THE OWNER RECENTLY FINISHED A BASEMENT SUITE IN THE DWELLING AND WOULD LIKE TO MAKE IT AVAILABLE YEAR ROUND FOR SHORT-TERM VISITATIONS, FOR COUPLES AND FAMILIES VISITING THE WARREN COUNTY AREA,

THE APPLICANT AND HIS WIFE WILL MANAGE THE PROPERTY PERSONALLY WHILE RESIDING IN THE MAIN SECTION OF THE DWELLING.

UH, THIS PROPERTY IS ZONED AGRICULTURAL IT'S IN THE HANDS ANDERSON THUNDERBIRD FARMS, SUBDIVISION SURROUNDED BY AGRICULTURAL ZONING WITH SINGLE FAMILY DWELLINGS.

UH, THE DWELLING ON THE SUBJECT PROPERTY WAS CONSTRUCTED IN 2016.

THIS PROPERTY HAS NOT HAD ANY PREVIOUS CONDITIONAL USE PERMITS ISSUED FOR USES IN THE AGRICULTURAL ZONING DISTRICT.

THE PROPERTY OWNER WAS ISSUED A NOTICE OF VIOLATION IN JANUARY OF THIS YEAR FOR OPERATING A SHORT-TERM TOURIST RENTAL WITHOUT AN APPROVED CONDITIONAL USE PERMIT UPON NOTIFICATION OF THE REQUIREMENT FOR A CONDITIONAL USE PERMIT, THE PROPERTY OWNER CEASED THE USE AND WORKED WITH COUNTY STAFF TO BEGIN THE CONDITIONAL USE PERMIT PROCESS.

THERE IS A HEALTH DEPARTMENT OPERATION PERMIT ON FILE APPROVING SIX OCCUPANTS FOR THE DWELLING THAT APPLICANT HAS PROVIDED DOCUMENTATION REQUESTING SIX OCCUPANTS AND, UH, WARREN COUNTY ASSESSMENT DATA LISTS THREE BEDROOMS IN THE DUET DWELLING.

UM, WE DID REQUEST COMMENTS FROM THE THUNDERBIRD FARMS POA, UH, AND I INCLUDED THEIR EMAIL RESPONSE IN YOUR PACKETS.

UM, BUT BASICALLY THEY HAD A VOTE TO, UM, BASICALLY GET RID OF SHORT-TERM TOURIST RENTALS IN THE COMMUNITY AND, UM, IT DID NOT PASS.

SO AT THIS TIME THEY DO NOT OPPOSE THE USE IN THIS DWELLING ALSO DOES MEET THE SETBACK REQUIREMENT TO ADJACENT SINGLE FAMILY DWELLINGS WITH THE CLOSEST WELLING 147 FEET TO THE SOUTHEAST FOR THE RECOMMENDED CONDITIONS.

I WILL READ THEM ALL, ALL OF THE CONDITIONS AS FIRST TIME.

UH, MOST OF THEM WILL BE THE SAME FOR ALL OF THE SHORT-TERM TOURIST RENTALS.

UH, SO WE'LL JUST READ WHAT'S DIFFERENT AFTER THIS ONE, UH, CONDITION NUMBER ONE, THE APPLICANT SHALL COMPLY WITH ALL WARREN COUNTY HEALTH DEPARTMENT AND WARREN COUNTY BUILDING INSPECTIONS IN VIRGINIA STATEWIDE, FIRE PREVENTION, CODE REGULATIONS AND REQUIREMENTS.

NUMBER TWO, THE MAXIMUM NUMBER OF OCCUPANTS SHALL NOT EXCEED SIX.

AS DETERMINED, ACCORDING TO THE HEALTH DEPARTMENT OPERATION PERMIT FOR A THREE BEDROOM DWELLING, NUMBER THREE, THE APPLICANT SHALL HAVE THE WELL DRINKING WATER TESTED ANNUALLY FOR ECOLAB AND COLIFORM BACTERIA, AND A COPY OF THE RESULTS SHALL BE SUBMITTED TO THE PLANNING AND HEALTH DEPARTMENTS.

NUMBER FOUR, THE APPLICANT SHALL HAVE THE SEPTIC SYSTEM INSPECTED ANNUALLY BY A STATE LICENSED INSPECTOR, AND A COPY OF THE RESULT SHALL BE SUBMITTED TO THE PLANNING AND HEALTH DEPARTMENTS.

IT DID NOT PASS BY ABOUT FIVE TENTHS OF A PERCENT.

SO THERE ARE A NUMBER OF PEOPLE WHO WOULD NOT WANT THE ROADS TO, UH, TO HAVE SO MANY VEHICLES, MORE VEHICLES THAN ALREADY OVER THERE FOR THE WEAR AND TEAR ON THE ROADS.

UM, THE PREVIOUS OWNER, UH, DID LIVE OUT OF THE STATE AND OWNED IT SINCE 1985.

AND THERE ARE CURRENTLY A NUMBER OF PROPERTIES ON THIS ROAD, WHICH HAVE BEEN ISSUED CONDITIONAL USE PERMITS FOR THIS USE BECAUSE THEY CANNOT BE BUILT ON WITH A SINGLE FAMILY DWELLING.

UH, STAFF HAS RECOMMENDED, AND THE PLANNING COMMISSION IS FORWARDED, UH, THESE CONDITIONS, UH, FOR THE USE.

NUMBER ONE, THE APPLICANT SHALL COMPLY WITH ALL WARREN COUNTY HEALTH DEPARTMENT REGULATIONS AND REQUIREMENTS.

UM, THIS SUBDIVISION IS A SMALL SUBDIVISION RIGHT OFF, UH, ROUTE 55 EAST AND HAS A ONE WAY IN ONE WAY OUT ROADS.

SO, UM, THERE, THERE'S A NUMBER OF, I GUESS, CHILDREN THAT LIVE IN THE SUBDIVISION.

SO THERE WERE SOME CONCERNS ABOUT, YOU KNOW, GUESTS WHO DON'T LIVE THERE.

UM, COMING IN AND OUT, UM, THE APPLICANTS HAVE REACHED OUT TO THE NEIGHBORS THIS TIME AND RECEIVED SOME POSITIVE RESPONSES SINCE THEY WILL BE ON SITE WITH, UH, GUESTS WHO ARE STAYING AT THE BED AND BREAKFAST.

UM, THE, UH, PLAINTIFF COMMISSION MOVE, UH, THIS FOR, WITH THE STANDARD CONDITIONS THAT WE HAVE FOR SHORT-TERM SOURCE RENTALS.

WENDLING HAS SAID, ONE OF THE MAIN DIFFERENCES IS THAT A SHORT-TERM TOURIST RENTAL, THE, YOUR TENANTS ARE THERE, OR YOUR GUESTS ARE THERE WHEN YOU'RE NOT, OR WE'VE HAD SOME WHERE THEY ARE, BUT YOU HAVE THE OPTION OF PEOPLE COMING TO STAY AT YOUR HOME WHEN YOU'RE NOT THERE A BED AND BREAKFAST REQUIRES YOU TO BE PRESENT, UM, ALL THAT REQUIRES YOU TO BE PRESENT WHEN YOU HAVE GUESTS.

THEY PLAN TO CONTINUE LIVING IN THIS SINGLE BEDROOM CABIN WHILE THE CONSTRUCTION PROCESS IS MOVE FORWARD UNTIL THEY RECEIVE A CERTIFICATE OF OCCUPANCY FOR THE OTHER DWELLING, THEN THEY WOULD MOVE INTO THAT.

THIS DWELLING WOULD THEN BECOME JUST A, SOMETHING FOR FAMILY AND FRIENDS TO BE ABLE TO UTILIZE.

UM, THEY COULD NOT RENT IT OUT, UH, AND FOR ANY KIND OF COMPENSATION.
