THIS PUBLIC HEARING IS FOR RECONSIDERATION OF REZONING REQUEST, OUR 2020 DASH ONE ZERO DASH OH ONE FOR BEDDING COMMERCIAL DEVELOPMENT, LLC.MADAM CHAIR, THE APPLICANT IS REQUESTING TO REZONE APPROXIMATELY 6.45 ACRES FROM AGRICULTURAL TO COMMERCIAL FOR A SHEET STORE WITH FUEL PUMPS.
AND THE PROPERTY IS IDENTIFIED AT TAX MAP 31 AND A PORTION OF PARCEL 39 AND IS LOCATED ON APPLE MOUNTAIN ROAD.
THE NORTHWEST CORNER OF INTERSTATE 66, THE PROPOSED USE OF FOUR SHEETS STORE WITH A DRIVE-THROUGH AND FUEL PUMPS FOR AUTOMOBILES IN GENERAL.
RETAILING IS A USE PERMITTED BY RIGHT IN THE COMMERCIAL ZONING DISTRICT, AS WELL AS AN AUTOMOBILE FILLING STATION.
AND A CONVENIENCE STORE IS ALSO PERMITTED BY RIGHT.

THE PLANNING COMMISSION VOTED THREE TO ONE WITH THE RECOMMENDATION TO APPROVE THE REZONING FROM AGRICULTURAL TO COMMERCIAL.
THE BOARD OF SUPERVISORS VOTED THREE TO DENYING THE REZONING APPLICATION ON TUESDAY, MAY 4TH, 2021.
THE BOARD OF SUPERVISORS VOTED TO RECONSIDER THE REZONING REQUEST FOR DUNNING COMMERCIAL DEVELOPMENT, LLC.

IN ADDITION, THE OWNER OF SAID PIECE OF PROPERTY AT THE BASE OF OUR COMMUNITY TOOK OWNERSHIP IN THAT LAND WITH THE FULL KNOWLEDGE OF WHAT THEY WERE BUYING AGRICULTURALLY ZONED LAND WAS WHAT IT WAS ZONED FOR AND HAS BEEN ZONED FOR FROM THE BEGINNING.
IT IS NOT FAIR TO HAVE HUNDREDS OF HOMEOWNERS HAVING TO SACRIFICE THEIR ABILITY TO LIVE PEACEFULLY IN THE COUNTRY SETTING THAT WE ALL MOVED HERE FOR IN ORDER TO APPEASE A SINGLE LAND OWNER THAT WANTS TO MAKE MONEY BY REZONING THE LAND.
AT WHAT POINT DO YOU ASK YOURSELF, WHAT'S THE RIGHT THING TO DO HERE? I COULD RECOUNT THE PREVIOUS TOPICS WE DISCUSSED AT THE LAST REVIEW AND POINT OUT THE POTENTIAL ISSUES WITH REGARD TO POSSIBLE WELLS, RUNNING DRY DISPLACING, HUNDREDS OF HOMEOWNERS AND LOSING A TREMENDOUS AMOUNT OF EQUITY AND PROPERTY VALUE.

I AM UNSURE OF WHY MR. CARTER IS UPSET AND WANTS TO PERSONALLY REOPEN THIS ISSUE AS IT IS MY UNDERSTANDING THAT THE LANDOWNER SLASH SHEETZ DID NOT EVEN APPEAL.

THE MAJORITY OF TAXPAYERS DIRECTLY AFFECTED BY THIS DECISION DO NOT WANT TO REZONE FOR THE SHEETZ PERIOD USING THE BUS STOP AS A BACKDOOR TO IMPLEMENT WHAT WAS ALREADY VOTED DOWN IN A PREVIOUS ATTEMPT.
AND WHILE YOUR CONSTITUENTS DO NOT WANT, SHOULD NOT BE HAPPENING.
THIS IS A STATE THAT I AM OPPOSED TO REZONING A PROPERTY LOCATED AT THE BOTTOM OF APPLE MOUNTAIN LAKE.
THIS ISSUE WAS DECIDED ON IN A MARATHON MEETING ON FEBRUARY 10TH, WITH THE OPPOSITION OF APPLE MOUNTAIN RESIDENTS CLEARLY EVIDENT IT WAS DENIED.
IT IS NOT CORRECT THAT ONE PERSON FOR WHATEVER REASON IS REQUESTING TO OPEN THIS ISSUE.
FOR WHATEVER REASON, SIDING SCHOOL BUS STOP, THE SCHOOL BUS STOP IS A COMPLETELY SEPARATE ISSUE AND SHOULD BE ADDRESSED AS SUCH THE PUBLIC HAS SPOKEN THE BOARD VOTED AND THE FOCUS SHOULD BE THE BUS STOP IN WORKING TOGETHER ON THAT ISSUE.

APPLE MOUNTAIN HOA OWNS LAND A HUNDRED YARDS OFF APPLE ORCHARD DRIVE, WHERE THE BUS STOP WAS ORIGINALLY.
THAT LOT WAS ORIGINALLY ALLOCATED FOR COMMUTER PARKING OR WINTER WEATHER PARKING FOR RESIDENTS.
ALL I'M ASKING IS TO RECONSIDER ALLOWING THIS LAND TO BE ZONED COMMERCIAL AND GIVE THE PEOPLE OF APPLE MOUNTAIN LAKE

THE PROPOSED STATION WOULD NOT POSE ANY EPA CONCERNS TO THE AREA DUE TO THE AMOUNT OF SAFEGUARDS REQUIRED BY FEDERAL STATE AND COUNTY REGULATIONS IN PLACE AND CURRENT CONTINUALLY MONITORED.
I AM WRITING TO SAY, I DO NOT AGREE WITH REVISITING THE REZONING OF THE LINDEN PROPERTY ON APPLE MOUNTAIN LAKE.

THIS PROMPTED THE SCHOOL BOARD AND DIVISION OFFICIALS TO LOOK FOR ALTERNATIVE SITES FOR A SCHOOL BUS STOP IN THE INTERIM, A NEW BUS STOP COULD COST AT LEAST A HUNDRED THOUSAND DOLLARS.
CARTER SAID END QUOTE, PAGE 27 OF THE 2019, 2020 FINANCIAL REPORT, WHICH IS SHOWN ON THEIR EMAIL SHOW.
THE PEOPLE ABOVE THE COUNT ABOVE ALL OF THE COUNTY SERVICES.
THE PEOPLE SPOKE AT A FEBRUARY 10TH MEETING AND THE BOARD LISTENED.
NOW, MR. CARTER CLAIMS TO SEE A BUDGET IMPACT, TAKING A DEAF EAR TO WHAT THE PEOPLE SAID ON FEBRUARY 10TH AND BRINGING THE MATTER BACK UP FOR DEBATE.
WE HAVE ALL BEEN WARREN COUNTY RESIDENTS SINCE 2001 WITH THREE CHILDREN HAVING BEEN IN AND ONE MORE CURRENTLY IN THIS COUNTY SCHOOL SYSTEM AND HAVE EXPERIENCED THE CHAOTIC SITUATION AT THE BUS STOP LOOP, BEING REFERENCED IN THAT ARTICLE.
AS FAR AS I'M CONCERNED, THE SITUATION SHOULD HAVE BEEN RESOLVED MANY YEARS AGO, AND IT'S THE COUNTY'S RESPONSIBILITY, NOT A COMMERCIAL ENTITY LIKE SHEETS.
THE FISCAL YEAR 2021, 2022 BUDGET SHOWS THE BOARD BUDGETED 1.2 MILLION ON EDA LITIGATION, BUT YET THEY ARE HAVING A HARD TIME ALLOCATING A HUNDRED THOUSAND DOLLARS ON A SCHOOL BUS STOP FOR THE APPLE MOUNTAIN LAKE COMMUNITY OF OVER 400 HOMES.
AS MY FINAL ITEM PAGE 17 OF THE AFOREMENTIONED CAFFER STAYS THE COUNTY VISION AS QUOTE, WARREN COUNTY WILL BE A THRIVING COMMUNITY THAT RETAINS ITS SAFE, SCENIC FRIENDLY, AND INVITING CHARACTER WITH LEADERSHIP THAT PUTS COMMUNITY FIRST AND IT WORKS COOPERATIVELY TO PRESERVE THE QUALITY OF OUR CLEAN WATER AIR, NATURAL RESOURCES AND SCENIC LANDSCAPE AND QUOTE.

THE WARREN COUNTY BOARD OF SUPERVISORS HAVE BEEN INVOLVED IN MANY ISSUES THAT HAVE CAUSED THE ELECTORATE TO DISTRUST THEM.
THIS RECONSIDERING OF A DECISION THAT WAS JUST RESOLVED IN FEBRUARY SMELLS OF A PAIN PAY OFF TO GET AROUND THE WILL OF THE PEOPLE.
WHAT ARE YOU ALL DOING? THE PROPOSAL TO REZONE? THIS AREA WAS A BAD IDEA IN FEBRUARY, AND IT CONTINUES TO BE A BAD IDEA.

THE WARREN COUNTY BOARD OF SUPERVISORS VOTED THREE TO TWO AT ITS FEBRUARY 10TH MEETING IN FAVOR OF A MOTION TO DENY THE REZONING APPLICATION FILED BY DUNNING COMMERCIAL DEVELOPMENT.
SO THAT AS SHEETS TRUCKSTOP COULD NOT BE BUILT ON THE PROPERTY ALMOST IMMEDIATELY, BUT NOT EXPECTEDLY DOTTING COMMERCIAL DEVELOPMENT LLC DENIED THE COUNTY AND THE SCHOOL AND THE SCHOOL CHILDREN LIVING IN THE APA MOUNTAIN LAKE SUBDIVISION.
THE BENEFIT OF A SMALL PORTION OF THE PROPERTY THAT BEEN USED AS A SCHOOL BUS TURNAROUND FOR LONGER THAN THE ALMOST 20 YEARS, I'VE BEEN A RESIDENT OF THE SUBDIVISION IN RESPONSE TO THIS TONY CARTER, THE WARREN COUNTY BOARD OF SUPERVISORS MEMBER REPRESENTING THE HAPPY CREEK DISTRICT REQUESTED THAT THE BOARD RECONSIDER THEIR REQUEST AND HOLD ANOTHER PUBLIC HEARING NOW SCHEDULED FOR TONIGHT.
MR. CARTER STATED IN AN EMAIL QUOTE.
MY REASON FOR RE-EVALUATING THE REZONING IS THE LACK OF A BUS STOP.
THIS ISSUE IS BEING LOOKED AT AND REVIEWED BY VEDA AND THE SCHOOL'S TRANSPORTATION DEPARTMENT FURTHER, MR. CARTER HAS SAID A NEW BUS STOP COULD COST AT LEAST A HUNDRED THOUSAND DOLLARS.
HE HAS NOT MADE PUBLIC HOW HE HAS COME UP WITH THIS AMOUNT OR WHY HE CONSIDERS THE REZONING OF THE AFOREMENTIONED PROPERTY.
SO THAT AS SHEETZ BUSINESS OF SOME KIND CAN BE BUILT AT THAT LOCATION, BEING THE ONLY OPTION FOR A BUS STOP AT THE FEBRUARY 10TH MEETING RESIDENTS AND BUSINESS OWNERS OF LINDEN OVERWHELMINGLY REJECTED THE REZONING AND THEY DO SO.
AGAIN, THE LIST OF REASONS GIVEN BEFORE AND AT THAT MEETING AND ALL FORMATS HAS NOT CHANGED.

I'VE ALSO DRIVEN PAST THE EXIT AND COME BACK FROM FRONT ROYAL TO AVOID HAVING TO STOP ON 66.

ONE STUDY FOUND CONTAMINANT LEVELS WERE FIVE TO 30 TIMES HIGHER THAN URBAN RESIDENTIAL RUNOFF.
ONE CAN REASONABLY EXPECT THE RUNOFF TO BE SEVERAL TIMES HIGHER THAN OUR RURAL APPLE MOUNTAIN LAKE RUNOFF, EPA GUIDANCE ADVISES CAUTION WITH REGARD TO ALLOWING RUNOFF TO INFILTRATE SOIL, PARTICULARLY IN AREAS WHERE DRINKING WATER IS OBTAINED THROUGH WELLS SPILLAGE AT THE PUMP IS THE MOST FREQUENT CAUSE OF CONTAMINATION.
JOHNS HOPKINS UNIVERSITY RESEARCHERS FOUND THAT AN AVERAGE OF 40 GALLONS OF GAS IS SPILLED AT A TYPICAL GAS STATION PER YEAR AT THE PUMPS AND CAN MIGRATE THROUGH THE CONCRETE PADS.
SOME OF OUR NEIGHBORS ALREADY HAVE ISSUES WITH DECREASED WATER SUPPLIES, ANY COMMERCIAL ACTIVITY, AND PARTICULARLY AS SHEETS TAPPING INTO THE COMMON AQUIFER WILL FURTHER REDUCE THE SUPPLY OF WELL WATER, SHEETZ OR WARREN COUNTY PROVIDE US WITH ALL THE FILTERED WATER WE NEED IN PERPETUITY INCREASED TRAFFIC.

I COULDN'T FIND A REFERENCE FOR THE DECIBEL LEVELS OF A TRUCK BREAKING, BUT WE ALL KNOW FROM PERSONAL EXPERIENCE THAT THAT IS AT LEAST THE SAME NOISE LEVEL AS AN ACCELERATING TRUCK NOISE LEVELS DO HAVE REAL HEALTH CONSEQUENCES, THE MOST COMMON BEING INTERRUPTED SLEEP AND THE ACCOMPANYING DAILY FOCUS AND ATTENTION ISSUES.

DURING THIS MEETING, WE DISCUSSED SEVERAL DIFFERENT SOLUTIONS WITH THE COOPERATION OF THE APPLE MOUNTAIN LAKE POA BOARD AND WARREN COUNTY PUBLIC SCHOOLS, TRANSPORTATION.
THE TRANSPORTATION DEPARTMENT IS CURRENTLY LOOKING INTO THE PROPOSED SOLUTIONS TO SEE, WHICH IS THE MOST FEASIBLE APPLE MOUNTAIN LAKE HAS GROWN OVER THE LAST 20 YEARS AS HAS THE COUNTY, ALL COUNTY BOARDS SCHOOL AND SUPERVISORS SHOULD HAVE REALIZED THAT THERE WOULD EVENTUALLY NEED TO BE A SOLUTION TO THE INCREASED STUDENT POPULATION.
JUSTICE SCHOOLS HAVE BEEN PLANNED AND BUILT.
SOCIAL BUS STOPS HAVE BEEN PLANNED AND BUILT.
THIS IS SIMPLY A LACK OF PLANNING WHILE WE ARE BEHIND IN OUR PLANNING.

THERE ARE NO COMMERCIAL ACTIVITIES AT THE NORTH SIDE OF EXIT 13, WHICH NOW ONLY SERVES AS THE ENTRANCE TO A LARGE RESIDENTIAL COMMUNITY.
WHILE THE DEVELOPERS PROFFER FOR A SCHOOL BUS ENHANCEMENT IS ALLURING RESIDENTS HAVE LEGITIMATE CONCERNS ABOUT POSSIBLE DEGRADATION OF THEIR WATER SOURCE AS WELL AS THE TRAFFIC HAZARD SUCH A BUSINESS WOULD CERTAINLY CREATE, REGARDLESS THAT THE APPLICANT IS OFFERED ASSURANCES, THAT POSSIBLE WATER PROBLEMS CAN BE MITIGATED.
THERE IS NEW GUARANTEED AT THAT CLAIM.
WHEREAS AT THE PROPOSED COMMERCIAL DEVELOPMENT IS PERMITTED AND THE CONCERNS THAT RESIDENTS ARE BORN OUT, THE RESULTS WOULD BE CALAMITOUS.
PROPERTY VALUES IN THE AREA WOULD PLUMMET TAX REVENUES WOULD BE DIMINISHED.
AND THE GENERAL REPUTATION OF OUR COUNTY WOULD SUFFER.
THUS SUCH RISKS SHOULD BE AVOIDED IF THERE IS A VALID NEED FOR SCHOOL BUS ENHANCEMENTS AT THAT LOCATION, OTHER SOLUTIONS ARE AVAILABLE SUCH AS PUBLICLY FINANCED PROJECT.
A ONE-TIME PROFFER WOULD NOT OFFSET UNDESIRABLE LONG-TERM ASPECTS OF THIS PROPOSAL, EVEN THOUGH DEVELOPMENT IS PERMISSIBLE AT THIS SITE, DOESN'T JUSTIFY THAT IT IS APPROPRIATE OR THAT OUR GOVERNING BODY SHOULD ALLOW IT WITH THE EXISTENCE OF CYLINDER, RETAIL BUSINESSES, ENCLOSED PROXIMITY RESIDENTS AND TRAVELERS WOULD GAIN NO ADDITIONAL SERVICE OPPORTUNITIES FROM THIS PROPOSAL.
AND THE COUNTY SHOULD NOT EXPECT A SUBSTANTIAL INCREASE IN REVENUE, REGARDLESS OF THE APPLICANT'S ASSERTION.
CONSEQUENTLY, THERE IS LIMITED UPSIDE TO PERMITTING THIS PROPOSAL AT THAT SPECIFIC LOCATION, BUT IT CARRIES SUBSTANTIAL RISKS.
I HOPE YOU RECOGNIZE THAT YOUR ALLEGIANCE SHOULD BE TO THE INTEREST OF THE MANY COUNTY CITIZENS IN OPPOSITION RATHER THAN TO THAT OF A SINGLE PROPERTY OWNER AND AN OUT-OF-STATE BUSINESS WITH EXPERIENCE IN PROVIDING SLICK PRESENTATIONS, THE OWNER HAS KNOWN THEIR PROPERTY WAS ZONED AGRICULTURAL, AND HE CAN CONTINUE TO USE IT IN THAT ZONING.

UM, SOME OF THE, UM, THE ALLOCATED PURPOSES OF THAT FUNDING INCLUDE, UM, PUBLIC TRANSIT AND TRANSPORTATION, CAPITAL IMPROVEMENT, PLAN PROJECTS, INFRASTRUCTURE, AND, UM, SCHOOLS.

ONE OF THE THINGS I LOVE AS A RESIDENT, I'M NEVER SCARED TO GO TO THE GAS STATION NO MATTER WHAT TIME.
AND I DID THIS TO BILLY, I GO TO THE APPLE, I GO APPLE GAS STATION OR EXXON I, BUT I ALSO HAVE GONE TO SEVEN 11.
THERE'S JUST SUCH A SENSE OF COMMUNITY HERE.
LIKE WHEN THE SNOW CAME, WE DIDN'T KNOW ANYBODY AND NEIGHBORS CAME AND PLOWED OUR DRIVEWAY BECAUSE I COULD NOT TRAVEL IT.

BUT IN ADDITION, THERE ARE SHEETS AT ALMOST EVERY EXIT ON 66, ONE BEING SEVEN MILES FROM LONDON IN FRONT ROYAL.
SO I DON'T UNDERSTAND SHEET'S POSITION OF WANTING TO BE A PART OF THE COMMUNITY AND LINDEN WHEN THEY ALREADY ARE IN FRONT ROYAL AND THEY HAVE NO OTHER PLANS FOR A DIFFERENT LOCATION.
SO I WONDER HOW DOES THAT MAKE SENSE? AND IT ALL THE OTHER SHEETS, THERE IS NO BUS STOP, NOT IN MANASSAS AND IN HAYMARKET, NOT AN OPAL, NOT IN WARRINGTON.

CARTER, WHAT HAS CHANGED BECAUSE THE COUNTY NEEDS A BUS STOP FOR OUR CHILDREN AND YOU DO NOT WANT TO PAY FOR IT.
THIS IS WHAT OUR TAX DOLLARS GO TOWARD.
OUR CHILDREN HAVE THE RIGHT TO A SAFE BUS STOP.
IS THERE A RESPONSIBILITY OF THE COUNTY TO PAY FOR IT? NOT TO GO BACK ON A DECISION THAT WAS MADE BASED ON THE BEST INTEREST OF THE COMMUNITY.
IT WOULD SEEM THAT THIS IS NOW A SEVERE CONFLICT OF INTEREST CONSIDERING THE EXPENSE OF A BUST UP, NOTHING ELSE HAS CHANGED BETWEEN THE TIME THAT WE WERE ALL HERE IN FEBRUARY, BUT IT DOES NOT SEEM FAIR OR HONEST FOR THE BOARD TO BE BRINGING THIS ISSUE BACK WHEN NODDED THE LAND OWNER OR THE DEVELOPER HAVE APPEALED THE DECISION.
ONE OF THE PRIMARY REASONS THAT THE PLANNING AND ZONING COMMISSION SUGGESTED TO APPROVE THE REZONING ORIGINALLY, AND YOU MRS. COOLERS AND MISS OATS VOTED IN FAVOR OF APPROVING.
IT HAD TO DO WITH THE RIGHTS OF THE LAND OWNER.
THAT ISSUE HAS BEEN LAID TO REST.
IT WAS AN ISSUE OF THE MAJORITY OF HOMEOWNERS OF APPLE MOUNTAIN AGAINST SHEETS AND THE PROPERTY OWNER WITH THE BOARD HAVING TO MAKE A DECISION IN FAVOR OF ONE OF THE OTHER, HAVE THE RESIDENTS OF WARREN COUNTY NOT BEEN THROUGH ENOUGH WITH THE EDA SCANDAL, WHERE IT WAS MADE ABUNDANTLY CLEAR THAT THERE ARE COUNTY OFFICIALS WHO DO NOT HAVE THE BEST INTEREST OF THE TAXPAYERS AND HOMEOWNERS OF WARREN COUNTY.
THIS IS A GREAT OPPORTUNITY FOR THE BOARD TO ACT WITH INTEGRITY, HONESTY, AND PERHAPS REGAIN SOME TRUST OF THE PEOPLE THAT YOU ARE ELECTED TO REPRESENT.

AND I WOULD ALSO LIKE TO POINT OUT TO THE BOARD, THE HOMES DIRECTLY NEXT TO LESS THAN 500 FEET, MY HOME INCLUDED, WHICH JUST PICTURED IN THAT SLIDE TO THE LEFT, THE HOME DIRECTLY BEHIND LESS THAN 500 FEET, THERE'LL BE NO BUFFER BETWEEN A COMMERCIAL GAS STATION.
MY HOME, ALL THE OTHER HOMES CLOSE NEARBY WERE UP UNTIL NOW.

THAT AMOUNT OF INCREASE IN TRAFFIC ON A ROAD THAT CAN BARELY HANDLE THE TRAFFIC.
IT HAS NOW SAFELY WOULD COST A LOT MORE TO REDEVELOP AND MODIFY THAT ROAD TO HANDLE THE TRAFFIC LEVEL.
NOT ONLY THAT WHEN THEY GET TO OREGON HOLLOW AND DISMAL HOLLOW TO COME INTO TOWN, MANY WOULD BE GOING DOWN DISMAL HOLLOW TO HAPPY CREEK AND INTO SIXTH STREET INTO FRONT ROYAL.
AGAIN, A LOT OF THAT AREA HAD, CAN NOT HANDLE THE TRAFFIC SAFELY AS IT HAS AT THE PRESENT TIME, THE INCREASE OF TRAFFIC WOULD BE DISASTROUS AND THE COST WOULD BE A LOT MORE THAN A HUNDRED THOUSAND DOLLARS TO FIX.
SHEETZ HAD SAID THAT, UH, THEY'RE CONCERNED ABOUT THE COMMUNITY AFTER HEARING EVERYTHING THAT WE'VE HEARD FROM THE RESIDENTS OF APPLE MOUNTAIN AND SURROUNDING COMMUNITIES.
IS THAT REALLY TRUE? IT MAKES ME WONDER BEFORE I RETIRED FROM THE AIR FORCE, I WORK IN GOVERNMENT WITH GOVERNMENT CONTRACTING AND AFTER RETIRING AND WORK AT THE GOVERNOR GAVIN GOVERNMENT CONTRACTOR, THE NUMBER ONE RULE WAS ALWAYS THROUGH A VOID OF ALL COSTS, EVEN THE APPEARANCE OF A CONFLICT OF INTEREST.

AND THAT'S WHY I REQUESTED THAT WE POSTPONE THIS TO THE 15TH.
