I OPPOSE RECONSIDERING THE REZONING REQUEST FOR THE PROPERTY AT EXIT 13.

WHEN I PREVIOUSLY QUERIED THE SUPERVISORS WHO ORIGINALLY SUPPORTED THE REZONING REQUEST, I HEARD A MAIN CONSIDERATION WAS PROPERTY RIGHTS, AND I AGREE THAT'S AN IMPORTANT PRINCIPLE TO SAFEGUARD.

HOWEVER, IN THIS CASE, THE PROPERTY OWNER HAS HAD AND CONTINUES TO HAVE FULL OPPORTUNITY TO USE THIS PROPERTY BY RIGHT, FOR A VARIETY OF AGRICULTURAL PURPOSES.

SYNTHI FIRST ACQUIRED IT THUS CONTINUING THE AGRICULTURAL ZONING IS NOT TAKING AWAY ANYTHING FROM THE PROPERTY OWNER, JUST BECAUSE THE PROPERTY OWNER WOULD BENEFIT FROM A REZONING DOES NOT ENTITLE THEM TO IT.

IN FACT, DOING SO MIGHT CAUSE OTHERS WITH AGRICULTURAL PROPERTY TO REQUEST A REZONING.

IF IT PROVIDED THEM A FINANCIAL BENEFIT.

ALSO THE COMPREHENSIVE

PLAN PROVIDES FOR COMMERCIAL DEVELOPMENT TO OCCUR WHERE PUBLIC WATER AND SEWER IS AVAILABLE.

AND THAT IS IT THE 3 45, 22 CORRIDOR OR IN THE TOWN, NOT AT THE ENTRANCE TO A LARGE RESIDENTIAL SUBDIVISION.

HAVING ANOTHER GAS STATION SLASH CONVENIENCE MARKET AT THAT EXIT WOULD NOT PROVIDE CITIZENS WITH ANY MORE SERVICES THAN ARE ALREADY OFFERED BY EXISTING BUSINESSES.

SO THERE'S NO REAL BENEFIT TO APPROVING THE PROPOSED DEVELOPMENT.

I BELIEVE THE ONLY REASON THE ISSUE IS BEING RECONSIDERED IS THAT THE APPLICANT'S PROPHET SCHOOL BUS AREA ADDRESSES AN OUTSTANDING ISSUE.

AS SUPERVISOR ODE SAID AT THE JUNE ONE MEETING, THAT'S A MATTER FOR THE SCHOOL BOARD TO ADDRESS SURELY THIS BOARD HAS ENOUGH ALREADY ON ITS PLATE AND SHOULD AVOID TAKING ON ADDITIONAL RESPONSIBILITIES, WHICH WERE IN SOMEONE ELSE'S DOMAIN, PREVIOUS CITIZEN, AS OVERWHELMINGLY ESTABLISHED THAT WHILE THE SCHOOL BUS ISSUE NEEDS A RESOLUTION, THEY ARE NOT WILLING TO ACCEPT THE NEGATIVE ASPECTS OF WHAT IS PROPOSED JUST TO SOLVE THAT PROBLEM.

ESPECIALLY SENSITIVE MAY ENDANGER THEIR WATER SOURCE.

OTHER REASONABLE BUS TRANSPORTATION SOLUTIONS ARE AVAILABLE TO THE SCHOOL BOARD.

SINCE THE PREVIOUS DECISION WAS TO DENY THE REZONING REQUEST, NO EFFORT IS REQUIRED TO PUT THIS ISSUE TO BED.

THE BOARD SHOULD SIMPLY MOVE ON TO THE NEXT AGENDA ITEM BECAUSE IT WOULD NOT SERVE THE PUBLIC'S INTEREST TO REVERSE THE STANDING DECISION, WHICH KEEPS THE LINDEN PROPERTIES OWNED AGRICULTURAL.

OUR COMMUNITY HAS FELT VERY DISRESPECTED FROM THE START OF THIS.

IT STARTED WITH OUR FIRST HEARING AT, UH, THE ZONING COMMISSION.

AND AFTER NEARLY ALL OF OUR RESIDENTS CAME AND SPOKE IN SEVEN LETTERS WERE RECEIVED AT THE END OF THE HEARING.

THE, UM, THE CHAIRMAN WENT ON TO EXPLAIN WHY WE SHOULDN'T HAVE THESE CONCERNS WHEN I SPOKE LAST TIME.

UM, I HONESTLY DID NOT FEEL LIKE EVERYONE WAS LISTENING AND, UH, TO BE FRANK, MR. CARTER, YOU WERE ON YOUR PHONE MOST OF THE TIME, LOOKING DOWN.

SINCE THIS HAS BEEN A DIFFICULT DECISION FOR THE BOARD, I INVITED ALL THE BOARD MEMBERS OUT TO, UH, TO VIEW OUR RESIDENTS OF YOUR ROAD, TO BETTER UNDERSTAND THE ISSUES.

UM, AND I DID NOT RECEIVE A YES RESPONSE.

WE'RE SIMPLY ASKING THE COUNTY TO RESPECT OUR LAW AS THEY HAVE RESPECT SIMILAR COVENANTS, UM, WITH, UH, HOS IN THE PAST.

AND I THINK IT'S VERY TELLING THAT IF THE COUNTY, UH, RULES IN FAVOR OF ALLOWING THIS, UH, SHORT-TERM RENTAL PERMIT, IT'LL BE UNPRECEDENTED, THAT, THAT, THAT HAS NEVER HAPPENED BEFORE LAST MONTH.

UH, MS. CHAIRWOMAN, YOU HAD MENTIONED THAT A CERTAIN LEVEL OF TRUST IS, UH, IS NEEDED BETWEEN THE COMMUNITY MEMBERS AND THE BUSINESS OWNER.

AND I REALLY APPRECIATE YOU MENTIONING THAT IT'S CERTAINLY TRUE, UH, PARTICULARLY IN OUR COMMUNITY.

UM, AND THEN AFTER THAT, IT WAS MENTIONED THAT THERE WAS CONFUSION AS TO, UM, WHY MR. CARPENTER WAS CONTINUING TO PURSUE THIS PERMIT AS, UH, WE HAD STATED, AND HE ACKNOWLEDGED THAT HE, UM, SAID THAT HE WOULD RESPECT THE OUTCOME OF THE BOAT AND WITHDRAWALS APPLICATION IF, UM, IF THE VOTE WAS AGAINST IT WITHIN OUR COMMUNITY, WITHIN OUR PROPERTY OWNERS ASSOCIATION.

AND HE DID NOT.

AND SO THERE, HE, UH, SAT IN MY HOME AND LOOKED

THEY SAY THAT THEY EVEN HAVE A LETTER OF A NEUTRALITY SAYING THAT THE PROPERTY OWNERS ARE GONNA STAY OUT OF IT.

THAT LETTER GOT REVERSED.

AND I BELIEVE ALL OF YOU GOT A COPY OF IT AT THE APRIL BEFORE LAST PROPERTY OWNERS ASSOCIATION MEETING THERE, WE, WE ROSE UP AND SAID, HEY, WE DIDN'T LIKE THAT LETTER.

AND WE WANT TO, TO OPPOSE THE DEVELOPMENT OF SHEETS.

SO WHEN THEY SAY THEY'VE GOT BACKING FROM, YOU KNOW, A BUY-IN FROM OUR PROPERTY UNDER THE ASSOCIATION, THAT'S NOT TRUE.

WE OPPOSED IT.

AND WE PUBLISHED A LETTER AND I BELIEVE, LIKE I SAID, YOU ALL HAVE IT.

THERE ARE OVER 500 HOMES ON APPLE MOUNTAIN.

AND EVERY ONE OF THOSE HOMES HAVE PROPERTY RIGHTS.

JUST LIKE THE GENTLEMAN WHO OWNS L-3 HAS PROPERTY RIGHTS, BUT THEY CAN'T BE ALLOWED TO ENCROACH ON OUR PROPERTY RIGHTS.

HIS RIGHT TO STRETCH ENDS AT OUR WELLS AND OUR AIR AT OUR, OUR LIGHTING AND THE TRAFFIC AND ALL THE THINGS THAT GO WITH IT.

YOU BE DAMAGING THE BUSINESSES THAT ALREADY EXIST IN THAT AREA.

NOT ONLY THAT, BUT IT WILL DETRACT FROM THE BEAUTY OF WARREN COUNTY AND OF LINDEN AND IS DIRECTLY ANTAGONISTIC TO WHAT WE VALUE HERE IN THE COMMUNITY.

WE'RE ALL SO LUCKY TO LIVE IN SUCH A BEAUTIFUL, HEALTHY GREEN PLACE.

AND WE SHOULDN'T DO ANYTHING TO DAMAGE THAT WE ALREADY HAVE ROUTE 66 PASSING DIRECTLY THROUGH LINDEN AND WARREN COUNTY.

AND WE SHOULDN'T COMPOUND THAT BY REZONING FOR COMMERCIAL DEVELOPMENT.

THE REZONING AND DEVELOPMENT AT EXIT 13 AND LINDEN WILL BE DETRIMENTAL FOR PUBLIC HEALTH WILL DETRACT FROM THE BEAUTY OF THE COUNTY AND IS THE WRONG DECISION FOR THE COUNTY.

AND WHILE I UNDERSTAND THAT WHEN YOU, I THINK I NEED TO MAKE IT VERY CLEAR WHEN YOU LIVE IN AN HOA, YOU GIVE UP A LOT OF THOSE RIGHTS AND YOU HAVE TO SEEK PERMISSION FROM THE HOA WHEN MR. CARPENTER AGAIN, AND I'M SORRY FOR REDDING.

AND THE THIRD TIME IN SIX MONTHS IS BECAUSE OF A REZONING REQUEST THAT IS PRIMARILY FOR THE BENEFIT OF A NON-RESIDENT LANDOWNER AND A VERY PROFITABLE CORPORATION BASED OUT OF PENNSYLVANIA.

THE STATED REASON THAT MR. CARTER ASKED FOR A RECONSIDERATION OF THE ORIGINAL VOTE AGAINST REZONING IS BECAUSE THE LANDOWNER EXACTED RETRIBUTION ON APPLE MOUNTAIN LAKE BY TAKING AWAY PERMISSION FOR THE SCHOOL BUS TO TURN AROUND ON HIS PROPERTY.

AND FOR SOME REASON IT'S BELIEVED WE MUST SPEND SOMEWHERE BETWEEN 60,000 AND A HUNDRED THOUSAND DOLLARS ON A BUS STOP IN LINDEN.

BUT WHAT MAKES US SO SPECIAL IF CHILDREN CAN BE PICKED UP ON ROUTE 55 AT HIGH KNOB, WHICH IF ANYONE THAT LIVES HERE KNOWS IS ONE OF THE MOST DANGEROUS PLACES TO BE IN A CAR OR A VEHICLE OF ANY KIND, UM, IF THEY CAN BE PICKED UP THERE AND THAT'S CONSIDERED ACCEPTABLE, WHY IS THE STANDARDS SO HIGH FOR APPLE MOUNTAIN? WHY IS IT ACCEPTABLE TO CONTINUE TO DRAG THIS PROCESS ON AND ON WHEN YOU'RE FORCING THE PEOPLE THAT ARE MOST EFFECTED, THE ONES WHO HAVE THE MOST TO LOSE BY THIS DEVELOPMENT, YOUR TAXPAYERS, YOUR CONSTITUENTS, TO COME HERE AND PLEAD WITH YOU AND TELL YOU, THIS IS NOT WHAT WE WANT.

WE DON'T WANT THE CRIME.

WE DON'T WANT THE POLLUTION.

WE DON'T WANT ALL THE PROBLEMS ASSOCIATED WITH THIS DUMPED AT OUR FRONT DOOR.

THE PROPERTY SUBJECT TO THE REQUEST WAS 1.6, SEVEN PLUS OR MINUS ACRES.

HOWEVER, THEY DID SUBMIT A BOUNDARY LINE ADJUSTMENT, WHICH WAS APPROVED TO CREATE A TWO ACRE PARCEL.

FIELD DAY IS AMATEUR RADIO'S BIGGEST NATIONWIDE EVENT EACH YEAR WITH MORE THAN 30,000 PARTICIPANTS ACROSS THE COUNTRY.

THE PURPOSE OF THIS EVENT IS TO DEMONSTRATE TO THE PUBLIC, OUR ABILITY TO PROVIDE SUPPLEMENTAL COMMUNICATIONS LOCALLY AND REGIONALLY ON BEHALF OF WARREN COUNTY IN THE EVENT OF A DISASTER OR EMERGENCY HAM RADIO FUNCTIONS INDEPENDENTLY OF THE INTERNET AND CELL PHONE INFRASTRUCTURE CAN INTERFACE WITH TABLETS OR SMARTPHONES, AND IT CAN BE SET UP ANYWHERE ALMOST ANYWHERE IN MINUTES.

THAT'S THE BEAUTY OF AMATEUR RADIO DURING A COMMUNICATIONS OUTAGE, AS YOU MAY KNOW, WARREN COUNTY M COM IS A GROUP OF LOCAL AMATEUR RADIO OPERATORS WHO HAVE VOLUNTEERED THEIR TIME AND EQUIPMENT TO ASSIST THE WARREN COUNTY OFFICE OF EMERGENCY MANAGEMENT IN TIMES OF PUBLIC NEED.

THE DECISION, THE ISSUE OF A BUS STOP IS A SEPARATE ISSUE THAT THE SCHOOL BOARD AND THE TRANSPORTATION OFFICE NEED TO RESOLVE.

IF A SCHOOL BUS STOPS LAST SHEETS WAS NOT APPROPRIATE THREE MONTHS AGO.

WHY WOULD IT BE APPROPRIATE? NOW? DOZENS OF PARENTS HAVE EMAILED CALLED, POSTED ON SOCIAL MEDIA THAT CAME TO THESE MEETINGS AND SPOKEN TO YOU AND MADE IT ABUNDANTLY CLEAR THAT THEY DO NOT THINK A GAS STATION BUS STOP IS AN APPROPRIATE SOLUTION.

I HAVE BEEN AT ALL OF THESE MEETINGS, INCLUDING THE FIVE-HOUR MEETING, WHERE THE MAJORITY OF APPLE MOUNTAIN OPPOSED THE SHEETS AND NOT ONE PARENT SPOKE IN FAVOR OF HAVING THEIR CHILDREN'S BUS STOP AT A GAS STATION.

AND IT HAS BECOME APPARENT THAT, UM, THERE'S A NEED TO REEVALUATE AND BRING THAT STUDY UP OR RENEW THAT STUDY.

UM, I ALSO ATTENDED THE RIBBON CUTTING AT THE NEW HOSPITAL AND, YOU KNOW, NOT ONLY IS THE TECHNOLOGY AND THE HOSPITAL BEAUTIFUL, BUT SOME OF THE MOST BREATHTAKING VIEWS, UH, I THINK THEY NEED TO TURN THE BEDS AROUND.
