[C. Conditional Use Permit 2022-06-09, Cole and Danielle Haase for a Commercial Outdoor Recreational Operation Located at 19959 Fort Valley Road and Identified on Tax Map 10, Lot 110 and Tax Map 9, Lot 36A2 – Matt Wendling]

ITEM C, CONDITIONAL USE PERMIT 2022 DASH OH SIX DASH NINE COLE AND DAN HO FOR COMMERCIAL OUTDOOR RECREATIONAL OPERATION LOCATED AT 1990 OH, THAT'S A 19 99 59 FORT VALLEY ROAD AND IDENTIFIED ON TAX MAP 10 LOT ONE 10 AND TAX MAP NINE LOT 36 A TWO MR. WENLING? YES.

GOOD EVENING, MADAME CHAIR AND MEMBERS OF THE BOARD.

UH, THE APPLICANTS ARE REQUESTING THIS CONDITIONAL USE PERMIT FOR A COMMERCIAL OUTDOOR RECREATION OPERATION, WHICH WOULD CONSIST OF A SOFTBALL, BASEBALL, AND SOCCER TRAINING FACILITY.

THE APPLICANTS PURCHASED HIS PROPERTY IN APRIL, 2022 TO TURN IT INTO AN OUTDOOR INDOOR YOUTH SPORTS TRAINING CENTER.

THE PROPERTY IS THE FORMER SITE OF THE CHURCH OF WATER LAKE.

IT CURRENTLY HOUSES A CHURCH BUILDING AS WELL AS A 7,500 SQUARE FOOT ACCESSORY BUILDING AND OTHER SMALLER ACCESSORY BUILDINGS.

THE APPLICANTS HAVE RESUBMITTED

[00:10:01]

THEIR STATEMENT OF JUSTIFICATION, REVISING THEIR INITIAL PLANS FOR A SMALLER FACILITY THAN ORIGINALLY REQUESTED THE PLAN.

THEY PLAN TO HAVE A BY APPOINTMENT OR PRE-REGISTRATION OPERATION FOR INDIVIDUALS OR TEAMS TO USE THE FACILITY AND ARE LIMITING THE BUSINESS TO NO MORE THAN 20 VEHICLES AT ONE TIME DURING THEIR HOURS OF OPERATION.

THEY DO IMMEDIATELY PLAN TO INSTALL TWO OUTDOOR BATTING CAGES FOR TEAMS AND INSTRUCTORS TO USE OUTDOORS.

THEIR PLAN TO OUTFIT THE 7,500 SQUARE FOOT ACCESSORY BUILDING INTO TURF WITH THREE BATTING CAGES AND AT APPROXIMATELY 30 BY 100 INTERIOR FIELDING AND THROWING PRACTICE AREA FOR AVAILABILITY DURING INCLEMENT WEATHER AND DURING THE WINTER SEASON.

UH, THEY WOULD LIKE TO OPERATE MONDAY THROUGH FRIDAY FROM 3:30 PM TO 9:00 PM AND SATURDAYS FROM 9:00 AM TO 6:00 PM THIS PROPERTY HAD TWO PREVIOUS CONDITIONAL USE PERMITS ISSUED TO IT.

UH, WHEN THE CHURCH WAS IN OPERATION IN 1989, IT WAS FOR A TEMPORARY MOBILE HOME AND THEN IN 1993 FOR THE CONSTRUCTION OF THE ADDITION TO THE CHURCH, UH, IN THE AGRICULTURAL ZONING DISTRICT.

AND AT THAT TIME THE MOBILE HOME WAS TO BE REMOVED.

THE PROPERTY IS LOCATED APPROXIMATELY 0.33 MILES OR 1,729 FEET FROM THE INTERSECTION OF ROUTE FIVE TO THE ENTRANCE TO THE PROPERTY, AND THERE IS A 50 FOOT RIGHT OF WAY AT THE ENTRANCE, WHICH IS WHAT FORT VALLEY ROAD IS.

UM, THE PLANNING COMMISSION DID REVIEW THIS.

WE HAD, UH, THREE MEMBERS, UH, VOTE ON THIS AND THEY DID RECOMMEND DENIAL AFTER HEARING SOME OF THE CONCERNS FROM THE, UH, ADJACENT PROPERTY OWNERS AND NEIGHBORS.

I BELIEVE WE RECEIVED THREE UH, LETTERS FROM THEM, UM, AND MR. HENRY DID, UH, LIST HIS REASONS AS DUE TO NOISE AND TRAFFIC CONCERNS THAT IT WOULD CREATE.

AND AGAIN, THIS WAS FOR THEIR INITIAL APPLICATION PRIOR TO, UH, REVISING IT.

UM, STAFF DID MEET WITH THE BOARD OF SUPERVISORS FOR A WORK SESSION ON AUGUST 16TH TO ADDRESS QUESTIONS AND CONCERNS THEY HAD REGARDING THE LAND USE AND APPLICATION.

WE HAVE REVISED THE CONDITIONS SHOWING THE ADDITIONS AND DELETIONS TO THOSE PRESENTED TO THE PLANNING COMMISSION, WHICH THEY RECOMMENDED DENIAL OF AND BASED ON THE CHANGES SUBMITTED TO THE A BY THE APPLICANT AND WERE REVIEWED BY THE BOARD.

SO THE APPLICANT DID SUBMIT THE, THE, SOME OF THESE CHANGES.

NUMBER TWO, A SITE PLAN SHALL BE PREPARED AND APPROVED BY THE WARREN COUNTY PLANNING DEPARTMENT PRIOR TO THE ISSUANCE OF A CERTIFICATE OF ZONING SHOWING THE BUILDINGS PARKING AREA, OUTDOOR LIGHTING, TRASH, RECEPTIBLE SIGNAGE, OUTDOOR BATTING CAGES, AND OTHER APPLICABLE ZONING REQUIREMENTS.

THE APPLICANT.

NUMBER SEVEN, THE APPLICANTS SHALL ALL HAVE THE WELL WATER, UH, AND DRINKING WATER TESTED ANNUALLY FOR E COLI AND COLIFORM CON CONTAMINATION AND A COPY OF THOSE RESULTS SHALL BE SUBMITTED TO THE PLANNING DEPARTMENT.

UH, AS STATED, UH, WE DID RECEIVE, UH, SOME LETTERS FROM, UH, JASON PROPERTY OWNERS AGAIN FOR THE BOARD.

UH, I BELIEVE THREE OF THOSE.

UH, WE DID RECEIVE ONE LETTER IN THE SUPPORT OF IT, UH, WHICH WE RECEIVED TODAY, AND THEN TWO VIDEOS AND I BELIEVE MISS, UH, MRS. SHIRAKI WILL BE READING THOSE AND PLAYING THAT VIDEO.

UH, THIS PUBLIC HEARING HAS BEEN PROPERLY ADVERTISED ADJACENT PROPERTY OWNERS HAVE BEEN NOTIFIED.

I'LL BE GLAD TO ANSWER ANY QUESTIONS.

AND, UH, MR. MRS. HOAS IS HERE THIS EVENING

[00:15:01]

IF YOU HAVE ANY QUESTIONS OF THEM.

WOULD YOU LIKE TO SPEAK AT THIS TIME? UM, COLE HA AT 2 2 0 CEDAR SPRING DRIVE IN CHARLESBURG, VIRGINIA.

UM, GOOD EVENING, SUPERVISORS AND MEMBERS OF THE COMMUNITY.

UM, WE APPRECIATE THE TIME AND ATTENTION YOU'VE ALREADY GIVEN TO THIS PERMIT.

UM, MY WIFE AND I ARE HERE TONIGHT TO ASK FOR AN APPROVAL, VOTE FOR A PROPOSAL OF THE CONDITIONAL USE PERMIT FOR A YOUTH ATHLETIC FACILITY LOCATED AT 1 99 59 FORT VALLEY ROAD HERE IN WARREN COUNTY.

WE HOPE THAT WE'VE ANSWERED YOUR QUESTIONS THAT YOU'VE HAD SO FAR AND SINCE OUR PLANNING COMMISSION MEETING IN JULY, WE'VE TRIED TO ADDRESS ANY CONCERNS THAT NEIGHBORS HAVE HAD.

WE HOPE THAT WE CAN WORK TOGETHER WITH EVERYONE TO CREATE GREAT NEEDED ASSET TO THIS COMMUNITY.

OUR AMENDED PROPOSAL SUBMITTED TO THE BOARD AND INCLUDED IN THE AGENDA SCALES BACK OUR ORIGINAL PROPOSAL AND FOCUSES ON THE USE OF INDOOR OPERATIONS IN THIS C U P AS ALLOWED BY THE TAX AMENDMENT APPROVED BY THE BOARD ON, UH, AUGUST 23RD.

IN THIS AMENDMENT, WE'VE LIMITED OUR OUTDOOR USE TO DAYTIME ONLY BATTING CAGE USE AND WARM UP USE INSTRUCT FUTURE, INSTRUCT FUTURE, UM, PHASES OF OUR VISION TO ENSURE THAT NEIGHBORHOOD IMPACT IS MINIMAL.

WE'VE ADDRESSED CONCERNS ABOUT THE NUMBER OF PARTICIPANTS IN PARKING.

WE'VE NOTED THAT OUR FACILITY WILL BE FOR YOUTH USE AND WILL BE BY APPOINTMENT ONLY AND GEARED TOWARD TEAMS USE.

WE'VE NOTED THE CONCERNS FOR VDOT ABOUT ENTRANCES AND EXITS AND PLAN TO INCORPORATE SIGNAGE, ARROWS, UH, TO HELP DIRECT TRAFFIC FLOW.

WE'VE HEARD FROM THE COUNTY HEALTH DEPARTMENT ABOUT THE WATER TESTS AND WE'D LIKE TO NOTE THAT INBO SERVICES FROM EDINBURGH IS CURRENTLY CONTRACTED TO PERFORM BIAL SERVICES AND REPORTS ITS RESULTS TO THE DEPARTMENT OF ENVIRONMENTAL QUALITY, WHICH WILL ALSO SUPPORT TO THE HEALTH DEPARTMENT.

THE LAST SERVICE TEST WAS PERFORMED IN APRIL OF THIS YEAR DURING OUR PURCHASE, AND IT WAS DEEMED THAT THE WELL AND SEPTIC SERVICES ARE SAFE AND ADEQUATE.

WE'VE ALSO DEVELOPED A SAFETY PLAN THAT WAS SUBMITTED, UM, EARLIER IN THE DAY THAT ADDRESSES TRAINING FOR STAFF AND FIRST AID, WHICH WILL BE INCLUDED WITH EACH APPLICATION FOR USE.

ALSO, WE'VE DE WE HAVE DEDICATED OR WE WILL HAVE DEDICATED EMERGENCY SERVICES, LANES AND PARKING IN THE EVENT OF AN ACCIDENT OR INJURY.

THIS FACILITY WILL HELP DEVELOP THE YOUTH OF WARREN AND SURROUNDING COUNTIES INTO ATHLETES THEY DESERVE TO BE WHILE HELPING THEIR PARENTS WITH THE FINANCIAL AND TIME OBLIGATIONS AND NOT HAVING TO TRAVEL LONG DISTANCES, SPENDING MONEY AND TIME AWAY FROM HOME WHERE THEY'RE UTILIZING FACILITIES IN WINCHESTER, WARRENTON, AND EVEN GAINESVILLE TO SUPPORT THE DEVELOPMENT OF THEIR CHILDREN.

OUR PARTICIPATION IN YOUTH SPORTS FROM BEING COACHES FOR MANY YEARS, WARREN COUNTY GIRLS, LITTLE LEAGUE SOFTBALL PRESIDENT AND BOARD MEMBERS FOR MULTIPLE YEARS, RUNNING A YOUTH BILLIARD LEAGUE AT OUR OTHER BUSINESS AND DONATIONS TO MULTIPLE LEAGUES IN THE COMMUNITY.

ATHLETIC TEAMS AT OUR, AT OUR PUBLIC SCHOOLS SHOW OUR COMMUNICA OR SHOW OUR DETERMINATION TO PROVIDE OUR YOUTH IN WAYS THAT EXTEND WAY BEYOND THE PROPOSAL PRESENTED TODAY.

OUR COMMUNITY CONTINUES TO GROW RAPIDLY.

WE'VE SEEN YOUTH PARTICIPATION IN ALL SPORTS CONTINUE TO EXPAND IN RECENT YEARS, INCLUDING LARGE GROWTH IN GIRLS PARTICIPATING IN SOCCER AND LITTLE LEAGUE SOFTBALL.

JUST A MONTH AGO WE HAD A WARREN CURRENT, WARREN COUNTY GIRLS LITTLE LEAGUE SOFTBALL PLAYER, WIN HER WAY TO THE LITTLE LEAGUE WORLD SERIES HOME RUN DERBY FROM OUR SMALL TOWN.

SHE COMPETED WITH GIRLS ACROSS ALL, ALL THE US AND WAS ABLE TO FINISH THIS RUNNER UP.

SHE CURRENTLY TRAVELS OUTSIDE THIS COUNTY FOR MORE SPECIALIZED INSTRUCTION FOR HER TALENTS.

JUST IMAGINE IF MORE CHILDREN HAD A FACILITY TO USE IN THE AREA AND WHAT THEY COULD ALSO ACCOMPLISH.

AS WE GROW, COUNTY FIELDS ARE STRAINED.

FACILITIES FOR INSTRUCTION ARE LACKING AND MORE WHOLESOME ACTIVITIES ARE NEEDED.

THESE CHILDREN DESERVE THE SAME OPPORTUNITIES TO GROW IN THEIR INTERESTS LIKE THOSE IN NEIGHBORING COMMUNITIES.

THIS FACILITY WILL ALLOW THEM TO HONE THEIR BATTING, PITCHING, CATCHING, FIELDING, AND FOOTWORK SKILLS AMONG OTHER THINGS FOR FUTURE COMPETITION.

CURRENTLY, THE COUNTY FACILITIES ARE OVERWHELMED AND DO NOT HAVE MANY OPTIONS AVAILABLE FOR SPECIALIZED INSTRUCTION, ESPECIALLY DURING THE OFF SEASON.

THIS FACILITY WILL AID IN THAT INSTRUCTION AT NO COST OR EMPLOYEE TIME EXPENDITURES FROM THE COUNTY.

TONIGHT, YOU WILL HEAR FROM SOME OF OUR SUPPORTERS, MANY OF WHOM YOU SEE WEARING YELLOW T-SHIRTS.

SOME OF THESE SUPPORTERS WERE NOT ABLE TO ATTEND THE MEETING AND HAVE TAKEN THE TIME TO SIGN A PETITION AND SUPPORT THIS FACILITY AS OF LAST NIGHT.

WE HAVE OVER 230 SIGN SIGNATURES THAT WE BROUGHT WITH US TONIGHT, UM, AND WE'RE WILLING TO SUBMIT FOR YOUR REVIEW TONIGHT.

WE HEAR THAT YOU TONIGHT, WE ASK THAT YOU HEAR YOUR COMMUNITY MEMBER REQUEST FOR THIS FACILITY AND RECOGNIZE ITS GREAT NEED.

FINALLY, PLEASE REMEMBER THAT JUST LIKE YOU, WE ARE FOR THE YOUTH IN OUR COMMUNITY.

THANK YOU FOR YOUR TIME AND YOUR CONSIDERATION, AND WE'RE MORE THAN HAPPY TO ANSWER ANY QUESTIONS.

THANK OKAY.

OPEN THE PUBLIC HEARING.

ARE THERE ANY QUESTIONS FOR MR. HOS AT THIS TIME? NOT AT THIS TIME.

OKAY.

I I HAVE

[00:20:01]

ONE.

OKAY, SO THIS IS ACTUALLY FOR MR. WENLING.

SO THE, THE PROPOSAL THAT WAS DENIED BY THE, THE PLANNING COMMISSION IS NOT THE SAME PROPOSAL THAT WE ARE CONSIDERING TONIGHT.

CAN YOU TELL ME WHAT WAS REMOVED FROM THAT PROPOSAL? FROM, FROM THEIR NIGHT TO THIS NIGHT? YEAH, THE, THE PRIMARY THING THAT WAS REMOVED WERE PHASES TWO AND THREE OF OKAY.

THEIR ULTIMATE FIRST PLAN OR THEIR, THEIR FIRST APPLICATION, WHICH WOULD'VE INCLUDED AN INDOOR, UH, EXCUSE ME, AN INFIELD PRACTICE AREA OUTSIDE.

AND THEN ALSO THEY WERE LOOKING AT PUTTING IN A FULL FIELD FOR THAT THEY COULD PRACTICE BOTH IN, IN FIELD AND OUTFIELD AND POTENTIALLY HAVE GAMES, UH, THAT KIND OF THING.

UM, WHICH, SO ABOUT THE LITTLE LEAGUE FIELD, UH, BASICALLY A LITTLE LEAGUE FIELD, WHICH, UH, WAS A PRETTY LARGE SCOPE FOR THIS, UH, SITE.

UM, AND, AND EVEN WE, WE DID STAFF EVEN HAD LITTLE CONCERNS ABOUT THAT, UH, FOR THE AMOUNT OF TRAFFIC THAT THAT MIGHT BRING IN.

OKAY.

BUT THAT'S WHAT THE APPLICANT INITIALLY SUBMITTED.

THAT'S WHAT WE BROUGHT FORTH TO THE PLANNING COMMISSION AND THAT'S WHAT THE PLANNING COMMISSION HEARD, UM, COMMENTS FOR FROM CITIZENS AND AND, UH, STAFF.

SO TONIGHT'S CONSIDERATION IS FOR INDOOR FACILITIES AND ONE OUTDOOR BATTING CAGE.

THAT'S, THAT'S OUR PLAN.

OUR OUR TWO, YEAH, TWO OUTDOOR OUTDOOR BATTING CAGES THAT WILL BE USED FOR INSTRUCTION OR WARMUP, IF I REMEMBER CORRECTLY.

CORRECT.

I I WANTED IT FOR MY OWN CLARIFICATION, BUT I ALSO WANTED IT FOR COMMUNITY CLARIFICATION AS WELL, BECAUSE OFTEN PEOPLE DON'T SEE THE INITIAL PLANNING COMMISSION MEETING TO UNDERSTAND WHAT HAS CHANGED.

SO THANK YOU.

YEAH.

BEFORE WE START, I DO HAVE BLANK QUESTION BEFORE WE START THE PROCESS OF ALL THOSE SIGNATURES, HOW MANY WE'RE FROM THE FORK DISTRICT? FROM THE FORK DISTRICT? YEAH.

UM, I, WE, WE HAVE ALL THEIR ADDRESSES ON HERE, BUT I DIDN'T ACTUALLY GO THROUGH AND DETERMINE, UM, WHERE THOSE WERE.

OH, HOW MANY, YOU KNOW, WHERE THEY'RE LOCATED, HOW MANY ON FORT VALLEY, UH, HOW MANY ON FORT VALLEY? I CAN, I CAN LOOK THROUGH THIS WHILE WE HAVE THE PUBLIC HEARING AND I CAN COME BACK AND GIVE YOU THAT ANSWER.

YES, I'D LIKE TO KNOW THAT.

OKAY.

AND THEN WE WILL HAVE OTHER OPPORTUNITIES TO ASK MORE QUESTIONS.

MM-HMM.

, BECAUSE I HAVE A LOT OF QUESTIONS, BUT I'LL WAIT TILL THE PUBLIC HEARING IS COMPLETED.

OKAY, THANK YOU.

THANKS.

I'LL JUST MENTION ALSO THAT THEY PUT THAT IT SHALL BE BY APPOINTMENT OR RESERVATION ONLY, SO IT'S NOT JUST ANYBODY SHOWING UP.

THEY'RE, THEY'RE GONNA HAVE CONTROL OVER THAT A LITTLE BIT BETTER CONTROL WITH THAT, UH, SECOND SUBMISSION OF THE APPLICATION, THE VOLUME.

YEAH, THAT'S RIGHT.

THANK YOU.

ANY OTHER QUESTIONS BEFORE WE OPEN IT? THIS IS SHAI.

I KNOW YOU HAVE SOME PEOPLE SIGNED UP.

SO IF YOU WOULD START THAT WITH, AND I APOLOGIZE IN ADVANCE IF I MISPRONOUNCE YOUR NAME.

UH, DAWN TAKA TO KESH AND IF YOU WOULD, UM, STATE YOUR NAME AND ADDRESS WHEN YOU COME UP TO THE PODIUM PLEASE.

MY NAME IS DON TUCKER AND I LIVE AT 4 76 DOGWOOD FARM ROAD, UM, UP IN THE FARMS. AND I'M SPEAKING TO SUPPORT THE ARENA SPORTS AND EVENT CENTER BECAUSE THE POSITIVE IMPACT THAT WILL HAVE ON SO MANY KIDS IN THE, THE AREA.

UM, SPORTS AND ACTIVITIES WHERE KIDS CAN BE A PART OF A TEAM OR A COHORT.

A COHORT WHERE THEY LEARN TO SUPPORT AND BUILD EACH OTHER UP OR CRUCIAL IN DEVELOPING THEM TO BE FUTURE LEADERS AND UPSTANDING MEMBERS OF THE COMMUNITY.

WITH COLIN DANIELLE'S SUPPORT, I, ALONG WITH THE HELP OF SOME IN THE LOCAL BILLIARDS COMMUNITY, RUN AN INSTRUCTIONAL JUNIORS POOL LEAGUE AT THEIR OTHER BUSINESS.

ON Q, WE PROVIDE A SAFE LEARNING ENVIRONMENT FROM KIDS FOR KIDS FROM AGES SEVEN TO 17 TO LEARN HOW TO PLAY POOL AND SOME OF THEM GOING TO COMPETE, GO ON TO COMPETE AT HIGHER LEVELS OF PLAY.

THIS GIVES THEM AN ACTIVITY WHERE THEY CAN GROW MENTALLY, EMOTIONALLY AND PHYSICALLY.

CURRENTLY WE'VE GOT 17 KIDS AND WE'RE GROWING.

THE KIDS COME AND SHOW AN EXCITEMENT FOR THE GAME IN OUR TIME TOGETHER EVERY TIME WE MEET.

SO I HAVE NO DOUBT THAT COLE AND DANIELLE WILL PROVIDE THE SAME ENVIRONMENT FOR AT, FOR THE KIDS AT THE SPORTS FACILITY THAT THEY DO AT OUR POOL HALL.

SO OBVIOUSLY I'M HERE TO SUPPORT OR TO ADVOCATE FOR THE SPORTS COMPLEX TO BE APPROVED.

BOTH

[00:25:01]

BOYS AND GIRLS WILL BENEFIT TREMENDOUSLY FROM HAVING A PLACE WHERE THEY CAN CONTINUE TO HONE THEIR SKILLS IN A SPORT THAT THEY LOVE AND THEY DON'T HAVE TO TRAVEL ALL OVER THE PLACE TO DO IT.

WE DON'T CURRENTLY HAVE A FACILITY LIKE THIS IN THE LOCAL AREA AND UM, IT WOULD BE GREAT FOR US TO BE ABLE TO BRING THAT HOME TO OUR KIDS.

SO COLE AND DANIELLE, I'VE KNOWN THEM PERSONALLY AND THEY'VE BEEN INVOLVED IN COMMUNITY SPORTS FOR MANY YEARS WITH THEIR OWN CHILDREN AND OTHER KIDS IN THE COMMUNITY.

SO THEY KNOW, THEY KNOW WHAT KIND OF SUPPORT THE KIDS NEED FOR THEIR TEAM, FOR THEIR TEAM SPORTS OR FOR THEMSELVES FOR THEIR OWN GROWTH.

AND THEY'VE ALREADY HAD A POSITIVE IMPACT ON SO MANY CHILDREN, SO I'D LIKE TO BE ABLE TO SEE THEM BE ABLE TO CONTINUE TO HAVE THIS POSITIVE IMPACT ON THEM.

SO LET'S VOTE YES FOR THE KIDS, DON'T THEY DESERVE IT? THANK YOU.

TOBY BROWN.

HELLO, UH, MY NAME IS TOBY.

I LIVE AT 44 ELMWOOD ROAD IN FRONT ROYAL.

UM, HELLO LADIES AND GENTLEMEN.

THANK YOU FOR YOUR TIME TODAY.

I SAY BEFORE YOU AS A LIFELONG MEMBER OF THIS COMMUNITY, I'M IN HERE.

I'M HERE IN SUPPORT OF THE ARENA SUPPORTS AND EVENT CENTER.

I COULD STAND HERE AND GIVE YOU STATISTICS ABOUT FUNDING AND THE IMPORTANCE OF BEING INVOLVED IN TEAM SPORTS, BUT THOSE THINGS ARE THINGS YOU ALREADY KNOW.

INSTEAD, I'M GONNA TALK TO YOU ABOUT COLE, DAN COLE, DANIELLE, AS EVERYONE KNOWS THEY OWN AND OPERATE ON KE KILL, UM, BUT THEY AREN'T JUST WITH BUSINESS OWNERS.

THEY'RE AVID ACTIVISTS FOR THE YOUTH IN OUR TOWN.

I KNOW PERSONALLY, MY NIECE PLAYS FOR FIRE SOFTBALL.

THEY SPONSORED HER TO GO TO A NATIONAL CHAMPIONSHIP, UH, IN 2021.

THEY'VE ALSO DONATED NUMEROUS THINGS TO ALL THE EVENTS THAT FIRE HOLDS TO RAISE MONEY TO SEND THESE GIRLS TO ALL OF THEIR TOURNAMENTS FROM ALL OVER THE COUNTRY.

UM, AS DAWN SAID, THEY STARTED THEIR POOL LEAGUE FOR CHILDREN.

UM, THEY TOOK A KIND OF ROUGH AND TUMBLE BOYS IN TOWN, TURNED IT AROUND AND MADE IT A FAMILY FRIENDLY ENVIRONMENT.

UM, THE ENVIRONMENT ON Q IF YOU'VE EVER BEEN THERE IS VERY MUCH LIKE EVERYBODY'S FAMILY.

EVERYBODY'S WELCOME.

UH, AS AN ADULT THAT'S SO IMPORTANT TO FEEL THAT SENSE OF COMMUNITY.

IMAGINE WHAT THEY CAN DO WITH CHILDREN IN THIS AREA.

UM, THE POINT IS THAT COLON DANIEL OPEN, OPEN HOPES TO OPEN THE SPORTS ARENA WITH THE INTENTION OF BETTER THE LIVES OF MANY THE KIDS IN THIS COMMUNITY, MEANING MORE OF THAT, NOT LESS.

THE KIDS HERE HAVE BEEN THROUGH SO MUCH THIS LAST YEAR AND THEY COULD REALLY USE A WIN.

I DO NOT LIVE IN THAT AREA, BUT MY 72 YEAR OLD MOTHER-IN-LAW DOES.

UM, SHE'S PROBABLY LESS THAN A MILE.

UM, AND THIS IS SOMETHING SHE'S SO EXCITED ABOUT.

HER DAUGHTER PLAYED GIRLS SOFTBALL.

IT WAS UNDERFUNDED.

UM, THE, THE FIELDS WERE NEGLECTED.

THEY DIDN'T GET THE SAME ATTENTION AS FOOTBALL OR BASEBALL DID BY ANY MEETINGS.

SO THIS IS LIKE EXCITING.

UM, I FEEL LIKE THE NOISE ISSUE, I MEAN, IT'S JUST KIDS LAUGHING AND HITTING BALLS AND HAVING FUN.

UM, I'VE LIVED, I LIVED IN TOWN FOREVER.

I COULD ALWAYS HEAR BEAN CROSBY THE NIGHT GAMES, UH, AND BASEBALL GAMES SET.

AND IT WAS FUN.

IT WAS EXCITING.

THE, THE KIDS WERE OUT HAVING A GOOD TIME AND FIRST, YOU KNOW, WE WERE THE FOOTLOOSE TOWN BECAUSE OF THE DONUT SHOP AND THEN THE SCANDAL HEARD AROUND THE WORLD WE WERE THE ED.

LET US NOT TO DECIDE TO BE THE COMMUNITY KNOWN FOR PUTTING OUR KIDS LAST.

THANK YOU FOR YOUR TIME.

THANK YOU BRIAN ROSATI.

GOOD EVENING AND THANK YOU FOR THIS OPPORTUNITY.

MY NAME IS BRIAN ROSATI AND I RESIDE AT 2 78 WATER PLANT ROAD OUTSIDE OF MIDDLETOWN IN WARREN COUNTY.

I'M THE RECENTLY APPOINTED PRESIDENT OF THE WARREN COUNTY GIRLS OF LEAGUE SOFTBALL.

AS YOU KNOW, WE'RE A YOUTH LEAGUE FOR REX SOFTBALL WHERE WE SUPPORT AGES FIVE THROUGH 17.

THE GOAL OF THE LEAGUES BE A RESOURCE FOR THE YOUTH TO BE ACTIVE AND HEALTHY, TO DEVELOP SKILLS IN A BALL FIELD AND CONFIDENCE IN THEMSELVES TO FOSTER FRIENDSHIPS ON AND OFF THE FIELD.

WE HAVE MORE THAN 280 GIRLS PLAYING ACROSS 20 TEENS.

WE ARE THE LARGEST SOFTBALL

[00:30:01]

LEAGUE REC LEAGUE IN THIS AREA.

OVER THE PAST FEW YEARS, WE'VE SEEN GROWTH IN OUR MAJORS AND SENIORS DIVISION BRINGING MORE MIDDLE SCHOOLERS AND HIGH SCHOOLERS TO THE FIELD THAN WE'VE SEEN BEFORE.

THIS ALLOWS US THE OPPORTUNITY TO IMPACT THESE YOUTH DURING A TIME OF DEVELOPMENT IN THEMSELVES WHERE THEY'RE MOVING FROM CHILD TO YOUNG ADULT.

THIS ALSO GIVES 'EM AN OUTLET AND A PLACE TO SPEND THEIR TIME AWAY FROM OTHER INFLUENCES THAT MAY NOT BE AS DESIRABLE.

WHEN WE LEARNED THAT THIS FACILITY INTENDED TO OPEN IN OUR COMMUNITY, WE WERE EXTREMELY EXCITED.

COLE AND DANIELLE HAVE BEEN VOLUNTEERS IN THE LEAGUE AND SUPPORTERS OF THE LEAGUE FOR MANY YEARS.

THEY UNDERSTAND ITS PURPOSE, THEY ALSO UNDERSTAND ITS STRUGGLES.

THEY'VE ALWAYS BEEN WILLING TO HELP THE KIDS AND HAVE VOLUNTEERED IN ANY OPPORTUNITY WHENEVER ASKED.

CURRENTLY WE ONLY HAVE THREE FIELDS TO USE AT CHIMNEY AND WE HAVE TO DO THAT WEATHER PERMITTING.

THE FIELDS ARE SHARED AMONGST ALL OF OUR TEAMS FOR BOTH GAMES AND PRACTICES.

YOU CAN IMAGINE THE STRAIN THAT THIS PUTS ON OUR SCHEDULING AND OUR ABILITY TO SUPPORT 280 GIRLS.

OUR SCHEDULES ARE VERY LIMITED TO WHAT WE CAN DO WITH SO MANY KIDS TO PROVIDE FOR.

WE'RE ALSO RELIED UPON FOR INNER LEAGUE PLAY.

OTHER COUNTIES COUNT ON PLAYING OUR TEAMS SO THEIR GIRLS CAN PLAY BALL.

IN MANY CASES, WE HAVE BEEN THE ONLY OPTION FOR SOME TEAMS OR SOME LEAGUES TO BE ABLE TO COME PLAY AND GIVE THEIR GIRLS THE OPPORTUNITY TO GO ON THE FIELD DURING OUR ALL STAR TOURNAMENTS.

OUR LEAGUE DOES STRUGGLE WHEN COMPETING WITH TEAMS OUTSIDE OF THIS AREA WHO HAVE YEAR ROUND RESOURCES.

THESE SAME LEAGUES ALSO SEE PLAYERS THAT GET SCHOLARSHIPS AND OPPORTUNITIES TO PLAY AT COLLEGE LEVEL WHERE OUR GIRLS CAN SOMETIMES STRUGGLE BECAUSE OF THE LACK OF OPPORTUNITY TO HONE THEIR SKILLS.

THE ONLY INDOOR FACILITY AVAILABLE TO US CURRENTLY IS THE 15TH STREET GYM AND THIS IS WHEN IT'S AVAILABLE BECAUSE THAT RESOURCE IS SHARED AMONGST OTHER LEAGUES AND OTHER COMMUNITY ACTIVITIES, THERE'S NO OTHER RESOURCES IN THIS AREA.

THOSE WHO ARE CURRENTLY GOING TO OTHER OPPORTUNITIES ARE TRAVELING TO WINCHESTER, TO MANASSAS OR EVEN FARTHER.

AND SOME OF THE KIDS THAT WE HAVE IN OUR LEAGUE DON'T HAVE THE OPPORTUNITY TO TRAVEL THAT DISTANCE.

THE PROPOSED FACILITY WOULD PROVIDE AN OPTION FOR OUR TEAMS AND OUR PLAYERS TO BE ABLE TO USE AND GROW IN THEIR SKILLS.

IT WOULD OPEN THE DOOR FOR PLAYERS TO DEVELOP NOT JUST IN COMPETITION, BUT ALSO TO DEVELOP IN THEIR SKILLS TO COMPETE FOR SCHOLARSHIPS OR DIVISION ONE LEVEL SCHOLAR, UH, OPPORTUNITIES IN COLLEGE.

WE KNOW THAT WE HAVE TALENTED YOUNG LADIES IN OUR AREA.

WE RECENTLY HAD ONE OF OUR LITTLE LEAGUERS GO ON TO THE LITTLE LEAGUE WORLD SERIES HOMER ON DERBY.

IF YOU DIDN'T GET A CHANCE TO SEE IT, IT AIRED ON ESPN.

WE WERE EXTREMELY PROUD TO SEE THAT SHE TOOK SECOND PLACE, BUT WE KNOW THAT SHE'S NOT THE ONLY DIAMOND THAT WE HAVE.

THERE ARE MANY OTHERS THAT WE SEE ON THE FIELD ALL THE TIME, THE CHALLENGER AND IN TWO IS THE RESOURCES TO HONE THOSE SKILLS.

AND WHILE THE LEAGUE DOES EVERYTHING THAT WE CAN, INCLUDING HAVING SEVEN BOARD MEMBERS STRETCH TO ALMOST FULL-TIME LEVEL WORK TRYING TO PROVIDE, WE JUST DON'T HAVE THE RESOURCES IN THE AREA.

ALLOWING THIS FACILITY TO GRANT ITS PERMIT WOULD GIVE US AN OPTION TO WORK WITH THEM, TO HAVE OUR TEAMS GO OUT THERE WHEN NEEDED AND TO HAVE TRULY GOOD TIME IN THE WINTER WHEN THE GIRLS HAVE NOWHERE ELSE TO GO, TO GO OUT AND DEVELOP THOSE SKILLS TO COME BACK AND CONTINUE TO COMPETE.

WE HOPE THAT YOU'LL GRANT CONSIDERATION TO ALLOWING THEM THE PERMIT AND HELP THEM FILL A GAP THAT WE HAVE IN THE COMMUNITY.

THANK YOU SIR.

SUE RUSSELL.

SUE RUSSELL .

YOU CAN PULL IT DOWN, MA'AM.

OKAY, THANK YOU.

ALL RIGHT.

HI, MY NAME IS SUE RUSSELL.

I LIVE AT 26 MESS ROAD.

I AM THE LADY WHO IS ON TWO SIDES OF THE PROPOSED, UH, EVENT CENTER THAT, UH, IS BEING DISCUSSED THIS EVENING.

I HAVE A DEGREE IN EDUCATION WITH A CERTIFICATION IN HISTORY, WHICH IS MIDDLE SCHOOL HISTORY.

I HAVE SUB FOR THE LAST NEARLY 19 YEARS IN THE MIDDLE AND HIGH SCHOOL AREA.

I'M VERY FAMILIAR WITH THESE KIDS.

I HAVE NO PROBLEMS WITH THEM.

IN FACT, MIDDLE SCHOOLERS ARE MY FIRST LOVE.

SO NOISE IS NOT REALLY THAT BIG OF ISSUE WITH ME AS LONG AS IT'S WITHIN A REALM.

WE'RE TALKING ABOUT MY PROPERTY JUST RIGHT THERE AND WE'RE TALKING ABOUT THESE DESIGNATED HOURS AND WE'RE TALKING HOUR AFTER HOUR AFTER HOUR.

THAT'S WHERE MY PROBLEM IS.

I'VE BEEN CONCERNED FROM THE BEGINNING WITH THE VAGUENESS THAT I'VE HAD OUTLINED IN THE PROPOSALS THAT I'VE BEEN GIVEN, THE PLANS, THE IMPLEMENTATIONS, THE OVERALL KNOWLEDGE OF THE AREA, THE PEOPLE AND THE LAND HAS BEEN A CONCERN TO

[00:35:01]

MINE.

THEY TALK ABOUT THE USE OF THE 7,500 FOOT FACILITY AS BEING USED IN WINTER AND IMPLEMENTED AND IMPLEMENT WEATHER.

UH, DOES THAT MEAN THEN THAT THEY'RE GONNA USE THE OUTSIDE WHENEVER IT'S NOT WINTER OR THE WEATHER IS NICE AND SUNNY? THAT'S NOT, THAT'S NOT SOMETHING THAT'S DISCUSSED HERE.

UH, THEY WANT TO EXPAND ANOTHER FIVE PLUS ACRES, BUT THEY DON'T SPECIFY FOR WHAT REASON.

THAT'S KIND OF ALARMING TO ME.

AND WE'VE ALSO ADDED SOCCER TO THE MIX.

NOW I COME FROM A SOCCER BACKGROUND.

I JUST CAME FROM ROANOKE FROM A SOCCER GAME FROM MY GRANDDAUGHTER WHO JUST HAD HER NINTH BIRTHDAY.

SO, UM, I'M VERY FAMILIAR WITH SOCCER.

UH, IT'S CALLED AN EVENT CENTER NOW.

OKAY, PLEASE DEFINE WHAT INVENT IS.

HOW WILL OVERLAPPING BE HANDLED WHEN GROUPS COME IN? ALL RIGHT, WE'RE TALKING ABOUT WHENEVER ONE GROUP COMES IN AND ANOTHER, THEY'RE WAITING FOR THEIR OTHER GROUP TO TO TO LEAVE.

WE'RE TALKING ABOUT THE OUT, I'M TALKING ABOUT THE OUTDOOR BATING CAGES.

I REALLY DON'T HAVE A PROBLEM WITH THE INDOOR, IT'S THE OUTDOOR AREA THAT I FEEL IS NOT AS ADDRESSED AS IT SHOULD BE.

THERE SEEMS LIKE THERE'S A LOT OF PLANS, BUT VERY LITTLE MEET AS TO WHAT THEY WANNA DO.

SO HOW IS THAT GOING TO BE HANDLED? IS THERE GONNA BE A STAFF MEMBER OUT THERE OR ARE THEY DEPENDING ON THE COACHES AND THE PARENTS? ANOTHER THING WHERE THE PARENTS GONNA BE SITTING, WHERE ARE THE CHILDREN GONNA BE SITTING? WHENEVER SOMEONE'S IN THE BATING CAGES, WHAT ARE THE OTHERS GONNA BE DOING? THEY'RE GONNA KID OUT.

THAT MEANS THEY'RE GONNA BRING THEIR GLOVES, THEIR BALLS, THEIR BATS.

ALL RIGHT, WHAT ARE THEY GONNA DO? THEY'RE GONNA PRACTICE IN THAT BIG AREA BETWEEN BY MY HOUSE AND WHERE I GUESS THE BATTING CAGES ARE GONNA GO BECAUSE IT'S GONE FROM 50 FEET TO 125 FEET.

SO I REALLY DON'T KNOW WHERE THEY'RE GONNA BE PUTTING THEM.

ALSO, WHAT TYPE OF BARRIERS ARE THEY GONNA PUT BETWEEN ME AND THEM? THAT HASN'T BEEN DISCUSSED EITHER.

UM, SUNDAYS THEY TALK ABOUT, OKAY, THEY'RE CLOSED ON SUNDAY, BUT DOES THAT MEAN THAT FRIENDS AND FAMILY CAN'T COME OUT AND USE THE OUTDOOR BATTING CAGES? I ASK FOR ONE DAY A WEEK IN WHICH THE OUTDOOR BATTING CAGES NOT BE IN USE AND I'M ASKING FOR THAT TO BE SUNDAY.

THEY CAN DO ALL THEY WANT FROM THE INDOOR, JUST PLEASE DON'T OPERATE THOSE OUTDOOR BATTING CAGES.

I HAVE BEEN LISTENING TO VIDEOS AND SOUNDTRACKS OF OUTDOOR BATTING CAGES AND BELIEVE ME, IT'S NOT A FUN THING TO DO.

UH, ARE THEY GONNA HAVE PARTIES OUT THERE? I'M SURE.

LIKE I SAID, I JUST CAME FROM MY NINE YEAR OLD GRANDDAUGHTER'S BIRTHDAY PARTY TOO, WHICH WAS A SWIM PARTY.

SO I FIGURED IF THEY'RE GONNA HAVE PARTIES OUT THERE, HOW'S THAT GONNA BE HANDLED? WHEN ARE THEY GONNA HAVE 'EM? WHAT HOURS? UM, K THE OUTDOOR SUPERVISION.

UH, ONE OF THE BIG ISSUES THAT I HAVE, MY HUSBAND IS A CIVIL ENGINEER.

ONE OF THE BIG PROBLEMS WE HAVE IS WITH ANY WORK THAT THEY DO, ANY FIELD WORK THAT THEY DO ON THEIR PROPERTY CAUSES PROBLEMS WITH MY PROPERTY.

WE'RE TALKING ABOUT POSSIBLE FLOODING ON MY PROPERTY, UH, THE DISRUPTION OF DRAINAGE FROM THE MOUNTAIN WHEN IT RAINS DOWN THROUGH MY PROPERTY, THROUGH THE LOW AREA THERE BY THEIR PROPERTY, AND THEN ONTO THE CREEK, WHICH GOES THEN ONTO THE SHENANDOAH.

HOW IS THAT GOING TO BE? IF THERE IS ANY, UH, WORK DONE, UH, DIRT WORK, THEN THERE HAS TO BE DRAINAGE CONSIDERATIONS FROM MY PROPERTY, FROM WHAT'S GOING ON, WHICH MEANS THAT I DON'T WANNA SEE ANY DOZERS, ANY BACKHOES, ANYTHING OUT THERE WITHOUT FIRST GOING THROUGH THE COUNTY, THROUGH THE, UH, WARREN COUNTY EROSION AND SEDIMENT CONTROL AND ALSO THE LAND DISTURBANCE PERMITS.

THERE HASN'T BEEN ANY POSTED.

AND ON THE SEPTEMBER 2ND, THIRD AND FOURTH, THAT'S WHAT THEY WERE OUT THERE DOING.

THEY WERE OUT THERE GRADING A LITTLE, I D DUNNO, WHY THINGS SO BACKHOE AND THERE WAS A, UH, A LITTLE DOZER TYPE THING THAT WAS OUT THERE MOVING EARTH.

NO MATTER HOW SLIGHT, IT DOESN'T MATTER, IT DOESN'T TAKE MUCH IN ORDER TO CAUSE A PROBLEM ON MY PROPERTY.

MY PROPERTY'S ARE ALREADY LOSING VALUE BECAUSE OF THIS EVENT CENTER.

THEY'RE, I JUST DON'T WANT A WHAT IF THEY'RE ALLOWED TO BUILD A, A HOUSE ON THAT PROPERTY THAT GIVES THEM, ACCORDING TO WHAT I'VE READ HERE, A RIGHT TO PUT MORE BUILDINGS ON THAT PROPERTY.

ALL RIGHT.

DOES

[00:40:01]

THAT MEAN THEY HAVE TO COME BACK THROUGH THIS, UH, THIS UH, UH, ISSUE AGAIN THROUGH YOU IN ORDER TO FIND OUT EXACTLY WHAT THEY WANNA PUT ON THE PROPERTY, WHERE THEY WANNA PUT IT? WHAT'S IT FOR? UH, I JUST DON'T WANT TO BE GIVEN, I DON'T WANT THEM TO BE GIVEN A CARTE BLANCHE.

I KNOW THAT WHAT THEY'RE WANTING TO DO IS IMPORTANT.

MY GRANDSON IS IN, UH, ELEMENTARY HERE AND HE'S IN HIS SECOND YEAR OF BASEBALL HERE AND HE LOVES IT.

I ASK HIM, I SAID, WHAT DO YOU THOUGHT ABOUT THAT? HE THINKS IT'S GREAT.

OKAY, WELL CODY, I'M GLAD YOU THINK IT'S GREAT , BUT WHAT ABOUT THE NOISE? AND HE SAID, WELL, NO, HE DIDN'T WANT THE NOISE AND EVERYTHING, BUT HE WAS EXCITED ABOUT IT AND THAT'S WONDERFUL.

BUT I DON'T WANT OUTSIDE TO BECOME THIS MENAGERIE OF NOISE OF DISRUPTION WITHOUT ANY CONSIDERATION FOR ME.

I'M RIGHT NEXT DOOR.

THANK YOU SO MUCH FOR THE, UH, OPPORTUNITIES THAT YOU'VE GIVEN ME TO CONTACT YOU FOR THE QUICK RESPONSES.

OH MY GOSH, YOU WOULDN'T EVEN KNOW YOU WERE GOVERNMENT FROM THIS QUICK RESPONSES THAT YOU ALL HAVE GIVEN ME AND I APPRECIATE IT SO MUCH IN THE DIRECTIONS THAT YOU'VE POINTED ME.

THANK YOU SO MUCH.

THANK YOU MA'AM.

I THINK RICK NOVA.

MM, THANK YOU GUYS.

UH, I'M GONNA, I I WEAR A COUPLE DIFFERENT HATS, UH, FOR THIS TODAY.

ONE IS AS THE OPERATOR OF ROYAL FAMILY BOWLING CENTER FOR I GUESS OVER 20 YEARS, AT LEAST ONCE A YEAR, SOMEBODY HAS APPROACHED ME ABOUT PUTTING IN BATTING CAGES OR AN INDOOR SPORT FACILITY OR CAN WE HAVE SOMETHING LIKE THE SPORTS PLEX.

UH, IT'S A VERY EXPENSIVE THING TO DO AND HONESTLY I HAVEN'T HAD, YOU KNOW, THE UH, THE ENERGY TO APPROACH THAT.

BUT I THINK THIS IS A GREAT THING.

UM, FOR OUR COMMUNITY.

I COME, UH, WEARING THE HAT OF A PARENT AS A PARENT.

I HAD, UH, SEVERAL KIDS THAT GREW UP HERE AT DIFFERENT TIMES AND THEY ALL PLAYED SPORTS AND PRACTICE TIME AND FACILITIES HAS ALWAYS BEEN A CHALLENGE.

OH, WE CAN'T GET IT.

WE CAN ONLY DO IT HERE.

WE CAN ONLY DO IT THERE.

OH, THIS IS REALLY INCONVENIENT.

WELL, WOULD WE RATHER, YOU KNOW, PRACTICE IT THIS TIME? YOU HAVE A PRIVATE ENTERPRISE WANTS TO PROVIDE THESE INSTEAD OF YOU GUYS BUILDING THEM.

I MEAN, I WOULD RECOMMEND THAT YOU GO BACK AND APPROVE PHASE TWO AND THREE.

I DON'T EVEN KNOW WHAT THE PLANNING COMMISSION WAS THINKING.

I DON'T THINK THEY EVEN WENT OUT TO THE PROPERTY.

I DON'T KNOW THAT.

BUT AS SOMEBODY WHO WENT OUT TO THE PROPERTY, IT'S OBVIOUS TO ME THAT THIS IS A CHURCH ON THE ROAD AND THEN IT'S A COMMERCIAL ENTERPRISE BEHIND IT.

THERE'S 50 TONS OF AIR CONDITIONING OUT THERE, 50 TONS AT MY BOWLING CENTER, I HAVE ABOUT 20 TONS.

SO THE SHIP SAILED.

THERE'S AN ICE CREAM STAND THERE, THERE'S A SNACK BAR THERE, THERE'S AN OPEN PIT TO BARBECUE.

I MEAN, THESE THINGS SOUND GREAT.

I DON'T REALLY KNOW WHAT THE HISTORY OF THE PROPERTY IS, BUT IT HAS ALREADY BEEN DOING THESE THINGS AND MORE.

SO I WOULD URGE YOU TO PAVE THE WAY FOR THESE PEOPLE.

UM, THEY'RE DOING OUR COMMUNITY A FAVOR, IN MY OPINION AS TO KNOW NOISE.

I GET IT.

YOU KNOW, I WAS AT MY HOUSE THIS WEEKEND AND THERE WERE PEOPLE, I DON'T KNOW, A COUPLE A MILE AWAY THAT WERE RIDING THEIR FOUR WHEELERS AND THEY WERE HAVING A GOOD TIME.

THEY WERE, THEY HAD 'EM WOUND OUT.

WELL, YOU KNOW WHAT? I'M PRETTY SURE IT'S ALLOWED.

SO I THINK SOME KIDS LAUGHING AND HITTING SOME BALLS OUTSIDE WOULD BE PREFERABLE TO ME THAN FOUR WHEELERS AND FOUR WHEELERS ARE OKAY.

I DON'T HAVE ANYTHING AGAINST FOUR WHEELERS, BUT JUST NOT AS A

[00:45:01]

PLEASANT AS SOUND AND WHAT A GREAT THING THAT WE WOULD HAVE OUR KIDS GO OUTSIDE.

WOW.

OUTSIDE.

I DON'T KNOW.

IT JUST, I I, MY HEAD EXPLODED WHEN I HEARD THAT THIS GOT TURNED DOWN INITIALLY AND I HOPE THAT YOU GUYS TONIGHT WILL FIX THAT.

THANK YOU.

THANK YOU SIR.

MR. JONES IS IN THE AV ROOM TRYING TO FIGURE OUT THE MIC SITUATION.

MISS COLORS, WOULD YOU MIND TALKING INTO YOUR MICROPHONE? NOPE.

I'M STILL SEEMS TO BE ALL AS LONG AS THEY CAN HEAR YOU CALL NAMES THOUGH.

THAT'S THE IMPORTANT PART AT THIS TIME.

SO THAT WAS ACTUALLY EVERYONE WHO WOULD SIGNED UP TO SPEAK.

WE DO HAVE THE TWO VIDEOS PULLED UP AND THE EMAILS TO BE READ, BUT I'LL LEAVE IT AT YOUR DISCRETION WHETHER TO DO THAT NOW OR TO ALLOW THE PEOPLE WHO ARE HERE TO SPEAK FIRST.

WELL, WE READ WHAT YOU HAVE AND DO THE VIDEOS AND THEN I'LL OPEN IT UP TO ANYONE ELSE WHO WOULD LIKE TO SPEAK.

THERE YOU GO.

YOUR MICS ON NOW? I'M GOOD.

YEAH.

OH, SO THESE ARE TWO VIDEOS THAT THE HA EMAILED TO US THAT HAVE BEEN SUBMITTED BY INDIVIDUALS WHO WERE UNABLE TO ATTEND THIS EVENING.

HI, I'M MARTY AND I'M JUST GONNA COME OUT THE FUN AND UM, DON'T MIND ANY OF OUR OUTFITS PLEASE BECAUSE IT IS BBA AT SKYLINE.

HI, I'M AND AT SKYLINE SOFTBALL AND UM, WE ARE FROM WARRENTON.

WELL OUR TEAM IS WARRENTON, SO WE HAVE TO DRIVE ABOUT TWICE OR THREE TIMES A WEEK, JUST LIKE AN HOUR.

AND I THINK IT WOULD US A LOT OF MONEY LIKE GASS AND UM, OUR PARENTS, SOMETIMES OUR PARENTS TO GO AND THEY HAVE TO GET OFF WORK AND GO THERE.

LIKE, IT JUST SAVED US A LOT OF TIME AND IT A FOR US LIKE TO HAVE SOMETHING HERE FOR OUR TEAM AND OUR FRIENDS AS WELL.

REALLY GOOD FOR EVERYONE.

HI STUDY.

I COULD HAVE A CLOSES ME PRACTICE AND JIMMY AND WE'RE BOTH FROM THE VARSITY SOFTBALL TEAM, VARSITY BASKETBALL.

WE BOTH PLAY FOR TEAM MIZUNO.

UH, THAT SOFTBALL TEAM IS LOCATED AROUND AN HOUR AWAY FROM HERE IN BETON AND BOOK AREA.

UM, IT WOULD REALLY BENEFIT US BECAUSE ON BRAND DAYS WE CAN JUST GO INSIDE THE SPORTS IN IT.

UM, ALSO IF THEY'RE TRYING TO ROCK THE, UM, GYM FLOOR AND OUR GYM, THEY, WE CAN GO TO SPORTS, PLAY BASKETBALL THERE, VOLLEYBALL IN THERE, BUT THROUGH THE THANK YOU.

THANK YOU.

HI, GOOD EVENING.

MY NAME IS SHAWN KELLY AND I AM CURRENTLY THE GIRLS VARSITY BASKETBALL COACH AT SKYLINE HIGH SCHOOL.

PREVIOUS TO THAT, I WAS THE BOYS AND GIRLS VARSITY BASKETBALL COACH AT COUNTY HIGH SCHOOL.

UH, ALSO SERVED AT THE JD SOFTBALL COACH, ONE COUNTY FOR SEVERAL YEARS AND WE COACHED SEVERAL SOFTBALL AND BASKETBALL TRAVEL TEAMS IN THE FRONT WORLD.

THE PAST 20 YEARS, YOUTH SPORTS HAS BEEN A IN THE SUCCESSFUL ATHLETES, STUDENT ATHLETES AND JUST GOOD YOUNG MEN AND WOMEN IN THE FRONT WORLD AND WARREN COUNTY AREA, ALL THREE OF OUR CHILDREN PARTICIPATED THE SPORTS THEY LEARNED TO, TO THRIVE, RESPONSIBLE AND LEARN TO WORK HARD JUST TO ACHIEVE THEIR DREAMS. THE OPPORTUNITY THAT ARENA SPORTS EVENTS AND THEY WILL PROVIDE FOR, FOR CHILDREN LIKE MY OWN AND FOR OTHER CHILDREN IN THE AREA WILL BE A GREAT ASSET FOR OUR COMMUNITY.

MY OWN DAUGHTER PLAYS TRAVEL SOFTBALL.

SHE'S CURRENTLY A SENIOR AT SKYLINE HIGH SCHOOL AND WE PLAY COLLEGE SOFTBALL NEXT YEAR.

[00:50:01]

WE TRAVEL TO CLUB, WE TRAVELED ORIGINALLY.

WE TRAVEL TO WARTON ALL OVER THE PLACE TRYING TO FIND A PLACE FOR HER TO WORK OUT TO A FACILITY LIKE THIS.

WE'RE NOT JUST HELP HER.

WHAT HELPED NUMEROUS ATHLETES BECOME MORE RESPONSIBLE, WORK HARD RUN TO PLAY THEIR RIGHT WAY, BUT ALSO DERIVING A PLACE NEARBY THAT, THAT THEY AND THEIR TEAMMATES, KIDS IN COMMUNITY WILL FIND WAYS TO BE SUCCESSFUL.

UM, I DO HOPE THAT THIS NOTION WITH US, I FULLY SUPPORTED AND I LOOK FORWARD TO SEEING THIS BUSINESS BECOME A GREAT ASSET.

NOT JUST FOR FOR ALL OUR COMMUNITY, BUT ESPECIALLY FOR THE STUDENT ATHLETES.

THANK YOU.

AND THEN I ALSO HAVE A FEW EMAILS TO READ MADAM CHAIR.

THE FIRST IS FROM DEBORAH JONES OF 2 52 MESS ROAD.

I AM WRITING TO GIVE MY DISAPPROVAL OF THE POSSIBILITY OF TURNING THE CHURCH PROPERTY INTO AN OUTDOOR RECREATIONAL AREA.

MY LAND JOINS THIS PROPERTY AND I DO NOT WANT A FACILITY LIKE THIS IN OUR AREA.

I AGREE A FACILITY LIKE THIS IS NEEDED, BUT CERTAINLY NOT IN OUR AREA.

WE HAVE TOO MUCH TRAFFIC NOW.

NEXT IS FROM PATTY SIMS. I'M WRITING AN OPPOSITION TO APPROVAL OF CONDITIONAL USE PERMIT FOR COLE AND DANIELLE HOS FOR COMMERCIAL RECREATION OPERATION AT 1 99 59 FORT VALLEY ROAD.

THIS IS PRIMARILY A RESIDENTIAL AND FARMING AREA.

TRAFFIC LITTER AND ACCIDENTS HAVE INCREASED HUGELY IN RECENT YEARS DUE TO MORE RESIDENTIAL BUILDING FROM ROUTE 55 ALL THE WAY INTO THE VALLEY ROAD IS NARROW AND FEEL THIS WILL ONLY INCREASE THE AMOUNT OF ACCIDENTS, NOISE AND LITTER.

THINK FACILITY OF THIS NATURE WOULD BE WELCOME ON AIR, ON AREA, BUT NOT AT THIS LOCATION.

THANK YOU FOR YOUR CONSIDERATION.

NEXT IS FROM SUSAN POE.

MY NAME IS SUSAN POE AND I OWN 99 76 FORT VALLEY ROAD, WHICH IS RIGHT ACROSS THE STREET FROM THE CHURCH.

AS A SMALL BUSINESS OWNER, I APPRECIATE AND SUPPORT OTHER SMALL BUSINESSES.

HOWEVER, THIS AREA IS RESIDENTIAL AND FARMLAND.

BY APPROVING THIS CONDITIONAL USE PERMIT, YOU WILL BE SPOT ZONING AND DROPPING A COMMERCIAL PROPERTY RIGHT IN OUR BACKYARD.

EVEN WITH CONDITIONS.

THIS WILL OPEN THE DOOR FOR MORE IN THE FUTURE.

THE HOURS OF OPERATION FOR THIS BUSINESS WOULD BE EVENING HOURS AND WEEKENDS WHEN THERE ARE HIKERS, CAMPERS AND BICYCLISTS HEADING INTO THE NATIONAL FOREST.

INCREASING TRAFFIC WHEN SCHOOLS ARE LETTING OUT AND PEOPLE ARE GETTING HOME FROM WORKING ALL DAY.

FORT VALLEY ROAD, THE SCENIC ROUTE TO THE GEORGE WASHINGTON NATIONAL FOREST IS ALREADY OVERFLOWING WITH TRAFFIC WITH ACCIDENTS OCCURRING OFTEN AND THIS WILL ONLY ADD TO IT.

THE ROAD IS ALREADY CONSIDERED NARROW AND UNSAFE.

AFTER TALKING WITH VICKY COOK FORK DISTRICT SUPERVISOR, SHE WAS GETTING WITH THE WARREN COUNTY SHERIFF'S OFFICE FOR AN ACCIDENT REPORT ON THIS ROAD.

AND FINALLY IS AN EMAIL FROM SARAH VI VIAL.

FIRST OF ALL, THANK YOU FOR YOUR TIME REVISITING THE PROPOSAL OF ARENA SPORTS AND EVENT CENTER.

I AM A PARENT OF THREE ACTIVE CHILDREN HERE IN WARREN COUNTY AND MY PROFESSION IS A CHILD DEVELOPMENT SPECIALIST.

IT IS MY UNDERSTANDING THAT THE FIRST PROPOSAL TO INCORPORATE A SPORTING FACILITY ON FORT VALLEY ROAD WAS MET WITH DISAPPROVAL BY SOME OF OUR COUNTY CITIZENS.

TO THINK OF SUCH A WONDERFUL OPPORTUNITY FOR THE CHILDREN IN OUR AREA TO BE DENIED BRINGS ME MUCH SADNESS.

I AM AT ONE OF OUR PARKS OR RECREATIONAL FACILITIES ALMOST EVERY NIGHT OF THE WEEK IN EVERY SEASON WITH ONE OF MY CHILDREN AT A SPORTING EVENT, I WITNESS FIRSTHAND WHAT CONSISTENT SPORTS AND PHYSICAL ACTIVITY PROVIDES FOR A CHILD.

AND IT IS IRREPLACEABLE.

FRIENDSHIP, SUPPORT, GUIDANCE AND POSITIVE ADULT ROLE MODELS ARE ALL PRESENT AT THESE PRACTICES AND GAMES.

MANY CHILDREN WHO MAY BE BULLIED OR OF A DIFFERENT SOCIOECONOMIC CLASS COME TOGETHER AS TEAMMATES AND FRIENDS.

CHILDREN WHO COME FROM BROKEN HOMES ARE MAYBE STRUGGLING ACADEMICALLY, ARE GIVEN THE OPPORTUNITY TO BE GOOD AT SOMETHING AND TO FEEL LIKE THEY BELONG.

TO BE ABLE TO OFFER ADDITIONAL OPPORTUNITIES TO PRACTICE IN AN INDOOR FACILITY WOULD BE LIFE CHANGING FOR SOME OF THESE KIDS.

IT WOULD TAKE MANY KIDS TO THAT NEXT LEVEL TO RECEIVE A SCHOLARSHIP TO GO TO COLLEGE WHEN IT WAS OTHERWISE NOT AN OPTION.

IT WOULD PROVIDE CHILDREN THE CHANCE TO PRACTICE IN THE WINTER INSTEAD OF BEING ON SCREENS AND BECOMING MORE ANTISOCIAL AND INACTIVE.

HOSTING LOCAL SPORTING EVENTS WOULD BOOST ECONOMIC GAINS FOR LOCAL RESTAURANTS IN TOWN BECAUSE KIDS ARE HUNGRY AFTER PLAYING.

THIS FACILITY WOULD BRING TOGETHER SOCIAL OPPORTUNITIES FOR FAMILIES TO MAKE NEW FRIENDS, TO FIND SUPPORT IN THEIR PEERS AND TO BOOST THEIR CHILDREN'S MENTAL AND PHYSICAL HEALTH.

IT IS MY UNDERSTANDING THERE IS A CONCERN SURROUNDING THE UPTICK AND TRAFFIC IN THIS AREA.

LOGICALLY SPEAKING, THERE WOULD BE LITTLE INCREASE OF TRAFFIC IF THE FACILITY WERE STILL A CHURCH OR BECAME A DIFFERENT EVENT LOCATION.

THE ROAD ALSO LEADS TO THE ENTRANCE OF ELIZABETH FURNACE, WHICH IS A POPULAR DESTINATION FOR OUTDOOR ENTHUSIASTS.

CHILDREN IN OUR COMMUNITY SHOULD HAVE THE OPPORTUNITY TO ENJOY WHAT MAKES THEM ENTHUSIASTIC AS OUT OF TOWN TOURISTS.

FURTHERMORE, THE NOISE AND TRAFFIC THAT IS GENERATED FROM SKYLINE RANCH RESORT, ZONED AND LOCATED JUST DOWN THE ROAD FAR SURPASSES ANYTHING AN INDOOR SPORTING FACILITY WOULD BRING.

I URGE YOU TO ACCEPT THE PROPOSAL OF SUCH A WONDERFUL OPPORTUNITY FOR THE CHILDREN IN OUR COMMUNITY.

AS A PARENT,

[00:55:01]

I WOULD LOVE FOR MY CHILDREN AND ALL OF THE CHILDREN IN OUR COUNTY TO BE GIVEN HEALTHY OPPORTUNITIES TO GATHER, BE ACTIVE, AND SOCIALIZE WITH THEIR PEERS.

THANK YOU FOR YOUR TIME AND CONSIDERATION.

AND THAT WAS THE LAST ONE.

YES MA'AM.

WOULD ANYONE ELSE LIKE TO SPEAK ON THIS ITEM AT THIS TIME? I THINK THAT YOUNG LADY HAD HER HAND AT FIRST, THEN YOU, HER IN THE BACK AND THEN YOU, SIR.

OKAY.

HELLO, MY NAME IS ARIANA WHITED.

UM, I LIVE AT TWO 20 CEDAR SPRING DRIVE IN STRASBURG, VIRGINIA.

I AM A GRADUATE OF STRASBURG HIGH SCHOOL AND GREW UP IN THE SCHOOLS OF WARREN COUNTY FROM KINDERGARTEN TO 11TH GRADE.

I'VE PLAYED SOFTBALL SINCE I WAS EIGHT YEARS OLD AND PLAYING ALL FOUR YEARS ON VARSITY IN HIGH SCHOOL AND WENT ON TO PLAY COLLEGE SOFTBALL AT MARY BALDWIN UNIVERSITY MY FRESHMAN YEAR.

MY PARENTS ARE DANIELLE AND COLE HA.

UM, GROWING UP I RELIED ON MY MOTHER TO DRIVE ME TO PRACTICES AND TOURNAMENTS HOURS AWAY ALMOST FOUR TO FIVE DAYS A WEEK, ALL WHILE WORKING FULL TIME.

THEN TO GIVE UP MY WEEKENDS OR HER WEEKENDS TOO.

UM, TO TRAVEL TO DIFFERENT COUNTIES AND TOURNAMENTS.

UM, I OWE A LOT OF APPRECIATION TO HER FOR MAKING ME A PRIORITY IN HELPING ME SUCCEED.

UM, TO HAVE A FACILITY LIKE THIS IN OUR TOWN WOULD BE BENEFICIAL FOR WORKING PARENTS TO BE ABLE TO SAY YES TO SPORTS AND TO HAVE THE TIME TO ONE SECOND, SORRY.

TO HAVE THE TIME TO BE THERE TO SUPPORT THEM WHILE TRAINING, TO BETTER THEIR SKILLS.

PLEASE DO CONSIDER THE PARENTS OF THE COMMUNITY THAT DO STRUGGLE TO COMMUTE TO DIFFERENT COUNTIES FOR PRACTICES AND GAMES.

WE HAVE THE OPPORTUNITY TO MAKE THIS HAPPEN LOCALLY AND WITH YOUR HELP, WE CAN MAKE MY PARENTS VISION COME TRUE.

THANK YOU.

THANK YOU.

YES, SIR.

IN THE BACK.

GOOD EVENING.

MY NAME'S CODY WARREN, OWNER OF WARREN LEE CONSTRUCTION, AS WELL AS WARREN HOME IMPROVEMENTS BASED OUT OF HERE IN WARREN COUNTY.

NOT BECAUSE OF WARREN COUNTY CUZ MY LAST NAME'S WARREN .

UM, SO GROWING UP, UM, MY DAD IS ACTUALLY THE PASTOR AT LIBERTY BAPTIST CHURCH IN STROLL.

UH, GROWING UP I SPENT COUNTLESS WEEKENDS AT RIVERMONT, NO, I'M SORRY, NOT RIVERMONT.

CHURCH OF WATER LAKE, WHICH IS A PROPERTY WE'RE SPEAKING OF.

THEY HAD COUNTLESS GOSPEL CONCERTS.

THEY WOULD HAVE HUNDREDS OF PEOPLE COME OUT TO FILL THE BUILDING.

THEY'RE TRYING TO TURN INTO THIS INDOOR SPORTS COMPLEX.

MAJORITY OF MY CHILDHOOD MEMORIES, UM, ARE IN THE CHURCH BECAUSE OF MY FATHER, BUT ALSO AT THIS FACILITY WHERE THERE WOULD BE A LOT OF CARS, A LOT OF PEOPLE GETTING TOGETHER AND ENJOY SOME MUSIC PLAYING OUTSIDE.

THERE WAS A LOT OF HISTORY AT THIS BUILDING, UM, DEVELOPMENT OF THE COMMUNITY, BRINGING THE COMMUNITY TOGETHER.

IT'S NOT ALWAYS BEEN FARMLAND.

IT HAS BEEN A RECREATIONAL FACILITY FOR THE CHURCH AND I THINK THIS IS A GREAT, GREAT WAY TO KEEP THAT SPIRIT ALIVE.

ALSO, GROWING A UP IN THE AREA, I KNOW HOW LITTLE TO DO THERE IS OR HOW LITTLE THERE IS TO DO IN THE AREA.

AND A LOT OF THE KIDS I WENT TO HIGH SCHOOL WITH, A LOT OF PEOPLE MY AGE HAD NOTHING TO DO.

ENDED UP GOING DOWN THE WRONG PATH AND GETTING IN TROUBLE, GOING TO JAIL, GETTING INTO DRUGS.

I THINK JUST THE POSSIBILITY OF POTENTIALLY HELPING ONE KID JUST WITH HAVING SOMEWHERE TO PRACTICE SOFTBALL IS WORTH A SHOT.

UM, ME AND MY WIFE BOTH ARE BIG SUPPORTERS OF ALL THE LOCAL SPORTS TEAMS. MY COMPANY HAS SPONSORED MANY SPORTS TEAMS. WE ARE ALL FOR YOUTH DEVELOPMENT IN THE AREA.

UM, I DON'T UNDERSTAND WHY YOU'D BE AGAINST THIS.

THE TRAFFIC, THE CHURCH ALONE WOULD BRING IN A LOT OF TRAFFIC ON EVENINGS AND WEEKENDS, SPECIFICALLY WEDNESDAY EVENINGS AND SUNDAY.

UM, THE CONCERTS THEY HAD BROUGHT IN HUNDREDS OF PEOPLE.

JUST THE CHANCE OF OUR KIDS HAVING SOMETHING TO DO OTHER THAN GET IN TROUBLE SEEMS LIKE IT'S WORTH IT TO ME.

THANK YOU.

THANK YOU, SIR.

YES, SIR.

GOOD EVENING.

I'M I'M TED MCDANIEL.

I'M THE BOSS TO SOFTBALL COACH AT WARREN COUNTY HIGH SCHOOL.

AND, UH, I DON'T WANT TO REHASH WHAT EVERYBODY ELSE HAS SAID, BUT SOMETHING THE, UH, LITTLE LEAGUE PRESIDENT SAID.

IT'S ALSO SOMETHING, UH, COLE SAID REALLY TRIGGERED SOME OF MY THOUGHTS.

UH, I HAVE A PICTURE THAT DURING THE WINTER THERE'S NOWHERE REALLY FOR HER TO WORK

[01:00:01]

OUT.

WE TRY TO USE THE GYM WHEN BASKETBALL TEAMS AREN'T IN THERE, BUT THAT'S KIND OF HIT AND MISS.

SHE GETS PITCHING INSTRUCTIONS AND SHE GOES TO MANASSAS AND PAYS $100 PER HOUR TO PITCH FOR ONE HOUR WITH A PITCHING INSTRUCTOR.

UM, A LOT OF OTHERS HAVE TOLD ME THEY WOULD LIKE TO DO THAT ALSO, EXCEPT THEY DO NOT HAVE $100 PER HOUR PLUS THE $3 PER GALLON GASOLINE GOING UP AND BACK.

UH, I THINK A FACILITY LIKE WHAT HAS BEEN DESCRIBED IN WHAT IS PROPOSED WOULD BE CERTAINLY BE AN ASSET TO OUR, UM, OUR AREA.

UM, I THINK A LOT.

AND THERE WAS A, A ONE TIME, A BATTING CAGE IN WINCHESTER.

THE THE MAN THAT RUN IT RETIRED AND MOVED OUTTA THE AREA, SO IT'S NO LONGER THERE.

BUT, UH, I KNOW FROM EXPERIENCE THERE TOO THAT SOMETIMES LIKE THREE OR FOUR PLAYERS WOULD RENT A CAGE IN INDOORS AND THEY WOULD GO THERE AND THEY'D HAVE AN AISLE.

THEY POOL OF MONEY, SPLIT THE COST FULL WAYS AND HIT AND THOSE, THOSE, THOSE KIND OF THINGS MAY SEEM SMALL, BUT THEY WILL HELP THE AREA AND HELP OUR PLAYERS VERY MUCH.

IT WOULD BENEFIT NOT ONLY US, BUT AS YOU SAW SKYLINE ALSO AND ALSO SKYLINE MIDDLE AND WARREN COUNTY MIDDLE.

UM, I'M, I'M 100% IN FAVOR OF THIS AND SUPPORT IT.

THANK YOU.

THANK YOU SIR.

YES MA'AM.

THAT'S MY CHECK BOX.

I'M AMANDA SLATE.

37 62 BROWNTOWN ROAD.

UM, I'M IN FAVOR OF IT.

YOU KNOW, I HAVE A LONG HISTORY.

I WAS THE SOCCER COACH FOR SKY HIGH SCHOOL.

I WAS ON THE BOARD FOR THE FRONT ROYAL SOCCER ASSOCIATION AND I COACHED OUR FIRST GIRLS' TRAVEL TEAM TO EVER GO D ONE AND GO TO WAGS IN OUR AREA.

AND THE STRUGGLE OF DRIVING AROUND A WHOLE SOCCER TEAM TO FIND PRACTICE I'VE LIVED.

BUT ON THE FLIP SIDE OF THAT, LIKE SOME OF THEM HAVE SAID THAT IS ONE OF THE LARGEST RECREATION AREAS THAT WE HAVE IN OUR COUNTY FROM, YOU KNOW, THE, UM, THE BUZZ ROCK TO THE GEORGE WASHINGTON NATIONAL FOREST.

THOSE ARE PLACES THAT PEOPLE GO FOR RECREATION.

AND IT WOULD BE THE SAME THING IN OUR AREA ON BROWNTOWN ROAD.

THERE ARE A LOT OF CARS THAT GO TO TRAILHEADS AND WE HAVE A COMMUNITY CENTER THERE IN BROWNTOWN.

WOULD WE SAY THAT THEY COULD ONLY HAVE 20 CARS THERE, YOU KNOW, SO IT'S, THERE'S STUFF EVERYWHERE.

I MEAN EVEN THE SHENDO GOLF COURSE THAT IS A NARROW ROAD AND THEY HAVE A LOT OF PEOPLE THAT COME IN AND OUT OF THAT AREA ALL THE TIME.

SO I THINK YOU HAVE TO LOOK AT IT FROM A COUNTY AS A WHOLE THAT WHERE ARE THOSE OTHER PIECES OF REAL ESTATE THAT OFFER THAT RECREATION, BECAUSE THAT'S WHAT WE'RE KNOWN FOR.

YOU KNOW, WE HAVE A LOT OF AREAS THAT ARE LIKE THAT.

SO THANK YOU.

THANK YOU.

SOMEWHAT OVER HERE.

YES MA'AM.

HI, MY NAME IS ANDREA BUNCH AND I LIVE AT TWO 10 FOX CHASE DRIVE HERE IN FRONT RAIL AND I'M GOING OUT ON A WHIM, BUT I'M SPEAKING ON A MOM'S BEHALF.

UM, I HAVE A HUSBAND THAT HAS COACHED, UH, SOFTBALL BASEBALL.

UM, I HAVE A DAUGHTER WHO IS CURRENTLY PLAYING TRAVEL BASKETBALL AND HAD JUST FINISHED UP PLAYING TRAVEL SOFTBALL.

AND I FEEL THAT SHE LET TRAVEL SOFTBALL GO DUE TO THE DISCOURAGEMENT OF NOT HAVING THE ADEQUATE PLACES TO PRACTICE.

UM, SHE STARTED OUT PLAYING TEE-BALL WITH LITTLE LEAGUE AND I CAN'T TELL YOU HOW MANY TIMES WE COULD NOT PRACTICE OVER AND OVER AGAIN.

THESE CHILDREN WANT TO PLAY AT A COMPETITIVE LEVEL AND WHEN THEY DO NOT HAVE A PLACE TO PLAY AT TO PRACTICE AT COMPETITIVE LEVEL, THEY CANNOT BE COMPETITIVE.

MY DAUGHTER DESIRES TO PLAY EITHER COLLEGE SOFTBALL OR COLLEGE BASKETBALL.

SHE GAVE UP ON TR ON SOFTBALL AT THIS TIME ON THE TRAVEL LEVEL BECAUSE AS A FULL-TIME WORKING PARENT FOR VALLEY HEALTH SYSTEM AND A HUSBAND WHO IS A SIX DAY A WEEK WORKING BUSINESS OWNER HERE IN FRONT ROYAL, HIS FAMILY HAS OWNED A FAMILY BUSINESS FOR YEARS.

THEY WORK SIX DAYS A WEEK TO PROVIDE FOR OUR COMMUNITY.

SHE HAS DECIDED THAT SHE IS GOING TO GIVE UP THE TRAVEL SOFTBALL AT THIS TIME.

MY HUSBAND WAS ONE OF THOSE COACHES FOR TRAVEL SOFTBALL.

THESE PARENTS PAY MONEY FOR THEIR CHILDREN TO PLAY EACH YEAR.

THEY PAY.

WE PAY TO FIND PLACES FOR THESE CHILDREN TO PRACTICE.

WE HAVE TO FUNDRAISE FOR THESE CHILDREN TO BE ABLE TO FIND A PLACE TO PRACTICE.

THIS HAS BEEN MY

[01:05:01]

ULTIMATE DESIRE TO DO SOMETHING LIKE THIS.

AND I COULDN'T BE HAPPIER WHEN I HEARD THAT DANIELLE AND COLE WERE GOING TO ASPIRE TO MAKE SOMETHING LIKE THIS FOR OUR CHILDREN.

I ALSO, MY DAD AND STEPMOM GOT MARRIED AT THE CHURCH AT WATER LAKE.

UM, SO I HAVE BEEN TO A MANY THINGS THERE.

THEY HAD HIM SINGS, THEY HAD GOSPEL SINGS.

THEY BROUGHT IN RVS.

MY DAD IS AN ELECTRICIAN.

HE DID A LOT OF WORK AT THAT CHURCH, A WHOLE LOT.

HE PUT IN ALL THE PLUGS FOR ALL THE RVS OUT, ALL THE RV PLUGS OUTSIDE.

THERE HAS BEEN MORE THAN 20 CARS AT THAT CHURCH AT A TIME.

WE'RE TALKING HUNDREDS OF CARS AT THAT CHURCH AT A TIME.

I HAVE BEEN THERE, I'VE SEEN IT.

I DRIVE BY THERE ALL THE TIME.

I LIVE BACK THAT WAY.

I JUST WANT NOTHING MORE THAN FOR OUR CHILDREN IN THIS COMMUNITY TO HAVE A PLACE TO BE ABLE TO PRACTICE.

THE SCHOOLS ARE GREAT ABOUT ALLOWING US, BUT THEY HAVE TO BE ABLE TO PROVIDE FOR THE SCHOOLS FIRST, THEN THE TRAVEL.

AND IF THESE CHILDREN WANT TO BE ABLE TO PLAY AT A COLLEGE LEVEL, THEY BASICALLY HAVE TO PLAY TRAVEL SPORTS AND DANIELLE AND COLE ARE WILLING TO ALLOW THAT OPERATION AT THEIR FACILITY TO BE ABLE TO HAVE THOSE PRACTICE PLACES.

AS YOU LISTEN ON THAT VIDEO, FOUR OF THOSE PEOPLE OR THOSE GIRLS ON THAT VIDEO ALL TRAVEL TO WARRINGTON, BUILTIN CALL PEPPER.

THEY DON'T EVEN PRACTICE OR PLAY ON A TEAM IN OUR COMMUNITY BECAUSE WE CANNOT PROVIDE THE COMPETITIVE LEVEL THAT THEY DESIRE.

I JUST ASK THAT YOU HEAR EVERYBODY OUT.

I ASK THAT YOU DO THIS FOR OUR CHILDREN.

OUR CHILDREN NEED THIS.

COLE AND DANIELLE HAVE BEEN NOTHING BUT SUPPORTIVE.

I HELP THE, UM, VARSITY SO, OR VARSITY BASEBALL TEAM.

EVERY TIME I'VE GONE TO THEM, THEY'VE DONE NOTHING BUT GIVE SUPPORT, HELP, WHATEVER THEY CAN OFFER.

SO I ASK THAT YOU DO THE SAME FOR THEM.

THANK YOU.

THANK YOU.

ANYONE ELSE? YES, SIR.

MY NAME IS CHRIS GOBY AND I LIVE AT 96 HONEYSUCKLE LANE, UP ON THAT LIVELY MOUNTAIN OF HIGH UP.

AND UM, I'VE BEEN COACHING , YOU KNOW, WELL, UM, I'VE BEEN COACHING LITTLE LEAGUE SOCCER, UM, FOR THE COUNTY FOR ABOUT 28 SEASONS NOW.

AND NOT ONLY DID I COACH FOR THE COUNTY SOCCER, BUT I COACHED FOR THE FLAMES HOMESCHOOL PROGRAM CUZ WE HOMESCHOOLED TWO OF OUR KIDS IN THE LATER YEARS.

AND IN THE DEVELOPMENT OF ALL THESE SPORTS PROGRAMS, UM, FIELDS HAVE ALWAYS BEEN A, AS EVERYBODY KNOWS A TIGHT SPOT.

UM, BUT THE COUNTY HAS DONE A WONDERFUL JOB WHEN IT'S COME TO SOCCER.

WE'VE HAD THE LIGHTS PUT IN AT THE SOCCER PLEX.

WE'VE HAD FIELDS PUT IN AT THE DOG PARK, I CALL IT EASTERN PARK.

AND WE'VE HAD FIELDS PUT IN AT CHURCHES.

I MEAN, THE COUNTY'S REALLY SUPPORTED THE SOCCER PROGRAM AND I THINK THE SOFTBALL LEAGUE AND TEAMS ARE AT THAT LEVEL NOW WHERE THEY NEED, I'M, WE'RE NOT ASKING WHERE NOBODY'S ASKING FOR THE COUNTY TO COME UP WITH ANY MONEY TO DO THIS.

WE HAVE COLE OFFERING TO PAY FOR THIS AND NOTHING COMING OUT OF THE COUNTY POCKET.

I USED TO STAND UP HERE AND ASK FOR MONEY FOR THE SOCCER ASSOCIATION.

I'M NOT A, NOBODY'S ASKING FOR MONEY.

ALL WE'RE ASKING IS FOR THE OPPORTUNITY TO HAVE AN OPEN SPACE FOR THESE KIDS TO PRACTICE.

IT'S NOT EVEN, NOT EVEN TALKING ABOUT A BASEBALL FIELD OR A, OR ANY, YOU KNOW, TWO GAMES, THREE GAMES GOING ON AT ONE TIME.

WERE JUST ASKING FOR THE KIDS TO BE ABLE TO PLAY AND WARM UP AND KEEP THEIR ENTHUSIASM FOR THE SPORTS GOING.

I HAD, UM, I JUST TOOK, I TOOK OVER THE UNIT 19 PROGRAM A FEW YEARS AGO AND THE THING THAT STICKS IN MY MIND STILL TO THIS DAY IS THERE WAS A LITTLE GIRL THAT WAS IN THE EIGHTH GRADE, SEVENTH GRADE, EIGHTH GRADE, I CAN'T SAY HER NAME CUZ I DON'T WANT TO, I DON'T HAVE PERMISSION, BUT SHE WAS TEED AROUND PLAYING SOCCER OR BASKETBALL AND SHE'D NEVER PLAYED SOCCER BEFORE.

WELL, BY THE TIME SHE GOT FINISHED PLAYING SOCCER WITH THE 19 FOR ONE OR TWO LEAGUES, SHE BECAME THE GOLDEN BOOT PLAYER THIS YEAR AND WAS IN THE, UH, LOCAL PAPER AND SHE JUST BECAME A STAR IN HIGH SCHOOL.

UM, AND EVERYBODY KNOWS HER.

AND THAT'S THE OPPORTUNITY THAT THEY, THAT WAS GIVEN TO THIS INDIVIDUAL THROUGH THE SOCCER ASSOCIATION.

AND I REALLY, REALLY BELIEVE IN MY HEART THAT THE KIDS THAT ARE PLAYING SOFTBALL NEED THE SAME OPPORTUNITY.

AND THIS ISN'T AT THE COUNTY EXPENSE, WHICH I THINK IS A BIG, BIG ISSUE HERE.

THANK YOU.

THANK YOU, SIR.

ANYONE ELSE? I THINK YOUR HAND WAS UP FIRST AND THEN I'LL GET YOU NEXT.

[01:10:01]

HI, MY NAME IS ASHTON LONG.

I LIVE AT 1520 MALLAD PLACE FROM MONROE, VIRGINIA.

UM, I'M GONNA SPEAK A LITTLE ON WHAT ANDREA TALKED ABOUT WHEN SHE STOOD UP HERE AND SPOKE TO Y'ALL.

UM, MY DAUGHTER ACTUALLY PLAYED ON HER HUSBAND'S TEAM THAT HE COACHED FIRE FRONT ROW FIRE, AND SHE LOVED IT, BUT THERE WAS MANY, MANY TIMES THAT WE COULDN'T PRACTICE BECAUSE OF THE RAIN OR BECAUSE THE FIELDS WERE STILL TOO WET AND SHE WANTED TO PLAY SO BADLY.

SHE HAS THAT COMPETITIVENESS THAT, THAT DRIVE THAT A LOT OF KIDS DON'T HAVE.

BUT WE'D GO TO THESE TOURNAMENTS AND WE'D HAD NEW PRACTICE AND THEY WOULD LOSE AND IT WOULD JUST DEVASTATE THEM BECAUSE I KNOW THAT IF THEY HAD THE TIME TO PRACTICE, LIKE THESE OTHER TEAMS ALL AROUND NORTHERN VIRGINIA WERE DOING, WE WOULD BE WINNING TOO.

SO SHE DECIDED TO LEAVE THAT TEAM AND WE ENDED UP MOVING TO A TEAM IN WINCHESTER CALLED SWARM.

THEY HAD AN INDOOR FACILITY.

IF IT RAINED, WE COULD PRACTICE THROUGH THE WINTER.

WE COULD PRACTICE THEIR WINNING CHAMPIONSHIPS.

THEY GAVE MY DAUGHTER THE OPPORTUNITY TO BE A GREAT HITTER WHERE SHE WAS JUST ON ESPN DURING THE HOME RUN DERBY FOR DURING THE LITTLE LEAGUE WORLD SERIES.

SPORTS ARE SO GOOD FOR OUR KIDS, IT GETS THEM OFF THE TVS AND OFF THEIR PHONES.

IT TEACHES THEM LIFE LESSONS, HOW TO LOSE, HOW TO WIN, HOW TO BE A GOOD FRIEND, A GOOD TEAMMATE.

MY DAUGHTER IS A WONDERFUL DAUGHTER AND I KNOW IT'S ALL BECAUSE SHE'S HAD THE OPPORTUNITY TO PLAY SOFTBALL.

SO MANY KIDS IN THIS TOWN CAN'T BECAUSE THEIR PARENTS DON'T GET OFF EARLY ENOUGH LIKE ME AND MY HUSBAND DO, WHERE WE CAN TRAVEL TO WINCHESTER AND CLEARBROOK AND IN WOOD WEST VIRGINIA FOR HER TO HAVE THOSE TIMES TO PRACTICE.

SO MANY PEOPLE WORK NINE TO FIVE AND THEY CAN'T GET THERE.

SO IF THEY HAD THE FACILITY HERE CLOSE TO HOME, MORE KIDS WOULD HAVE THE OPPORTUNITY TO DO WHAT MY DAUGHTER'S BEEN ABLE TO DO.

SO I REALLY HOPE YOU GUYS RECONSIDER AND APPROVE THIS.

THANK YOU.

THANK YOU.

AND CONGRATULATIONS TO YOUR DAUGHTER.

YES, MA'AM.

BEHIND THE, HELLO, MY NAME IS LAURA JOHNSTON AND I LIVE IN FORT VALLEY, VIRGINIA.

UM, I TRAVEL THAT ROAD UNFORTUNATELY EVERY DAY, TWICE A DAY.

AND, UM, I, I REALLY DON'T, I CAN'T SEE HOW IT WOULD BE AN ISSUE FOR MORE TRAFFIC AS PEOPLE WILL JUST BE COMING OFF OF STRAUSBERG ROAD RIGHT TO IT.

YOU WILL NOT BE ON FORT VALLEY ROAD LONG AT ALL.

UM, ALSO IF YOU ARE TRAVELING FROM FORT VALLEY WAY, THERE IS ANOTHER ROAD YOU CAN TAKE TO AVOID IT COMPLETELY AND IT TAKES YOU TO ST.

STRAUSBERG ROAD ANOTHER WAY.

SO, UM, I REALLY DON'T SEE THAT AS AN ISSUED, AS AN ISSUE.

UM, MY FATHER LIVED RIGHT BY THAT CHURCH MY WHOLE LIFE AND WE, UM, WE WOULD JUST WALK TO THAT CHURCH AND LIKE A COUPLE OTHER PEOPLE HAD SAID THERE WERE WERE MASSIVE EVENTS THERE, UM, FROM THE CONCERTS AND, UM, THERE THEY HAD HUGE AUCTIONS.

I REMEMBER LIKE, JUST HUGE AUCTIONS.

SO PEOPLE FROM ALL OVER WOULD TRAVEL TO THAT.

AND, UM, TRAFFIC I GUESS WASN'T AN ISSUE THEN.

UM, LIKE AT MY HOME IN, FOR MY NEIGHBORS, LIKE PEOPLE RIDE ATVS OR SHOOTING GUNS, THEY'RE REVVING THEIR RACE CARS AND I MEAN, I WOULD NEVER COMPLAIN ABOUT IT LIKE YOU LIVE IN THE COUNTRY AND WHAT YOUR NEIGHBORS DO.

IT'S, IT'S JUST, YOU KNOW, KIND OF WHAT THEY DO.

AND I JUST DON'T FEEL LIKE I HAVE A SAY SO ON THAT.

UM, LET'S SEE.

I FEEL LIKE FORT VALLEY IS A, IT'S A MAIN ROAD AND IT'S NOT VERY PRIVATE, SO A BUSINESS SHOULD JUST BE ABLE TO, YOU KNOW, BE A BUSINESS, ESPECIALLY FOR OUR YOUTH.

I, I WON'T GET INTO THAT CUZ EVERYBODY HAS, BUT I DO HELP MY SISTER TAKE MY NIECE TO WINCHESTER TWICE A WEEK FOR PITCHING LESSONS FOR AN INDOOR FACILITY.

AND IT'S RIDICULOUS.

SO THIS REALLY WOULD BE AMAZING AND HELPFUL AS EVERYBODY SEEMS TO AGREE ON.

BUT I THINK THE BIGGEST THING IS I TRIED TO PUT MYSELF AS IF I LIVED, YOU KNOW, RIGHT NEAR THAT PROPERTY.

AND ESPECIALLY WITH THE HOURS THAT THEY'RE OFFERING, I, I JUST DON'T SEE HOW IT COULD REALLY BE SUCH AN ISSUE AND NOISE.

IT'S A BIG INDOOR FACILITY, SO NOISE SHOULDN'T BE AN ISSUE, ESPECIALLY FOR THEIR PHASE ONE.

UM, LET'S JUST DEAL WITH

[01:15:01]

THAT FOR NOW.

USE THE INDOOR, LET THE KIDS HAVE A PLACE TO GO CUZ IT'S ALREADY COLD OUT.

THERE'S, IT'S OVER FOR KIDS WHEN IT'S COLD.

AND I THINK IT'S A GREAT IDEA AND I REALLY HOPE THAT YOU THINK ABOUT IT.

THANK YOU.

THANK YOU.

ANYONE ELSE? YES MA'AM.

CAN WE WAIT TO FINISH OR CAN COME UP NOW IF YOU, IF NO ONE ELSE WANTS TO SPEAK, I WAS GONNA ASK TWO MORE TIMES AND THEN CLOSE IT.

SO, UM, ANYONE ELSE WANNA SPEAK AT THIS TIME? THIRD AND FINAL CALL.

ANYONE ELSE WANNA SPEAK? IF YOU WANNA SPEAK, YOU'RE WELCOME TO COME UP NOW.

MY NAME IS DANIEL HUS.

I LIVE AT 2020 CEDAR SPRING DRIVE IN STRASBURG.

WE APPRECIATE ALL OF THE SUPPORT TODAY FOR EVERYONE THAT HAS COME OUT AND SPOKEN ON OUR BEHALF.

BUT WE WANTED TO SHARE, OR I WANTED TO SHARE WITH YOU SOME OF MY OWN PERSONAL THOUGHTS.

WHEN MY HUSBAND AND I FIRST LOOKED AT THIS PROPERTY, IT WAS A VISION COME TRUE FOR A DREAM I'VE HAD SINCE I WAS YOUNG.

WE CURRENTLY HAVE AN ESTABLISHED BUSINESS IN THE COMMUNITY ON QS SPORTS BAR AND GRILL.

WITH THAT EXPERIENCE, WE WERE ABLE TO GET APPROVED TO PURCHASE OUR DREAM.

I WAS NAIVE TO THINK THAT OUR VISION WOULD BE A PROBLEM TO THE NEIGHBORING COMMUNITY.

SINCE THE CHURCH OVER MANY DECADES PROVIDED A LOT OF SPACE FOR THE SAME CONCEPT AS OURS.

THE BUILDING WE WOULD LIKE TO UTILIZE FOR INDOOR TRAINING, PAST PASTORS USED FOR INDOOR BASKETBALL TOURNAMENTS AND EVEN OUTDOOR FLAG FOOTBALL FOR THE YOUTH.

THE FATE OF A DENIAL FOR US TO USE OUR OWN LAND, NO, I GOT IT.

COULD CHANGE EVERYTHING.

WE HAVE WORKED SO HARD TO PROVIDE FOR OUR FAMILY, WE EVEN WANT TO PUT OUR OWN HOUSE ON THAT LAND.

OKAY? AND THROUGH THAT.

NOW, AS YOU HAVE HEARD FROM THE LOCAL COMMUNITY, WE ARE AVID SUPPORTERS FOR YOUTH SPORTS ON THE HIGH SCHOOL LEVEL AND AT PARKS AND RECREATION.

JOEL TREL, WHOM IS THE PAST PRESIDENT OF THE LITTLE LEAGUE AND CURRENT PRESIDENT OF THE FRONT ROYAL FIRE, SENT ME A MESSAGE YESTERDAY THAT SPOKE VOLUME TO ME.

HE QUOTED THE COUNTY HAS A SLOGAN, NO CHILD LEFT BEHIND THIS COMPLEX WILL ALLOW CHILDREN WITH THE OPPORTUNITY TO DEVELOP THE SKILLS TO BUILD HOPEFULLY A COLLEGIATE EDUCATION FROM A TRAINING COMPLEX LIKE THIS.

WE WILL NEVER TAKE NO FOR AN ANSWER WHEN IT COMES TO OUR YOUTH.

THE PLANNING AND ZONING BOARD QUOTED THIS IS A GREAT IDEA AND SOMETHING THAT IS NEEDED IN THIS COMMUNITY.

JUST A BAD LOCATION, BUT I BEG TO DIFFER.

THERE IS NO PERFECT LOCATION.

THERE IS NO CURE FOR TRAFFIC, PERFECT NOISE OR LITTER.

WE CUR WE CAN SURELY OWN OUR OWN LAND.

WE CAN SURELY ON OUR OWN LAND ACCOMMODATE AND TAKE CARE OF LITTER CONTROL SET PARAMETERS FOR TRAFFIC FLOW IN AND OUT OF OUR FACILITY.

THE ACTUAL FACILITY ITSELF IS INSULATED AND FAR ENOUGH AWAY FROM NEIGHBORS.

THAT NOISE WILL NEVER BE AN ISSUE INDOORS.

WE CAN ONLY HOPE THE COMMUNITY WILL SEE THE GOOD THAT WILL COME OF THIS AND SEE PAST THE NEGATIVE NARRATIVES THAT HAVE BEEN STIRRED UP.

COLE, MYSELF AND LIKE-MINDED BUSINESS OWNERS IN THIS COMMUNITY ARE THE FUTURE OF THIS COUNTY.

WE HOPE THAT YOU, THE BOARD CAN SEE THE GOOD IN OUR PROJECT REGARDLESS OF ITS LOCATION.

THANK YOU FOR YOUR TIME.

THANK YOU.

AND I WILL CLOSE THE PUBLIC HEARING.

ARE THERE QUESTIONS OR DISCUSSION FROM THE BOARD AT THIS POINT? I KNOW MRS. COOK, YOU SAID YOU WERE GONNA HAVE QUESTIONS.

YEAH, I DO.

I DO HAVE SOME QUESTIONS HERE.

AS I HAVE SAID BEFORE, YOU KNOW, I LOVE YOUR STORY AND I SUPPORT YOUTH SPORTS AND YEAH, WE'RE LACKING.

THE COUNTY HAS LACKED IN PROVIDING THE FIELDS THAT WE NEED FOR OUR YOUTH.

BUT, YOU KNOW, I'M THE FOR DISTRICT SUPERVISOR, YOU KNOW, AND I DID DO, UM, SOME, SOME HOMEWORK AND I JUST HAD SOME QUESTIONS, UM, OF THE DOCUMENTS THAT I READ, YOU KNOW, TO UNDERSTAND BECAUSE, UM, AS THE RESIDENTES HAD SAID, I SEE GAPS IN A PLAN.

SO THE FIRST THING I WANTED TO ADDRESS WAS THE VEHICLE COUNT.

OKAY? EVERYONE SAYS 2020 VEHICLES, YOU KNOW, THAT'S IT.

WELL, I DID SOME MATH AND

[01:20:01]

WE'RE IN, WHAT I DID WHEN I READ YOUR C U P I TOOK NINE 30, UH, FOR, UH, MONDAY THROUGH FRIDAY THREE 30 TO SIX OR NINE 30, RIGHT? I BETTER GET MY EXCEL SPREADSHEET OUT HERE, , MAKE SURE I GIVE THE RIGHT NUMBERS.

THREE 30 TO NINE 30 IN U C U P, IT SAID THAT, UM, THE, THE, UM, THE APPOINTMENTS WOULD BE AN HOUR AND A HALF TO TWO HOURS PER APPOINTMENT.

SO, UH, I I USED ONE AND A HALF.

OKAY.

ALSO IN THE C U IT SAID THAT IT WAS GONNA BE UP TO 13 TO 18 PARTICIPANTS PER LESSON OR SLOT ON WHAT THIS CALL IT A SLOT, FOR LACK OF BETTER WORD.

SO I DID THAT AND IT CAME OUT TO BE ABOUT 65 STUDENTS A DAY.

OKAY? I MEAN, YOU KNOW, FOR ONE, ONE DAY, WHICH I LOOKED AT THAT AS AS VEHICLES.

SO THAT WAS LIKE, THAT'S LIKE 74 VEHICLES EITHER COMING OR GOING PER DAY MONDAY THROUGH FRIDAY.

SO IF YOU MULTIPLY THAT BY FIVE BRIGHT, IT COMES OUT TO BE CLOSE TO, YOU KNOW, 300 VEHICLES COMING AND GOING.

THAT DOESN'T COUNT SATURDAYS OKAY? CUZ SATURDAYS IT CAME TO ABOUT, UH, CARS LIKE A 110.

I'LL SHOW YOU THE NUMBERS, YOU KNOW, BUT I, I JUST KIND OF, I HAD TO, EVERYONE TALKS ABOUT THE TRAFFIC, RIGHT? 2020 VEHICLES, YOU KNOW, SO I'M, I'M KIND OF LOOKING AT AS A WHOLE.

SO, SO YOU'RE GONNA HAVE VEHICLES GOING BACK AND FORTH.

ALTAS A C P SAYS THAT TWO, TWO OF THE VEHICLES WILL BE FOR THE PEOPLE WHO WORK THERE.

OKAY? SO WHERE I'M GOING WITH MY QUESTION IS, SO YOU HAVE, WE HAVE 20, NO MORE THAN 20 VEHICLES COMING TO THE FACILITY AT ONE TIME.

WELL, MULTIPLE TIMES, RIGHT? BUT THEN YOU HAVE THE NEXT APPOINTMENT COMING UP, SO PEOPLE ARE GONNA BE THERE ABOUT 15 MINUTES.

SO YOU'RE STILL GONNA HAVE FOLKS INSIDE OR CHILDREN INSIDE, YOU KNOW, PRACTICING WITH 20 VEHICLES STILL ON THE LOT.

SO YOU HAVE THE NEXT, NEXT LOT OF PEOPLE COMING IN.

SO WHERE IS THE OVERFLOW GONNA GO? ARE YOU GONNA HAVE AN ATTENDANT OUT THERE TO SAY, OH, 20, THERE'S 20 VEHICLES HERE IN THIS PARKING LOT.

SO YOU'RE GONNA HAVE TO CIRCLE AROUND OR ARE YOU ANTICIPATING USING THE, THE, THE FIRST, THE, THE LOT NEXT TO YOU THAT BELONGS TO THE CHURCH FOR THE OVERFLOW? AND IF YOU ANTICIPATE USING THAT, DOES THAT COUNT AS THE 20 VEHICLES ON THE, ON THE PROPERTY? SO, SO IF YOU COULD, UM, YOU KNOW, YOUR, YOU KNOW, WHAT, WHAT IS YOUR PLAN FOR, FOR THAT? YEAH, I THINK THAT'S A GREAT QUESTION.

UM, FIRST OFF, TO ADDRESS ONE, ONE POINT YOU MADE, THE OVERFLOW PARKING IS OWNED BY THE CEMETERY.

THAT'S RIGHT.

IT'S NOT USED BY US.

UM, WE HAVE NO, NO CONTRACTOR OR AGREEMENT WITH THE CEMETERY TO USE THAT.

AND WE WILL PUT IN OUR, UM, RENTAL AGREEMENT THAT THAT'S NOT TO BE USED FOR OUR USE OR FOR THE USE OF OUR FACILITY.

UM, TO ANSWER YOUR QUESTION, WHAT WE'RE PLANNING ON HAVING DURING THAT TIME SLOT, THAT SIX HOURS IS THREE DIFFERENT GROUPS COMING IN.

SO AT AN HOUR AND A HALF, AS YOU'VE MENTIONED IN YOUR CALCULATIONS, THAT WOULD GIVE 30 MINUTES BEFORE THE NEXT GROUP WOULD BE THERE.

SO HOPEFULLY THAT GIVES TIME FOR, UM, PARENTS, COACHES, PLAYERS TO LEAVE, UM, PRIOR TO THE NEXT GROUP COMING IN.

SO I THINK AT THE 20 CAR, UM, YOU KNOW, SPOT THAT WE'RE ALL TALKING ABOUT, I THINK THAT'S HIGH .

UM, HONESTLY, YOU KNOW, IF YOU, I, I WISH SOMEBODY WOULD'VE TALKED TO IT TONIGHT, BUT WHEN YOU HAVE TEAMS, UM, 12 TO 13 KIDS USUALLY IS A TYPICAL TEAM SIZE FOR BASEBALL, SOFTBALL, AND ON IN THE OFF SEASON.

I MEAN, IT'S VERY TOUGH TO GET A FULL TEAM THERE.

SO I THINK 20 IS ON THE HIGH SIDE, BUT UM, AGAIN, IF WE'RE DOING TIME SLOTS FROM THREE 30 TO FIVE AND THEN FROM FIVE 30 TO SEVEN, IS THAT RIGHT? AND THEN SEVEN 30 TO TO NINE, UM, YOU KNOW, THAT GIVES A HALF HOUR OF TIME FOR PEOPLE TO LEAVE AND PEOPLE TO COME .

SO, OKAY, SO FOR, LET'S JUST USE THE HOUR AND A HALF MM-HMM.

.

SO WHAT YOU'RE SAYING FOR THE HOUR AND A HALF, IT'S ONLY FOR AN HOUR, AND THAT HALF HOUR IS FOR GET PEOPLE OUT BEFORE THE NEW PEOPLE.

I MEAN, THINK OF IT AS A, THINK OF AS A, I'M SORRY, I INTERRUPT.

THINK OF IT AS A TWO HOUR TIME BLOCK, BUT THE PRACTICE TIME WOULD ONLY BE AN HOUR AND A HALF.

OKAY.

SO IF THEY, IF THEY PRACTICE AT STARTING AT THREE 30, THAT TIMEFRAME WOULD BE DONE AT FIVE O'CLOCK.

THE NEXT PRACTICE WOULDN'T START UNTIL FIVE 30.

SO THAT WOULD GIVE A HALF HOUR FOR PEOPLE TO LEAVE AND THE NEW GROUP TO COME IN.

OKAY.

UM, SO WITH

[01:25:01]

THE OUTDOOR BAT CAGES MM-HMM.

.

OKAY.

SO WHEN I READ YOUR C U P, THAT'S ALSO PART OF THE COUNT, IS THAT RIGHT? UH, THE FACILITY WOULD BE THE, YOU KNOW, THE INSTRUCTIONAL, SO THE FACILITY, IF YOU'RE GOING BACK TO YOUR PARKING QUESTION THERE, THE FACILITY WOULD BE RENTED FOR FULL USE AT ONE TIME.

SO IF YOU WERE USING OUTDOOR, THE OUTDOOR CAGE, YOU WOULD ALSO HAVE THE INDOOR FACILITY AVAILABLE AS WELL.

WE WOULD NOT BE SPLITTING IT TO WHERE THERE'D BE TWO GROUPS THERE AND OVERFLOWING, UM, THAT PARKING MM-HMM.

.

UM, AND THEN JUST ANOTHER POINT IS, YOU KNOW, WHEN WE FIRST DEVELOPED, WE, WE PUT IN A FULL RANGE OF, YOU KNOW, WHAT WE WERE HOPING FOR THIS COULD BE, WE PUT IN OUR JUSTIFICATION, OBVIOUSLY AS WE'VE DISCUSSED WITH YOU AND OTHER COMMUNITY MEMBERS, UM, YOU KNOW, WE DIDN'T WANNA KEEP AMENDING AND AMENDING AND AMENDING, BUT WE'RE WILLING TO TAKE CONDITIONS ON THIS.

AND, YOU KNOW, THAT'S WHAT WE'RE, YOU KNOW, LOOKING AT YOU GUYS FOR.

BUT ONE THING WE DID WANNA NOTE IS OUR PLANS RIGHT NOW ARE JUST ONE OUTDOOR BATING CAGE.

I KNOW IT SAYS TWO.

UM, WE'RE WILLING TO STRIKE THAT, MAKE IT ONE TONIGHT IF THAT'S, UM, WHAT WE WOULD LIKE.

BUT RIGHT NOW WE PLAN TO JUST HAVE ONE CAGE OUTSIDE.

AGAIN, THE FOCUS WOULD BE ON THE INDOOR, UM, THE INDOOR INSTRUCTION.

UNFORTUNATELY, THE COUNTY JUST HAS AN OUTDOOR RECREATION PERMIT RATHER THAN AN INDOOR RECREATION PERMIT.

SO THAT'S WHERE WE FALL BY MEETING WITH THE COUNTY STANDARDS BY HAVING THE OUTDOOR CAGE.

OKAY.

UH, ANOTHER QUESTION I HAVE WITH IT PERTAINING TO THE, THE, THE, UM, THE ROAD.

NOW VDOT CAME IN AND SAID THAT THERE WAS FOUR ENTRANCES ENTRANCE ONE, TWO, WHICH I'M, IF I, CORRECT ME IF I'M WRONG, THE ONE AND TWO WAS THE CHURCH PROPERTY ENTRANCE ONE AND TWO.

THAT'S CORRECT.

IT WAS THE CHURCH, WHICH THEY SAID THAT WAS OKAY TO USE.

RIGHT.

AND THEN ENTRANCE THREE AND FOUR WERE ON, UH, THE, THE REC PROPERTY, WHICH THERE NEEDED SOME WORK NEEDED BE DONE, TURN LANES AND THINGS TO THAT IN NATURE.

IS THAT CORRECT? WELL, IT, IT'S CORRECT IN THE MEMO THAT WE DID GET FROM VDOT, BUT WHEN I SPOKE WITH THE VDOT REPRESENTATIVE, HE DID NOT REALIZE THAT THAT PARKING LOT TO THE NORTH WAS NOT A PART OF THIS APPLICATION.

AND THAT'S WHY HE REVIEWED THAT AS A PART OF THIS APPLICATION.

SO FOR ALL INTENSIVE PURPOSES, THOSE TWO NORTHERN ENTRANCES WOULD BE PROHIBITED BECAUSE THEY'RE NOT THEIR PROPERTY.

SO THEY ARE LIMITED TO THE, THE, THE ENTRANCES TO THE SOUTH ONE AND TWO, UH, THEY WOULD BE REQUIRED TO MAINTAIN THE SITE DISTANCE, UH, BY REMOVAL OF VENTING LANDSCAPING, APPARENTLY THAT HAS BEEN DONE.

UH, AND THEN ALSO, UM, THEY ARE ELIMINATED TO THE DIRECTIONS IN WHICH YOU CAN ENTER THE PROPERTY.

SO THAT WOULD BE SOMETHING WE WOULD WANNA MAKE SURE THAT THAT WAS IDENTIFIED.

CAN YOU EXPLAIN LIMITED TO THE DIRECTIONS? UM, LET'S SEE HERE.

I'LL GET HIS APPLICATION HERE.

YEAH.

SO, OKAY.

OKAY.

UM, ENTRANCE NUMBER TWO MUST BE SIGN AND PAVEMENT MARKED ARROW WITH MESSAGE AS A ENTRY ENTER ONLY ENTRANCE.

OKAY.

SO THAT WOULD BE ONE OF THOSE TWO SOUTHERN ENTRANCES, RIGHT? YES.

AND SO THEY WANTED TO CLEARLY IDENTIFY THAT ENTRANCE ONE IS A TWO-WAY ENTRANCE, UM MM-HMM.

.

SO WE WOULD MAKE SURE THAT WOULD BE SOMETHING WE WOULD WANNA MAKE SURE THAT WAS CLEARLY IDENTIFIED.

AND THEN AS, AS, UH, UM, WE'VE ADDRESSED THAT THERE WOULD BE NO PARKING OUTSIDE OF THIS, THIS PROPERTY AND, AND WE WOULD MAKE SURE THAT THAT WAS CLEARLY IDENTIFIED ALSO MM-HMM.

ON THE PROPERTY.

SO IT'S BASICALLY JUST TWO ENTRANCES.

RIGHT.

OKAY.

SO JUST CLARIFICATION.

OKAY.

NOW, JUST WANTED TO UNDERSTAND THAT BECAUSE I, I LIVE IN FORT VALLEY AND I ALSO DRIVE FORT, I MEAN THAT SUBDIVISION AND I DO DRIVE FORT VALLEY ALMOST THREE OR FOUR TIMES A DAY, ALL DIFFERENT TIMES OF THE DAY.

SO I'M WELL FAMILIAR WITH THE ROAD, AND I'VE LIVED OUT THERE FOR ALMOST OVER 10 YEARS.

AND SO I, I, UM, I HAVE A CONCERN WITH THE RESIDENTS WHO ARE, WHO ARE DIRECTLY AFFECTED BY, BY THIS, THIS, UM, LOCATION.

UM, ANOTHER THING THAT I READ IN THE C U P, IT SAYS THE SEWAGE DISPOSAL IS LIMITED TO 15 TO 20 PER DAY.

AND, UM, WITH, I'M LOOKING AT THE PRELIMINARY NUMBERS.

I MEAN, IN ONE WEEK, YOU KNOW, ONE DAY YOU MAY HAVE 160 INDOOR APPLICANTS PER DAY.

UM, SO HOW, HOW ARE YOU GOING, I KNOW THAT IN THE C U P YOU HAD, YOU'RE GONNA HAVE, UM, POTTY WHATEVER JOHN THINGS, YOU CALL 'EM .

BUT SO WHAT'S YOUR PLAN IN ACCOMMODATING IN

[01:30:01]

THAT? I MEAN, BECAUSE, YOU KNOW, I I I DO WANNA SAY THAT WE'RE NOT JUST TALKING ABOUT THE, THE YOUTH, WE'RE TALKING ABOUT PARENTS AND GRANDMA AND GRANDPA, YOU KNOW, WHO ARE GONNA HANG OUT AND WATCH 'EM, YOU KNOW, SO THERE'S GONNA BE MORE THAN JUST THAT.

SO, UM, IS, IS THAT AN ISSUE? HAS THAT GONE AWAY OR, UM, I'M, I'M NOT AWARE OF THAT.

MS. K I HAVEN'T HEARD ANYTHING FROM MATT ABOUT, UM, IT, I THINK IT WAS, IT, IT WAS WITH THE, UM, HEALTH DEPART I THINK IT WAS.

MM-HMM.

WELL, BUT LIKE YOU SAID, WE, WE WILL HAVE, UM, SOME OUTDOOR POTTIES AS WELL.

UM, YOU KNOW, SOMETHING WE WOULD HAVE TO LOOK INTO AND CONSIDER TO SEE HOW YOU'RE GONNA MAINTAIN THAT, RIGHT.

BECAUSE THAT'S SOMETHING THAT CAME FROM THE HEALTH DEPARTMENT REQUIREMENT.

SO, UM, LET ME SEE.

SO WE HAD THE, THE PARKING, THE BATTY CAGE, EXCUSE ME, BUT I TOURED THIS PROPERTY MM-HMM.

, AND THERE ARE SIX TOILETS IN THAT FACILITY AND SIX SHOWERS.

SO AT SOME POINT, THE HEALTH DEPARTMENT HAD FOUND THAT IT WAS SIGNIFICANT ENOUGH SEWAGE CAPACITY TO, TO ACCOMMODATE A LARGE GROUP OF PEOPLE.

IS THERE A NUMBER THAT YOU'RE LOOKING FOR, OR WHAT IS, I, I DON'T, I DIDN'T READING THERE WAS, I WAS, I WAS JUST READING WHAT THE DOCUMENTS SAID.

THAT'S ALL, YOU KNOW, IT, WHAT I'M READING HERE.

IT SAYS THE EXISTING DWELLING IS CONNECTED TO AN ALTERNATIVE DISCHARGING SEWAGE TREATMENT SYSTEM THAT IS PERMITTED AND REGULATED BY THE VIRGINIA DEPARTMENT OF ENVIRONMENTAL QUALITY.

DEQ.

SINCE THE PROPOSAL IS FOR A COMMERCIAL ESTABLISHMENT, THE DISCHARGE SYSTEM WILL REMAIN UNDER DEQ AND TO CONTACT DEQ REGIONAL OFFICE FOR FURTHER COMMENT.

I DON'T KNOW THAT I SAW ANY OKAY.

OF THE, I'LL HAVE TO, I'LL, I HAVE TO GO THROUGH IT SO WE CAN PUT THAT, WE'LL TABLE THAT THE, UH, I'LL JUST MENTION ONE NUMBER, ONEQ PACKAGE, UH, LETTER HERE.

YEAH.

OH, OKAY.

WE'LL JUST TABLE THAT ONE.

YEAH.

CAUSE I DON'T HAVE HAVE TO GO THROUGH ALL OF THIS TO FIND WHERE I READ THAT.

CONDITION NUMBER ONE IS KIND OF A CATCHALL UHHUH IF FOR AGENCY REGULATIONS, I MEAN, BASICALLY, YOU KNOW, IN, IN ALL OF THE C WE LIST AN OUTSIDE AGENCIES.

SO IN ORDER FOR THEM TO BE EVEN ISSUED A CERTIFICATE OF ZONING, IF THIS IS APPROVED BY THE BOARD AND, AND THEY MEET ALL THE OTHER AGENCY REQUIREMENTS, UM, WHICH IS IN, WHICH INCLUDES THAT KIND OF CATCHALL REQUIREMENT FOR THE HEALTH DEPARTMENT.

OKAY.

THIS IS KIND OF UNIQUE IN THE SENSE THAT IT IS A COMMERCIAL, A LARGER COMMERCIAL OPERATION.

UH, YOU KNOW, IT'S, IT'S, YOU KNOW, IT WAS WEEKENDS, THE CHURCH AND, AND, AND, UH, AND NOW THIS APPLICATION.

SO, UM, WHEN I DID SPEAK TO MR. DAVIS AT THE HEALTH DEPARTMENT, HE SAID, YEAH, IT'S, THIS IS NOT SOMETHING THAT WE COVER BECAUSE OF THE SIZE OF IT AND THE, THE NATURE OF THE SPECIFIC NATURE OF THIS TYPE OF SEWAGE SYSTEM.

OKAY.

AND HE DID, WE DID HAVE SOME ADDITIONAL COMMENTS, AND I BELIEVE THOSE WERE FROM D E Q, UM, AND THE OFFICE OF DRINKING WATER, THEY HAD, THEY HAD JUST, IT WAS KIND OF LIKE A GENERIC THING THAT THEY JUST SENT OUT, COVERED KIND OF EVERYTHING.

MM-HMM.

.

OKAY.

SO WE WOULD MAKE SURE THAT BEST MANAGEMENT PRACTICE WITH, OKAY, UH, WE WOULD MAKE SURE THAT THEY MEANT ANY REQUIREMENTS FOR EROSION AND SEDIMENT AND STORM WATER, UH, THAT WOULD BE DETERMINED BY MR. BEAM ARE, ARE BUILDING OFFICIAL ACCORDING, YOU KNOW, WHAT THE STATE CODE REQUIRES FOR THAT MM-HMM.

, SO THAT ENFORCEMENT WOULD, WOULD BE A PART OF A CON CONDITION, NUMBER ONE, OKAY'S.

SO WE WOULD MAKE SURE THAT THAT WAS A JOKE.

I WAS, YOU KNOW, THOSE ARE COMPLIED WITH.

SO, UM, I, I DID WANT TO, UM, MAKE A COMMENT THOUGH ABOUT EVERYONE SAYING THAT THE CHURCH AT ONE POINT IN TIME, YOU KNOW, HAD CAMPING AND ALL THESE EVENTS AND ACTIVITIES AND THAT KIND OF THING.

AND AGAIN, I'VE BEEN LIVING UP THERE FOR FULL TIME FOR ABOUT EIGHT YEARS, AND I'VE NEVER SEEN ANYTHING LIKE THAT IN THE PAST EIGHT YEARS.

HOWEVER, I DID A LITTLE BIT MORE HOMEWORK, AND I UNDERSTAND THAT ONE POINT IN TIME THAT WAS HAPPENING, BUT ACTUALLY, UM, FOURTH MONTH FIRE STATION USED TO DIRECT THE TRAFFIC DURING THAT TIME WHEN THEY WERE HAVING ALL THESE EVENTS.

SO THERE WAS, YOU KNOW, YEAH, THERE WAS A LOT OF TRAFFIC OUT THERE, BUT THERE WAS, UM, OUR LOCAL FIRE STATION THAT WAS, UM, UM, UH, DIRECTING TRAFFIC.

UH, I DO HAVE A CONCERN THOUGH, YOU KNOW, WITH THE ACCIDENTS, YOU

[01:35:01]

KNOW, UM, I KNOW TRAFFIC, EVERYONE'S SAYING THAT, YOU KNOW, IT'S OKAY, YOU KNOW, IT'S FINE.

BUT, UM, I, AND AS ONE OF THE LETTERS THAT WERE READ THAT I DID REACH OUT TO THE SHERIFF'S DEPARTMENT TO FIND OUT, YOU KNOW, HOW MUCH TO TRAFFIC ACCIDENTS OUT ON 55 IN 6 78, BECAUSE THAT'S WHERE MOST OF THE, OUR ACCIDENTS COME ABOUT.

AND THEN THE PAST TWO YEARS, THERE WERE 15.

AND, AND I APOLOGIZE, MISS KOHLS, I KNOW YOU ASKED ME TO BREAK IT DOWN A LITTLE BIT MORE, BUT WE HADN'T HAD THE OPPORTUNITY TO GET THAT DATA FOR YOU, BUT, YOU KNOW, WE'LL WORK ON THAT.

SO, UM, I, I HAVE A, A CONCERN WITH THE TRAFFIC, WITH THE INCREASE OF THE VEHICLES COMING IN AND OUT.

UM, AND IT'S NOT, YOU KNOW, IT'S, PEOPLE ARE GONNA COME BOTH WAYS.

THEY'RE GONNA GO UP FORT VALLEY TO GO OUT TO MOUNTAIN TO GO OUT TO THREE 40, OR THEY'RE GONNA BE COMING OUT IN 55 TO GO TO STRAWS, SPURS, OR WHATEVER.

SO, UM, I JUST WANTED TO MAKE THOSE TWO COMMENTS OF WHAT WAS BEING SAID.

UM, SO THAT, THAT'S IT FOR MY, MY, MY QUESTIONS.

AND, UM, IF YOU HAD ANY QUESTIONS FOR ME, I'M MORE THAN HAPPY TO, YOU KNOW, ANSWER 'EM.

BUT OTHER THAN THAT, I THINK THAT'S, IT'S ALL I HAVE FOR RIGHT NOW.

ANYONE ELSE HAVE ANY COMMENTS OR QUESTIONS? WELL, ADAM, CHAIR, I DON'T, NOT TRYING TO THROW ANY RAIN ON ANYTHING, BUT I JUST WANT YOU TO KNOW THAT IF THIS IS APPROVED BY THIS BOARD, IF PEOPLE ARE GONNA COMPLAIN, WE CAN TAKE IT AWAY JUST LIKE WE GIVE IT.

SO YOU HAVE TO BE VERY PARTICULAR.

IF YOU DECIDE WHAT YOU'RE GONNA DO, YOU'RE GONNA HAVE TO COME BACK TO US TO DO IT.

AND IT, I'M NOT, I BELIEVE IN TAKING CARE OF OUR KIDS, AND THIS IS AN, A GOOD WAY OF DOING THAT.

BUT I ALSO BELIEVE THAT AS BUSINESS OWNERS, YOU HAVE TO DEPEND UPON WHAT WE'RE TELLING YOU TO DO TO GIVE YOU A C U P AND LIVE BY THAT, AS HARD AS IT MAY BE UNTIL THE NEXT OPPORTUNITY FOR YOU TO DO SOMETHING ELSE, TO LIVE THROUGH, TO SEE IF YOU CAN DO THAT.

I DON'T WANNA SEE COOKING THERE BECAUSE I, I'VE SEEN THE ICE CREAM PLACE AND I'VE SEEN THE, UM, THE, THE, UM, THE SNACK BAR THAT'S OUTSIDE.

AND UNTIL Y'ALL DO A WHOLE BUNCH MORE TO THE EITHER ONE OF THOSE TWO PLACES, I HOPE YOU NEVER OPEN THOSE THINGS BECAUSE THEY'RE NOT RIGHT.

SO THAT'S MY STATEMENT.

THAT'S ALL.

MR. BUTLER.

YEAH.

UM, MADAM CHAIR, MADAM CHAIR.

I JUST WANTED TO FIND OUT THE, UH, YOU KNOW, WE'VE SEEN A LOT OF, UH, PEOPLE WHO WERE SUPPORTING THIS, AND THEN WE SAW SOME OF THE, THE DIRECT NEIGHBORS WHO WERE NOT SUPPORTING IT.

UH, I WILL TELL YOU THAT, UH, THAT I THINK THAT, UH, ACTIVITIES FOR OUR YOUTH IS VERY IMPORTANT.

BUT I ALSO TAKE A LOOK AT THE, THE NIMBY PRINCIPLE, WHICH IS NOT IN MY BACKYARD, AND I WAS JUST CURIOUS AS TO HOW MANY FOLKS WHO DID GET UP AND SPEAK OF HAVE A, UH, I WOULD SAY HAVE A DOG IN THE FIGHT IN THAT THEY ARE DIRECT NEIGHBORS OR THEIR NEIGHBORS IN THE AREA, BECAUSE I SAW A LOT OF FOLKS GET UP AND SPEAK, BUT HOW MANY OF THOSE ARE GONNA BE DIRECTLY AFFECTED BY THIS? OKAY.

I I SEE ONE OF, I DON'T SEE A WHOLE LOT MORE THOUGH.

YEAH.

AND IF, AND IF I MAY ADD ABOUT THE RESIDENTS WHO ARE DIRECTLY AFFECTED BY THE, BY THIS IS, UM, THEY'RE, THEY'RE SENIORS IN THE RETIRED PEOPLE.

AND, UM, I, YOU KNOW, IF IT WAS IN A NEIGHBORHOOD OF KIDS, YOU KNOW, FAMILIES, YOU KNOW, THAT SORT OF THING.

BUT THAT'S, THAT'S WHO ARE GONNA BE EFFECTIVELY DIRECTED BY THIS.

UM, ALSO, I KNOW IN THE C U P, YOU KNOW, IT SAID THAT, UM, THE ADJOINING PROPERTIES WERE BUFFERED BY, UM, TREES.

WELL, THE GRAVEYARDS BUFFERED BY TREES, BUT THERE IS TWO, TWO HOUSES ON METIC ROAD, AND ONE, A WOMAN SPOKE HERE WE ARE MAYBE ABOUT A HUNDRED FEET AWAY FROM HER, WHICH IS ALL OPEN LAND.

THERE'S NO BUFFER BETWEEN HER HOME AND THE OUTDOOR BATTING CAGE, THE WAY I LOOK AT THE MAP, YOU KNOW, SO I JUST WANTED TO PUT THAT ON, ON RECORD AS WELL, YOU KNOW, AS FAR AS, UM, UH, THE RESIDENTS OUT THERE IN FORK DISTRICT.

CAN I MAKE A COMMENT?

[01:40:01]

CHAIRMAN COLEMAN? YES, MA'AM.

UM, SO MY FAMILY IS, UM, VERY SPORTS ORIENTED.

I HAD THREE SONS.

ALL THREE OF MY SONS PLAYED BASEBALL, FOOTBALL, SOCCER, AND WE HAD A BATING CAGE IN MY BACKYARD.

THE GENTLEMAN WHO SPOKE, WHO SAID THE GUY IN WINCHESTER WENT OUTTA BUSINESS.

MY HUSBAND ATTENDED THAT FIRE SALE.

HE BROUGHT HOME A BAD ENGAGE.

AND, UH, IT'S A GOOD THING WE DON'T HAVE AN HOA BECAUSE WE PUT THAT BAD BOY UP IN MY BACKYARD, , AND, AND WE ALLOWED TEAMS TO COME TO MY BACKYARD AND WE HOST FRONT ROW CARDINALS WHO PRACTICED IN THAT BATTING CAGE IN MY BACKYARD.

UM, , WE HAVE TO MAKE SACRIFICES FOR OUR KIDS.

THIS IS PART OF, DID THE PING DRIVE ME CRAZY? YES.

DID THIS DRIVE ME CRAZY IN THE KITCHEN 24 7? YES.

MY CHILDREN ALL EITHER SWUNG GOLF CLUBS OR SWUNG BASEBALL BATS, .

BUT IT'S PART OF WHAT YOU DO TO ENCOURAGE YOUR CHILDREN TO BE THE BEST PEOPLE THEY CAN BE.

UM, AND SO I'VE BEEN DIRECTLY AFFECTED.

I DROVE TO GAINESVILLE, UH, THREE TIMES A WEEK WITH A KID WHO WAS ASLEEP BECAUSE HE WAS EXHAUSTED FROM DRIVING IN THE CAR BACK AND FORTH TO PAY FOR, UH, SPORTS TRAINING.

I, I WAS FORTUNATE I COULD AFFORD THAT, BUT I DON'T, THERE ARE NOT A LOT OF KIDS WHO HAVE SO MUCH TALENT IN THIS COMMUNITY WHO COULD NOT PAY FOR THAT.

UM, SO THOSE ARE MY THOUGHTS ON WHAT WE NEED TO DO AS A COMMUNITY TO SUPPORT YOUNG PEOPLE.

I, I UNDERSTAND WHAT EVERYONE HAS SAID FOR AND AGAINST.

UM, AND I, I DO UNDERSTAND THE, UM, I AM A SENIOR CITIZEN.

I DON'T FEEL LIKE A SENIOR CITIZEN, BUT I AM ONE, I GET A SENIOR DISCOUNT IF I ASK FOR IT.

SO , UM, I LIE.

YEAH.

UM, THE GOOD THING ABOUT, WELL, THE BAD THING ABOUT BEING A SENIOR IS A LOT OF TIMES YOU'RE HEARING IS NOT QUITE AS GOOD AS WHEN YOU WERE 30 YEARS YOUNGER.

I'VE GOT TWO LIVING IN THE HOUSE WITH ME NOW WHO CAN'T HEAR ANYTHING I SAY, AND THEN WHEN I SAY IT LOUD ENOUGH THAT THEY CAN HEAR, I'VE GOT AN ATTITUDE.

SO, UM, YOU KNOW, HOPEFULLY THAT IS ONE ADVANTAGE OF, OF BEING A SENIOR IS THAT, UM, IF THERE IS SOME BATTING OUTSIDE THAT YOU WON'T NOTICE IT AS MUCH.

BUT AT THE SAME TIME, AGAIN, IT'S CHILDREN.

AND AS FAR AS THE NUMBER OF CARS, UM, I HAVE THREE BROTHERS WHO ALL DID SPORTS AND, UM, ESPECIALLY MY OLDEST BROTHER, UM, MY MOM AND DAD HAD A CARRYALL, AND IT WAS USED, UH, THEY PICKED UP THE KIDS WHO, BECAUSE WE LIVED IN BROWNTOWN, IF YOU, YOU KNOW, THE SAME THING EVEN WAY BACK THEN, UM, PARENTS, YOU KNOW, MOMS DIDN'T WORK AS MUCH, BUT NOT MANY OF THE MOMS OUT THAT WAY HAD CARS TO TRANSPORT.

SO MY PARENTS DID A LOT OF, THEY PICK ALL THE KIDS UP, THEY'D TAKE 'EM TO PRACTICES, THEY WOULD PICK 'EM UP AND BRING 'EM HOME.

UM, AT ONE POINT WHEN IT SEEMED LIKE ABOUT HALF THE FOOTBALL TEAM HAD INJURIES, THEY EVEN TOOK 'EM TO THE ORTHO, UH, PS DOCTOR FOR THEIR, UM, CAST REMOVALS AND THOSE KIND OF THINGS.

SO, AND I, I'M ASSUMING A LOT OF THAT STILL HAPPENS THAT CARPOOLING, UH, IS BECAUSE THE KIDS WANNA BE TOGETHER.

SO THE NUMBER OF THE CARS MAY NOT QUITE EXCEED THE 20 ON THOSE THINGS BECAUSE THE KIDS ARE GONNA WANNA BE TOGETHER IN CARPOOL.

SO THREE OR FOUR KIDS MIGHT BE IN ONE CAR, HOPEFULLY.

UM, SO THAT, THAT WOULD HOPEFULLY NEGATE SOME OF THE TRAFFIC ON THE ROAD AS WELL.

BUT AGAIN, WE'RE, WE'RE TALKING ABOUT THINGS FOR KIDS AND I, I'M HOPING MS. RUSSELL, THAT YOU GET TO ENJOY SEEING THE KIDS OUT THERE HAVING A GREAT TIME.

I SAID THAT'S THE, YEAH, THAT, YEAH.

AND I'M SURE, UM, WHEN I WENT OUT, I WAS AMAZED THAT THAT BUILDING IS HUGE.

ALL THE DOORS TO THAT BUILDING, IT'S, IT'S A WALL OF DOORS AND THEY'RE ALL INSULATED.

AND THE ONE AREA THAT THEY SHOWED ME, THEY PLANNED TO PUT THE BATING CAGE, UM, I'M ASSUMING YOUR HOUSE IS ACROSS THE FIELD, IS, IS CLOSE TO THOSE BUILDINGS AND THE LINE, I DON'T EVEN THINK THE BALLS, UNLESS THEY REALLY HIT 'EM, WHAT DO YOU CALL THAT WHEN IT FLIES BACK? I'M NOT GOOD AT BASEBALL.

UM, BUT WHATEVER IT IS, YOU GUYS ARE, MY GRANDSONS ARE PLAYING T-BALL AND WHATEVER COMES AFTER T-BALL AND THE NEXT THING THERE'S SEVEN AND NINE.

UM, AND I, I KNOW HOW I'VE ENJOYED GOING AND, AND WATCHING THEM.

YOU MISS SPORTS AFTER A WHILE.

I NEVER THOUGHT WHEN I WAS DOING ALL THAT, RUNNING AROUND TO WRESTLING

[01:45:01]

TOURNAMENTS AND SITTING ON BLEACHERS ALL DAY LONG THAT I WOULD MISS IT.

BUT I DO, I EVEN MISS THE STINKY CLOTHES THAT I WASHED.

UM, YOU KNOW, SO SPORTS IS IMPORTANT, GETTING THESE KIDS FROM DOING THIS.

THE KIDS IN THIS COMMUNITY HAVE THE BEST THUMBS IN THE WORLD PROBABLY, CUZ THAT'S ONE OF THE BIGGEST ACTIVITIES THEY HAVE.

AND IT'S ONE OF THE THINGS THAT DRIVES ME THE MOST CRAZY BECAUSE THEY NEED TO GET OUT, THEY NEED TO GET DIRTY.

UM, THEY NEED TO, TO, TO BREATHE FRESH AIR, ESPECIALLY AFTER COVID WHERE THEY WERE BOTTLED UP SO BADLY, THEY NEED TO GET OUT.

IT'S GOOD FOR THEIR HEART, IT'S GOOD, YOU KNOW, FOR THEIR OVERALL HEALTH DOWN THE ROAD AS WELL AS LIKE THE PEOPLE SAID, TEACHING THEM HOW TO BE SPORTSMEN AND GET ALONG.

MAYBE WE'D HAVE LESS ROAD RAGE IF PEOPLE LEARN, GOT TOGETHER AND LEARNED HOW TO DEAL WITH PEOPLE ON A MORE OF A INTERPERSONAL LEVEL THAN ON A CELL PHONE TEXTING ALL THE TIME.

SO I, YOU KNOW, AND SEEING THAT'S A FABULOUS PLACE OUT THERE.

I CAN'T IMAGINE LETTING IT GO TO WASTE.

UM, UH, AND IT'S SUCH A SHORT DISTANCE FROM 55.

IF IT WAS WAY UP FORT VALLEY ROAD, YEAH, I'D HAVE MORE OF A CONCERN OF THE TRAFFIC, BUT 0.33 TENTHS OF A MILE FROM 55, IT, IT'S JUST, YOU KNOW, YOU'RE THERE, YOU TURN OFF THE ROAD AND YOU'RE, YOU'RE THERE AND THEN YOU GO BACK OUT PROBABLY THE WAY YOU CAME IN.

UM, SO IT JUST, I, I THINK OUR KIDS NEED IT, ESPECIALLY THE GIRLS.

THE GIRLS IN OUR AREA HAVE VERY LITTLE, AND WHEN I WENT FOR THAT OPENING DAY AND SAW ALL THOSE GIRLS AND ALL THOSE DIFFERENT COLORS, WE CAN'T NEGLECT THESE GIRLS.

UM, WE, WE'VE GOTTA DO BETTER.

AND LIKE THE GENTLEMAN SAID, IT'S NOT GONNA COST TAX DOLLARS ANYTHING.

UM, THE OTHER THING IS WITH THE CONDITIONAL USE PERMIT, THERE'S CONDITIONS, IF YOU BREAK THE CONDITIONS THE PERMIT GOES AWAY BY.

RIGHT? YOU CAN'T CHARGE FOR IT, BUT YOU COULD LET YOUR FRIENDS AND FAMILY COME OUT THERE SEVEN DAYS A WEEK, PLAY ALL DAY LONG AND NOTHING CAN BE DONE ABOUT IT UNLESS YOU'RE BREAKING THE LAW.

BECAUSE BY RIGHT.

IT'S YOUR PLACE, YOU CAN DO IT.

SO CONDITIONAL USE PERMITS ARE A GOOD THING.

IT KEEPS THINGS UNDER CONTROL WHEREBY, RIGHT, IF YOU'RE NOT BREAKING THE LAW, YOU GOTTA PUT UP WITH IT.

SO THOSE ARE MY THOUGHTS.

ANY OTHER QUESTIONS, MADAM CHAIRMAN? MAY I ADD JUST A COUPLE OF ITEMS? UM, AS YOU KNOW, THAT INTERSECTION IS, UH, A PRETTY DANGEROUS INTERSECTION.

IT'S, IT'S CURRENTLY ON THE SMART SCALE FOR VDOT IMPROVEMENTS.

WE'RE NOT SURE WHEN THAT'S GONNA ACTUALLY BE APPROVED FOR VDOT BY VDOT FOR THE GRANT MONEY TO, TO IMPROVE THAT.

UM, WE LOOK AT MAYBE SOME SOLUTIONS BEFORE THAT CAN HAPPEN.

AND ONE OF THOSE SOLUTIONS MAY BE THAT WE HAVE MORE LAW ENFORCEMENT IN THAT AREA DURING THOSE EVENING TIMES WHEN PEOPLE ARE GOING HOME.

I GO ON THAT ROAD ALL THE TIME AND, UM, I PROBABLY MIGHT BE GOING A LITTLE TOO QUICK SOMETIME, BUT I DO KNOW THAT THAT INTERSECTION'S DANGEROUS.

SO I MAKE SURE THAT I'M CAUTIOUS NEAR THERE.

ABSOLUTELY.

UM, THAT MIGHT BE SOMETHING THAT, UM, THE APPLICANTS WILL WANT TO HAVE IN THEIR, YOU KNOW, AGREEMENT WITH THEIR CUSTOMERS AND THEIR CLIENTS, YOU KNOW, JUST TO NOTIFY THEM, NOTIFY THEM OF ALTERNATIVE ROUTES IF THEY, UH, SO CHOOSE TO DO THAT.

MM-HMM.

, UH, WE CAN LOOK AT POSSIBLY MITIGATING SOME OF THE NOISE WITH THE NEIGHBOR.

THE APPLICANTS COULD, UH, POTENTIALLY PUT UP SOME LANDSCAPING.

WE FOUND THAT THIA GREEN GIANT OR PROVIDERS ARE FAST GROWING.

THEY COULD PROVIDE A SCREENING AND UH, SOME NOISE SUPPRESSION FOR THE APPLICANTS.

SO WE COULD POTENTIALLY LOOK AT DOING THAT.

AND, UM, AND CERTAINLY JUST, UH, UH, YOU KNOW, CREATING AWARENESS OF SAFETY IN THAT AREA.

UH, YOU KNOW, YOU'LL HAVE MORE TRAFFIC, YOU'LL HAVE CHILDREN IN CARS AND, UH, IT MAY BE THAT THEY MAY WANNA PROMOTE CARPOOLING THAT MIGHT DECREASE THE AMOUNT OF TRAFFIC.

SO THAT'S SOMETHING WE JUST LOOK AT SOME OF THESE SOLUTIONS THAT ARE LOW COST AND, AND, UH, IT MAY BE SOMETHING YOU WANT TO ADD AS A CONDITION OR JUST, YOU KNOW, UH, WE CAN WORK WITH THE APPLICANT TO MAKE SURE THAT'S COMMUNICATED.

YEAH, CUZ MY CONCERN IF FOR WHATEVER IT'S WORTH ON 55 AND 6 78 OR THE YOUTH, I MEAN, YEAH, IF YOUR KIDS UNDER 16 WILL BE CARPOOLING, BUT THE ONES WHO CAN DRIVE WILL BE DRIVING AND NOT ONLY, YOU KNOW THAT IT'S JUST NOT LOCAL TRAFFIC, IT'S ALSO BIS THAT

[01:50:01]

USE THAT ROAD TO GET ONTO 55.

YOU KNOW, ALSO THE, UH, 6 78 IS ALSO USED BY THE LOCALS FROM, UM, SIX 19 WHEN THERE'S A LOT OF EVENTS GOING ON IN FRONT ROYAL THAT THEY DIDN'T WANNA SPEND AN HOUR TO GET OUT.

SO THEY COME DOWN MOUNTAIN ROAD TO SIX, YOU KNOW, TO, UH, FORT VALLEY TO, TO, TO DIVERT FROM, UM, FROM THOSE, UH, BACKUPS OUT ON THREE 40 IN EVENTS IN TOWN.

SO THANK YOU FOR THAT, MATT, BECAUSE THAT IS, UM, EVEN THOUGH NO ONE KNOWS A LOT ABOUT IT, BUT I'VE BEEN THERE AND I'VE SEEN AT LEAST THREE TIMES, YOU KNOW, HELICOPTERS LANDING IN THE MIDDLE OF THE, OF THESE OF CEMETERY TAKING SOMEONE OUT BECAUSE OF THAT INTERSECTION.

SO SAFETY IS VERY IMPORTANT TO ME WHEN IT COMES TO THAT.

AND I'M SURE, I'M SURE THE APPLICANT, THE LAST THING THEY WOULD WANT TO SEE IS, OH, BEST THING I WANT ANY OF US, ANY OF US.

SO ABSOLUTELY.

BUT I THAT, YOU KNOW, I, YOU KNOW, I FOLKS JUST CAN'T TAKE IT LIGHTLY OF WHAT 6 78 IS REALLY LIKE, IS THAT INTERSECTION IS WHAT MAKES IT DANGEROUS BECAUSE THE SITE DISTANCE IS SUFFICIENT.

I DROVE OUT THERE MULTIPLE TIMES, DOWNHILL GRADE AND, AND PEOPLE ARE, IS IT PEOPLE IN A HURRY? UH, PEOPLE WANT GUESS AND AGAIN, AND IT GETS REAL DARK OUT THERE TOO.

LET ME TELL YOU, OKAY.

IT'S BECAUSE THE SITE, WHEN YOU'RE DRIVING AT NIGHT, YOU KNOW, YOU'RE LIKE, OH MY GOD, I I GOT THE ROAD.

YEAH, IT'S 10 LETTERS MA'AM.

SPEED KILLS.

YES, BECAUSE THE, THE ROAD IS FLAT FROM THE CEMETERY UP TO THE INTERSECTION.

OH, YOU COME OVER THE HILL AND YOU START MOVING.

YEAH.

YEAH.

YES.

AND THEN RIGHT WHEN YOU'RE, YOU GET ON 6 78 IS, I THINK IT'S 45 MILES AN HOUR.

RIGHT TURN, IT'S NOT 25 OR 35, IT'S 45 AND I DRIVE IN THE DAYLIGHT.

WELL, FOOLS DRIVE EVERYWHERE THEY SAY THEY, UH, THERE ARE NO, UH, TURN LANES THERE, THERE'S NO D CELL LANES OR ANYTHING TO GET ONTO BOX MILL AND FORT VALLEY ROAD.

SO IT'S PRETTY MUCH LIKE YOU'RE JUST TAKING A FULL STOP AND BECAUSE THE AMOUNT OF TRAFFIC COMING BOTH WAYS ON 55, UNFORTUNATELY YOU HAVE TO STOP COMPLETELY MANY TIMES.

AND A LOT OF TIMES PEOPLE JUST AREN'T PAYING ATTENTION AND ALL THE OTHER THINGS THAT COME APART WITH A, WITH AN ACCIDENT AND, YOU KNOW, AND YOU ADD THAT WITH, UH, YOU KNOW, YOUTH WHO MAY NOT HAVE THAT EXPERIENCE.

UH, IT IT, IT'S JUST SOMETHING NOT TO BE TAKEN LIGHTLY.

YES.

UM, SO YEAH.

ANY OTHER QUESTIONS OR DISCUSSION? MM-HMM.

ARE WE READY FOR A MOTION? I'LL MAKE THE MOTION.

I MOVE THE BOARD OF SUPERVISORS APPROVE THE CONDITIONAL USE PERMIT REQUEST OF COLE AND DANIELLE HOAS FOR A COMMERCIAL OUTDOOR RECREATIONAL OPERATION WITH CONDITIONS AS RECOMMENDED BY THE PLANNING COMMISSION AND STAFF.

IS THERE A SECOND? SECOND ROLL CALL MRS. SHIRAI.

MR. BUTLER? NO.

MRS. OATS? I MADAM CHAIR? I MRS. COOK? NO, MR. MA.

I I KNOW I SAID NO BO BOOING OR SO FORTH.

SO I'M GONNA LET YOU SLIDE ON THAT .

UM, WE'VE GOT SEVERAL OTHER, UM, PERMITS TO GO THROUGH IF, AND I'M ASSUMING YOU DON'T WANNA HEAR THEM, SO WE'LL WAIT AND LET YOU EXIT.

EVERYONE SAFE TRAVELS HOME.

YOU WANNA GIVE US FIVE MINUTES? UM, YEAH, WE'LL TAKE A FIVE MINUTE RECESS AND BE BACK AT EIGHT O'CLOCK.

THANK YOU.

I DON'T, YES, , I GONNA GET MORE COFFEE, RIGHT? LET'S SEE.

[D. Conditional Use Permit 2022-07-01, Michelle Moriarty for a Short-Term Tourist Rental Located at 96 Cappy Road and Identified on Tax Map 23C, Section 2, Block 2, Lot 29 – Chase Lenz]

ALL RIGHT.

OUR NEXT CONDITIONAL USE PERMIT IS PERMIT NUMBER 2022 DASH OH SEVEN DASH OH ONE.

AND THIS PROPERTY HAS NOT HAD ANY PREVIOUS CONDITIONAL USE PERMITS ISSUED FOR USES IN THE RESIDENTIAL ONE ZONING DISTRICT, NOR HAVE THERE BEEN ANY ZONING VIOLATIONS RECORDED FOR THE PROPERTY.

UH, AND THIS PROPERTY WAS RECENTLY ISSUED A CONDITIONAL PERMIT BY THE HEALTH DEPARTMENT, WHICH APPROVED SIX OCCUPANTS FOR FOUR BEDROOMS IN THE DWELLING.

UM, AND AS THE PROPERTY IS IN SHENDO FARMS, COMMENTS WERE REQUESTED FROM PROPERTY OWNERS OF SHENDO FARMS AND WE RECEIVE A RESPONSE STATING THEY HAVE NO OBJECTIONS TO THE REQUEST.

UH, AND THE DWELLING DOES MEET THE SETBACK, THE 100 FOOT SETBACK REQUIREMENT FROM ADJACENT DWELLINGS WITH THE CLOSEST DWELLING 145 FEET TO THE NORTHWEST.

SO I WILL GO AHEAD AND READ THROUGH THE RECOMMENDED CONDITIONS THIS FIRST TIME AND WE'LL JUST POINT OUT ONES THAT MIGHT BE DIFFERENT, UH, FOR THE REMAINING SHORT TERM TORRES STR APPLICATIONS TONIGHT.

THE APPLICANT IS HERE TONIGHT.

THIS PUBLIC HEARING HAS BEEN PROPERLY ADVERTISED AND ADJACENT PROPERTY OWNERS HAVE BEEN NOTIFIED.

IF YOU HAVE ANY QUESTIONS AVAILABLE, THANK YOU.

WOULD THE APPLICANT LIKE TO SPEAK AT THIS TIME? THANK YOU.

PUBLIC HEARING IS NOW OPEN.

ANY QUESTIONS, UM, FROM THE BOARD, IF NOT, MRS. SHIRAI, HAS ANYONE SIGNED UP? MS. MO ALREADY DID SIGN UP, BUT YOU DID NOT WANNA SPEAK? UH, NO, I, NO.

OKAY.

OH, WOULD ANYONE ELSE LIKE TO SPEAK AT THIS TIME? YES, MA'AM.

I'M LINDA MCDONOUGH AND I LIVE AT 1205 HIGH TOP ROAD.

AND IT SEEMS TO ME THAT THESE CONDITIONAL USE FOR, UM, THE BED NOT, OR THE AIRBNBS AND THIS TYPE OF STUFF HAS REALLY OPENED UP A CAN OF WORMS. UM, WE'RE A RESIDENTIAL AREA.

YOU CAN'T HAVE A, UM, LIKE A MECHANIC SHOP.

YOU CAN'T HAVE ANYTHING, YOU KNOW, LIKE THAT IN OUR AREA.

AND IT SEEMS LIKE ALL OF THESE AIRBNBS, YOU KNOW, THEY'RE IN THOSE HOMES.

THAT'S A BUSINESS.

THESE ARE OTHER PEOPLE COMING IN.

UM, THEY GET LOST.

UH, LAST WINTER WE HAD WHERE, UM, THERE THEY COME IN, THERE'S A LITTLE BIT OF SNOW ON THE GROUND, THEY GET STUCK, WE END UP HAVING TO PULL 'EM OUT, THEN THEY WANT US TO TAKE 'EM TO THE PROPERTY AND WE'RE LIKE, WAIT A MINUTE, HOW ARE YOU GONNA GET OUT? UH, BECAUSE THERE'S SNOW ON THE GROUND.

THEN I HAVE SEVERAL NEIGHBORS BECAUSE THERE'S QUITE A FEW OF THEM UP ON HIGH TOP.

SEVERAL NEIGHBORS HAVE BEEN TELLING ME BECAUSE I'VE BEEN GOING OUT AND TALKING TO 'EM AND EVERYTHING, AND THAT THEY'RE HAVING A LOT OF PROBLEMS WITH THE PEOPLE THAT RENT, UH, THERE, THAT THEY'RE VERY RUDE THAT THEY'RE UP TILL ONE, TWO O'CLOCK IN THE MORNING AND WE'RE, THIS IS A RESIDENTIAL, PEOPLE STILL WORK.

THEIR CHILDREN NEED TO GET UP AND GO TO SCHOOL.

AND HERE YOU HAVE ALL THIS NOISE GOING ON.

THEY PUT IN HOT TUBS, YOU DON'T KNOW WHO TO CALL.

UM, THEY, YOU KNOW, AND WE WANNA BE LEFT ALONE.

WE LIVE IN THE COUNTRY, WE LIVE UP ON THE MOUNTAIN.

UM, WE, WE PURCHASE THIS.

AND IT SEEMS TO ME OF ALL THE YEARS IT IS, UH, MORE AND MORE PEOPLE ARE BUYING IN THESE NEW PROPERTIES AND TURN 'EM OUT TO BE BED AND BREAKFAST, OR NOT BED AND BREAKFAST, BUT THE AIRBNB.

AND SO YOU HAVE, UM, EVERY WEEKEND, EVERY DAY, ALL THESE DIFFERENT PEOPLE COMING IN THAT HAVE NO CARE FOR OUR ROAD.

AND, UM, WHAT ABOUT THE, THE FEES OF ALL OF THESE

[02:00:01]

DIFFERENT PEOPLE DRIVING UP AND DOWN THE ROADS? ARE THEY PAYING EXTRA FOR OUR ROAD MAINTENANCE? UM, AND THE RESIDENTS HAVE GONE OUT AND TRIED TO SPEAK TO THE PEOPLE, BUT THEY'RE ON VACATION, THEY DON'T FREAKING CARE.

AND UM, SO I HAVE SUGGESTED THAT THE, UM, RESIDENTS AND STUFF THAT HAVE THEM NEXT DOOR AND WITHIN, BECAUSE, YOU KNOW, THEY'RE NOT ALL RIGHT TOGETHER.

YOU HAVE MAYBE A HOUSE HERE, A HOUSE OVER HERE, A HOUSE DOWN HERE, MAYBE ONE ACROSS THE STREET.

AND SO IT'S AFFECTING ALL OF THESE WITH THIS ONE HERE BECAUSE THEY'RE OUT IN THE HOT TUB UNTIL TWO O'CLOCK IN THE MORNING.

AND I, IT JUST REALLY HAS OPENED UP, YOU KNOW, TO WHERE WE'RE NOT RESIDENTIAL.

SO DOES THAT MEAN THAT IF SOMEBODY WANTS TO OPEN UP A MECHANIC SHOP THEY CAN BECAUSE IT'S ON THAT RESIDENCE? BECAUSE THAT'S EXACTLY WHAT'S GOING ON.

THE THESE PEOPLE AREN'T, THESE PROPERTY OWNERS ARE NOT IN THEIR HOMES RENTING OUT OTHER PROPERTIES FROM THEIR HOUSE.

THEY ARE ACTUALLY HAVING PEOPLE COME THERE.

SO WHAT'S THE DIFFERENCE OF HAVING A DOG KENNEL? UM, A DOG WALKER SERVICE.

UM, ANY OTHER BUSINESS IN OUR RESIDENTIAL, UH, WE ALREADY HAVE A GRAVEYARD.

UH, SO WHY NOT JUST OPEN IT UP AND NOT BE RESIDENTIAL ANYMORE AND THEN OPEN IT UP TO ALL THE BUSINESSES BECAUSE, UM, IT SEEMS TO ME IF YOU GO AND YOU LOOK ON EXACTLY HOW MANY ARE IN HIGH TOP CROSSWAYS FREEZE, WHICH IS THAT WHOLE CIRCLE THERE, YOU'LL FIND OUT THAT THERE'S A HECK OF A LOT OF 'EM.

AND SO WHERE DOES THAT LEAVE US WHO LIVE OUT THERE FOR THE, UH, COUNTRY? AND I DO GET TIRED OF THE SPEEDING BECAUSE THEY DON'T KNOW HOW TO DRIVE ON OUR ROADS.

THEY'RE LOST.

AND THEN THE PEOPLE THAT GET STUCK THAT, UM, BECAUSE WE'RE NEIGHBORLY, WE'RE GONNA PULL 'EM OUT, BUT WE'RE NOT GONNA GO AND TAKE YOU TO THE PROPERTY THAT YOU RENTED AND THEN PICK YOU UP THE NEXT MORNING AND, AND GET YOU OUT OF THERE.

UM, SO I'M, I'M TOTALLY A, UH, AGAINST THIS AND I'M TOTALLY AGAINST ANY OF 'EM, BASICALLY BECAUSE WE ARE A RESIDENTIAL AND HERE WITH ALL THESE BEEN BREAKFASTS, OR NOT BEEN BREAKFASTS, BUT THE AIRBNBS THAT THEY'RE TURNING US INTO, UM, A BUSINESS INSTEAD OF, UM, A RESIDENTIAL.

AND I HAVE LIVED THERE FOR OVER 20 YEARS AND MY HUSBAND'S FAMILY HAS LIVED THERE SINCE THE SEVENTIES.

SO WE KNOW EXACTLY WHAT WE'RE TALKING ABOUT.

AND IT ISN'T, UM, YOU KNOW, RIGHT WHEN YOU COME HOME AND YOU WANNA ENJOY YOUR AREA AND YOU GOT THESE OTHER PEOPLE OVER HERE, EVEN THOUGH THEY'RE NOT RIDING FOUR WHEELERS, EVEN THOUGH THEY'RE NOT HAVING A FIRE WHERE I AM BECAUSE MY BURN PIT'S BEEN THERE FOR 20 YEARS OR LONGER THAN THAT, AND IT'S LIKE TWO AND A HALF FEET DEEP AND WE HAVE OUR WATER, WE KNOW HOW TO DO IT, WE CONTACT THE SHERIFF AND LET 'EM KNOW THAT IT'S GOING ON.

AND, BUT WITH THE PEOPLE THAT HAVE BEEN SPEAKING TO ME, I DON'T EVEN KNOW WHO TO SEND THEM TO.

YOU CAN'T SEND 'EM TO THE PROPERTY OWNER.

WE DON'T KNOW WHO THE PROPERTY MANAGERS ARE.

THEY DON'T WANNA CALL THE POLICE BECAUSE, YOU KNOW, WE WANNA BE LEFT ALONE.

WE DON'T WANNA HAVE TO HAVE POLICE COMING UP THERE CONSTANTLY TO HAVE TO TAKE CARE OF THE ISSUES THAT ARE GOING ON WITH THESE RENTERS THAT ARE COMING UP.

NOW, I'M NOT SAYING IT'S ALL OF 'EM, BUT I AM SAYING THAT IT IS MORE THAN 50, 60% OF THE PEOPLE THAT ARE COMING UP RENTING COULD CARE LESS OF WHAT IT IS THAT THE PEOPLE ARE JUST POLITELY GOING OVER AND SAYING, HEY MAN, COULD YOU LIKE GET IT DOWN? YOU KNOW, IT IS TWO IN THE MORNING.

AND MY HUSBAND WENT, OKAY, YOU GUYS WANNA MAKE SOME NOISE.

HE GOES OVER AND STARTS THE WOOD SPLITTER AND STARTS SPLITTING WOOD.

AND SO IT'S SORT OF LIKE, WHAT, WHAT ARE YOU GONNA DO HERE? SO THESE ARE NOT BENEFIT TO OUR COMMUNITY, AND I UNDERSTAND ABOUT HAVING TWO HOMES, I UNDERSTAND ABOUT TRYING TO GET THE MONEY AND EVERYTHING, BUT TO PURCHASE THESE HOMES JUST TO TURN THEM INTO A BUSINESS.

UM, WHERE IS THAT LEAVING OUR COMMUNITY? THANK YOU.

THANK YOU.

ANYONE ELSE WANNA SPEAK AT THIS TIME? THIRD AND FINAL CALL.

CAN I RESPOND TO THIS? YES, MA'AM.

OKAY.

HI, UH, MICHELLE MODI.

UM, THANKS FOR YOUR TIME.

SO I COMPLETELY UNDERSTAND THE, THE CONCERNS.

I MEAN, SPECIFICALLY WITH THIS HOUSE, I MEAN, I LIVE IN FALLS CHURCH ABOUT AN HOUR AWAY, AND THIS AREA HAS BEEN A PLACE THAT I'VE GONE THROUGH MY WHOLE LIFE.

UNFORTUNATELY, WE CAN'T, UH, MOVE HERE DUE TO OUR JOBS, BUT THIS IS REALLY SUPPOSED TO BE A SECOND

[02:05:01]

FAMILY HOME.

UM, UNFORTUNATELY WE DON'T MAKE ENOUGH MONEY TO BE ABLE TO PAY THE MORTGAGE, YOU KNOW, FOREVER WITHOUT, UM, A LITTLE ASSISTANCE FROM AIRBNB.

BUT, YOU KNOW, UM, WE JUST GOT MARRIED AND, UH, WE ARE LOOKING TO HOPEFULLY HAVE KIDS SOON.

AND SO THIS IS REALLY GOING TO ULTIMATELY BE A FAMILY HOME AND THEN WHEN WE'RE NOT ABLE TO USE IT, UM, HAVE THAT, YOU KNOW, THOSE DATES BE AVAILABLE ON AIRBNB OR SOME SORT OF SHORT TERM RENTAL.

UM, SO I, AGAIN, I CAN, UM, I'VE SENT A, A PMP IN THAT'S GOING TO BE, UH, YOU KNOW, THE, THE BOOK OR THE INFORMATION FOR THE GUESTS, UM, SO WE CAN MAKE, YOU KNOW, THOSE SORTS OF CONCERNS CLEAR.

UM, AND YOU KNOW, I'VE SPOKEN TO EVERY SINGLE, UH, ADJOINING NEIGHBOR, EVERY SINGLE NEIGHBOR ON MY STREET, GONE THROUGH EXACTLY WHAT WE'RE PLANNING TO DO, MAKE SURE THAT THEY HAVE MY NUMBER, UM, AND YOU KNOW, IF THERE'S ANY ISSUES THAT THEY CAN REACH OUT TO US.

AND ALSO THE, THE PROPERTY MANAGER, UM, AS WELL, UH, JUST IF, IF THERE'S ANY CONCERNS THAT THEY CAN REACH OUT TO US, UM, THERE IS QUIET HOURS FROM UH, 10:00 PM UNTIL 7:00 AM.

UM, AND WE'VE ALSO INCLUDED THE, UH, I THINK IT'S CHAPTER 1 23, THE, THE NOISE, UM, INFORMATION FROM WARREN COUNTY IN THE, IN THE PMP AS WELL.

UM, I THINK THAT'S IT.

THANKS.

THANK YOU.

ANYONE ELSE WANT TO SPEAK? PUBLIC HEARING IS NOW CLOSED.

ANY DISCUSSION OR QUESTIONS FROM THE BOARD MEMBERS AT THIS TIME? YES, MA'AM.

I'M CHAIR.

UM, THE, UH, MY CONSTITUENT HERE, YOU KNOW, BROUGHT UP SOME VERY GOOD POINTS ABOUT THE, UM, THE FACT THAT, UM, YOU KNOW, YOU'VE GOT FOLKS WHO ARE, YOU KNOW, THEY'RE, THEY'RE SHORT TERM RENTALS AND, UH, YOU KNOW, IF THEY'RE CAUSING A R OR ANYTHING, THEY, THE, THE FOLKS WHO LIVE AROUND IN THE AREA REALLY DON'T KNOW WHO TO GET IN CONTACT WITH, UH, OTHER THAN, YOU KNOW, CALLING THE SHERIFF.

AND, UM, I WAS JUST WONDERING WHEN WE, UH, WHEN WE, UH, GIVE THESE, UH, THESE CONDITIONAL USE PERMITS, UM, YOU KNOW, HAVE WE EXERCISED THAT, UH, THAT AUTHORITY TO, TO COME IN AND SAY, OKAY, YOU KNOW, YOU'RE ABUSING THIS.

UH, YOU'VE HAD, HAD PEOPLE HERE WHO HAVE BEEN, YOU KNOW, DISTURBING THE PEACE, UH, WE ARE GOING TO REVOKE THIS CONDITIONAL USE PERMIT.

HA HAVE WE EXERCISED THAT MR. WENLING? I'LL TAKE CARE OF IT.

UM, WE'VE NOT GOTTEN THE CALLS.

OKAY.

UH, WE ARE AVAILABLE MONDAY THROUGH FRIDAY.

WE'VE JUST NOT EVER RECEIVED CALLS ABOUT DISTURBANCES FROM THESE, WE'RE NOT AWARE OF ANY FROM THE SHERIFF'S DEPARTMENT.

OBVIOUSLY SHERIFF'S DEPARTMENT IS YOUR FIRST CALL AND THEY WOULD, THEY ENFORCE THE NOISE ORDINANCE NO MATTER WHETHER IT'S A SHORT TERM TOURIST RENTAL OR SOMEBODY REVING THEIR MOTORCYCLE OR ATV TOO LOUD OR WHATEVER THEY'RE GONNA, IF THEY NEED TO, THEY'LL ENFORCE THAT, OKAY, WE, THIS LAND USE IS JUST NOT THAT IMPACTFUL.

NOW WHAT WE DO DO IS WE RECOMMEND TO THE PROPERTY OWNER TO REACH OUT TO THEIR NEIGHBORS, MAYBE TO PROVIDE THEIR NEIGHBORS WITH THAT PROPERTY MANAGEMENT PLAN, WITH THE CONTACT INFORMATION OF THEIR PROPERTY MANAGERS.

IF THEY LIVE OUT OF THE TOWN AND THEY'RE NOT MANAGING THE ACT, ACTIVELY MANAGING THE PROPERTY, THEY NEED TO HAVE THAT PROPERTY, LOCAL PROPERTY MANAGEMENT COMPANY OR PERSON AS A CONTACT AND GIVE THAT CONTACT NUMBER TO THAT PERSON.

THAT'S A, A RESPONSIBLE WAY OF OPERATING THESE RESIDENTIAL BUSINESSES.

UM, THE STATE HAS DETERMINED THESE TO BE RESIDENTIAL USES.

THEY ARE SOMEWHAT OF A COMMERCIAL ASPECT, BUT THEY ARE STILL RESIDENTIAL USE.

SO, UM, THEY'RE NOT, IT IS A PART.

RIGHT.

THE CONSTITUTION, THE VIRGINIA, UM, SUPREME COURT FOUND THAT THEY ARE NOT CONSIDERED BUSINESSES.

RIGHT? RIGHT.

WHAT, BUT IN ANY CASE, FOR THE, JUST FROM THE STANDPOINT OF GOODWILL TO YOUR NEIGHBORS, ESPECIALLY IF YOU LIVE OUTSIDE OF THE, THE COMMUNITY, YOU'RE NOT A FULL-TIME PRO, UH, PERSON WHO LIVES HERE.

WE JUST ASKED THAT THEY REACH OUT AND, AND, YOU KNOW, PROVIDE THAT CONTACT INFORMATION.

THE LAST THING THEY WANT TO DO IS HAVE YES.

CAUSE THEM TO BE IN VIOLATION OF THIS PERMIT, WHICH WE WOULD REVOKE IF, IF WE GOT FOUND A SYSTEMIC PATTERN OF FOREIGN COMPLIANCE, WE WOULD REQUEST THAT OF YOU.

LET'S JUST PUT IT THAT WAY.

SO, MA'AM, THAT YOU DID REACH OUT TO THE NEIGHBORS, YOU

[02:10:01]

DID GIVE THEM THE, THE INFORMATION ABOUT HOW TO CONTACT YOU AND OH, YEAH.

YEAH.

I, I'VE GONE UP TO EVERY SINGLE NEIGHBOR'S DOOR, HAD LIKE EXTENSIVE CONVERSATIONS WITH THEM, UH, TOLD THEM EXACTLY WHAT I'M DOING, UM, GIVEN THEM, UH, MY, MY NUMBER, MY HUSBAND'S NUMBER, MY MOM'S NUMBER.

UM, AND CAN YOU GET HER PRETTY MUCH THERE LIKE EVERY WEEKEND? MA'AM, WOULD YOU COME BACK UP IN ORDER FOR HER TO BE ABLE TO GET YOU ON THE MINUTES? YOU HAVE TO BE UP THERE.

SORRY, I DIDN'T WANNA INTERRUPT YOU, BUT YOU WERE ON THE ROLL.

SORRY, .

UM, I WAS SAYING, UH, THAT I DID GO UP TO EVERY SINGLE NEIGHBOR.

UM, AGAIN, WE BOUGHT THIS PLACE IN APRIL AND WERE THERE LIKE, IF, IF NOT EVERY WEEKEND, EVEN DURING THE WEEK TOO.

UM, BECAUSE, UH, IT'S KIND OF LIKE A JOINT VENTURE WITH MY MOM AND I.

SO, UM, THIS IS LIKE HER RETIREMENT PROJECT.

UM, AND SO WE SEE THE NEIGHBORS ALL THE TIME, UM, AND WE HAVE ALL, ALL OF THEIR NUMBERS.

WE TEXT EACH OTHER.

UM, YOU KNOW, LIKE THE, THE OTHER WEEK I WAS THERE, I HAD SOME FRIENDS THERE AND YOU KNOW, IT WAS PROBABLY LIKE EIGHT, 8:00 PM AND WE WERE PLAYING SOME MUSIC OUTSIDE.

THE NEIGHBOR TEXTS ME AND WAS LIKE, HEY, WE HAVE OUR, OUR BABY WITH US.

UM, I DON'T KNOW IF IT'S YOU OR IF YOU HAVE RENTERS YET, BUT JUST WANTED TO LET YOU KNOW, LIKE, WE CAN HEAR THE MUSIC.

AND I WAS LIKE, OH MY GOSH, I'M SO SORRY.

TURNED OFF EVERYTHING.

UM, SO THEY, THEY FEEL VERY COMFORTABLE COMING TO US AND LETTING US KNOW.

THAT'S, THAT'S THE ONLY THING THAT, UH, THEY'VE TOLD US SO FAR.

UM, BUT LIKE I SAID, WE'RE THERE ALL THE TIME, UM, OKAY.

AT LEAST EVERY WEEKEND, IF NOT DURING THE WEEK AS WELL.

SO, MA AND MAAM, CHAIR, I'D LIKE TO ADDRESS MY CONSTITUENT, UH, MA'AM, IF, IF YOU DO FIND THAT THERE ARE INSTANCES WHERE PEOPLE ARE, YOU KNOW, VIOLATING OR JUST MAKING A NUISANCE, YOU KNOW, THE, THESE BED AND BREAKFAST, I ENCOURAGE YOU TO LET, UM, FOR, FOR YOU AND YOUR NEIGHBORS TO KNOW THAT, THAT THEY CAN CALL MR, YOU KNOW, WENLING A CALL, UH, A CALL, YOU KNOW, THE, THE, UH, THE DEPARTMENT HERE AND, UH, PROVIDE A, UH, YOU KNOW, UH, SOME TYPE OF, OF A COMPLAINT BECAUSE WE CAN'T ACT IF WE DON'T GET THE INFORMATION.

BUT I, YOU KNOW, I, I'M VERY CONCERNED ABOUT THIS.

I'VE, I'VE SEEN THAT THERE'S, YOU KNOW, THAT IT'S, IT'S SEEMS TO BE, YOU KNOW, MORE AND MORE THAT, UH, THAT WE'RE GETTING THESE CON CONDITIONAL USE PERMITS.

BUT IF IT'S BECOMING A NUISANCE OR PROBLEM, WE NEED TO KNOW ABOUT THAT BECAUSE, UM, YOU KNOW, THAT THAT WOULD REVERSE THIS TREND IN THAT, UH, YOU KNOW, IF YOU, IF YOU START, UH, UM, OH, UH, YOU KNOW, TAKING AWAY THE, UH, THE, THE CONDITIONAL USE PERMITS, THEN WE WOULD STOP ISSUING THEM ALSO.

THAT'S THE WAY THAT I SEE IT.

THANK YOU.

MANAM CHAIR.

IF I COULD ADD, UM, THIS IS ABOUT THE NOISE ISSUE.

OKAY.

WHEN WE SAY, WELL, THE SHERIFF HASN'T HEARD ANYTHING, YOU KNOW, NO ONE'S COMPLAINED AND I JUST WANT TO JUST PLUG THAT SOMETIMES OUR EXISTING NOISE ORDINANCE TIES THE HANDS OF THE SHERIFF TO COME OUT AND DO ANYTHING.

SO I JUST WANT TO MAKE THAT POINT.

DR.

DAVE, YOU WANT? YES, SIR.

I WAS JUST GONNA NOTE, MA'AM, THAT ONE OF THE THINGS WE CAN LOOK AT IN THE ENTIRE PICTURE IS THE, UH, SHORT-TERM RENTALS REGISTER WITH THE COMMISSIONER OF REVENUE.

AND ONE OF THE THINGS WE MIGHT DO WHEN THESE ARE APPROVED IS REQUIRE THAT THERE ALSO BE SOME SORT OF A MASTER LOG KEPT IN PUBLIC SAFETY IN THE COMMUNICATIONS CENTER.

SO IF THE SHERIFF OR FIRE AND RESCUE HAS A CALL ON A PROPERTY, THEY AUTOMATICALLY CAN SEE THAT IT IS A, UH, SHORT TERM RENTAL AND THEY HAVE SOMEBODY THERE TO CONTACT.

AND THAT JUST MIGHT BE SOMETHING OVERALL THAT WE CREATE AS A REGISTRY POINT.

GREAT SUGGESTION, DR.

DAILEY.

OKAY.

ANY OTHER QUESTIONS? IF NOT, WE'LL CLOSE THE PUBLIC HEARING.

IS THERE A MOTION? MADAME CHAIR, I MOVED THE BOARD OF SUPERVISORS APPROVED THE CONDITIONAL USE PERMIT REQUEST OF MICHELLE MOTI FOR A SHORT-TERM CHOICE ROUND WITH THE CONDITIONS AS RECOMMENDED BY PLANNING COMMISSION AND STAFF.

SECOND.

SECOND.

ROLL CALL MRS. SHIRAI.

MR. MABE? AYE.

MRS.

[02:15:01]

COOK? I MADAM CHAIR? AYE.

MRS. OATS? AYE.

THE APPLICANTS ARE REQUESTING A CONDITIONAL USE PERMIT FOR A SHORT TERM TOURIST RENTAL FOR THE PROPERTY.

THEY'VE RECENTLY PURCHASED IN MAY OF 2022.

THE OWNERS PLAN TO USE THE PROPERTY THEMSELVES THROUGHOUT THE YEAR, BUT WHAT THEY WOULD ALSO LIKE TO BE ABLE TO MAKE THE PROPERTY AVAILABLE FOR SHORT TERM LODGING FOR VISITORS OF THE WARREN COUNTY AREA WHEN THEY ARE NOT OCCUPYING IT AND THEY WILL MANAGE THE PROPERTY PERSONALLY.

UH, THIS PROPERTY IS ALSO LOCATED IN THE SHENDO FARM SUBDIVISION.

THIS IS IN THE CAMEL'S BACK SECTION.

CONDITIONAL USE PERMIT 2022 DASH OH SEVEN DASH OH SIX.

MATTHEW WILLIAMS AND J GILBERT FOR SHORT TERM TAS RENTAL LOCATED ONE 15 LONESOME FLATS, ROADS AND IDENTIFIED ON TAP TAX MAT 19 LOT 43 MR. LENS.

THANK YOU MADAM CHAIR.

UM, THE APPLICANTS ARE REQUESTING A CONDITIONAL USE PERMIT FOR A SHORT TERM TOURIST RENTAL FOR THE PROPERTY THEY RECENTLY PURCHASED IN MARCH OF 2022, AND THIS IS THEIR SECOND APPLICATION TONIGHT.

YOU MIGHT HAVE NOTICED, UM, THE OWNERS WOULD LIKE TO MAKE THE ATTACHED CABIN.

THEY ARE IN THE PROCESS OF RESTORING ON THE PROPERTY AVAILABLE FOR SHORT TERM VISITATIONS FOR GUESTS SEEKING TO ENJOY THE WINERIES, HIKING TRAILS, AND OTHER NATURAL ATTRACTIONS OF THE SHENANDOAH VALLEY AREA.

THE APPLICANTS PLAN TO MANAGE THE PROPERTY PERSONALLY WITH ASSISTANCE FROM LOCAL PROFESSIONAL SERVICES FOR CLEANING AND LANDSCAPING MAY NOW ALSO HAVE A CONDITIONAL USE PERMIT FOR SHORTTERM TOURIST RENTAL ELSEWHERE IN THE COUNTY.

UM, THIS PROPERTY IS NOT LOCATED IN A SUBDIVISION.

IT IS OWNED AGRICULTURAL, UM, SURROUNDED BY AGRICULTURAL ZONING, ALL WITH SINGLE FAMILY DWELLINGS.

UH, THE PROPERTY HAS NOT HAD ANY PREVIOUS CONDITIONAL USE PERMITS ISSUED FOR USES IN THE AGRICULTURAL ZONING DISTRICT.

THE DWELLING WAS CONSTRUCTED IN 1995 AND NO ZONING VIOLATIONS HAVE BEEN RECORDED FOR THE PROPERTY.

UM, THERE IS A HEALTH DEPARTMENT OPERATION PERMIT ON FILE APPROVING SIX OCCUPANTS FOR THE DWELLING.

UM, AND LIKE I SAID BEFORE THERE, IT'S NOT LOCATED IN A SUBDIVISION SO THERE'S NO HOA OR POA.

UH, AND THE DWELLING DOES MEET THE SETBACK REQUIREMENT TO ADJACENT SINGLE FAMILY DWELLINGS WITH THE CLOSEST DWELLING 313 FEET TO THE NORTH.

IT IS AGAIN, THE STANDARD RECOMMENDED CONDITIONS WITH CONDITION NUMBER TWO.

THE MAXIMUM NUMBER OF OCCUPANTS SHALL NOT EXCEED SIX AS DETERMINED ACCORDING TO THE HEALTH DEPARTMENT OPERATION PERMIT FOR A THREE BEDROOM DWELLING.

THIS PUBLIC HEARING HAS BEEN PROPERLY ADVERTISED.

ADJACENT PROPERTY OWNERS HAVE BEEN NOTIFIED.

THE APPLICANT, AS YOU KNOW, IS HERE TONIGHT IF YOU HAVE ANY QUESTIONS.

THANK YOU.

WOULD YOU LIKE TO SPEAK AT THIS TIME ON THIS ONE? ONLY TO SAY I APPRECIATE YOUR TIME AGAIN.

OKAY.

PUBLIC HEARING IS OPEN.

I I DO HAVE A QUESTION.

I WAS READING THE ONE LETTER AND I'M CONFUSED.

IT SOUNDS AS IF HE'S SAYING THAT HE OWNS LONE SOME FLATS ROAD.

IS THERE A A A EASEMENT RIGHT AWAY HERE? UM, SO I BELIEVE THAT LONE SOME FLATS ROAD IS A PRIVATE ACCESS EASEMENT.

YES IT IS.

RIGHT.

UM, BUT IT WOULD BE USED TO ACCESS THIS PROPERTY.

OKAY.

I JUST WANTED TO MAKE SURE THAT, BECAUSE HE DOESN'T SAY THAT, HE JUST SAYS I OWN THE ROAD, SO I WANTED TO MAKE SURE THAT THERE WAS AN OFFICIAL RIGHT OF WAY THERE.

OKAY, THANK YOU.

OKAY.

I I UNDERSTAND THAT AND I READ IT TOO AND I'VE GOT IT WRITTEN DOWN.

UM, HE GAVE THE ORIGINAL PEOPLE THE, THE AUTHORIZATION TO USE HIS PRIVATE ROAD THROUGH THE EASEMENT, CORRECT? YES.

AS FAR AS I'M AWARE.

OKAY.

WE'RE GONNA HAVE N NEW PEOPLE COMING IN EVERY WEEK, EVERY TWO WEEKS, EVERY MONTH.

ARE THESE PEOPLE THE SAME PERSON? AND SHOULD WE NOT ASK OF THAT LANDOWNER THAT OWNS THAT PRIVATE ROAD TO GIVE HIM THE ABILITY TO GET SOMETHING IN WRITING FROM THEM THAT SAYS THEY CAN USE THAT ROAD TOO, OTHERWISE HE NEVER KNOWS WHO'S RUNNING UP DOWN HIS ROAD? I DON'T KNOW IF I'M BEING STICKY ABOUT THAT OR NOT.

NO, YOU'RE NOT.

I THINK BECAUSE IT IS A PRIVATE ROAD AND THERE'S ONLY THREE HOUSES ON THAT ROAD.

RIGHT.

I'M, I'M, THAT'S WHY I'M ASKING IF THERE IS AN OFFICIAL, BECAUSE EASEMENTS TRANSFER WITH PROPERTY.

IF, IF I AND CAITLYN'S NOT SITTING THERE, UM, SHOULD BE RIGHT BACK.

I'M PRETTY SURE THEY, THEY TRANSFER WITH OWNERSHIP.

YEAH.

EAS THE EASEMENT ITSELF IS REALLY JUST THAT IT'S DEFINED AS AN ACCESS EASEMENT.

IT GOES OVER THE ROAD, OVER THE PROPERTY LITERALLY VERSUS A RIGHT OF WAY, WHICH IS REALLY KIND OF A SEPARATE ENTITY UNTO ITSELF.

UM, SO THE EASEMENT WAS GRANTED, THE, THE PARCEL WOULD NOT HAVE BEEN APPROVED HAD IT NOT HAD ACCESS EASEMENT.

THE EASEMENT DOESN'T DEFINE WHO CAN DO IT.

IT JUST DEFINES BASICALLY WHAT IT IS.

IT'S AN ACCESS EASEMENT TO THAT PROPERTY.

COULD YOU IMAGINE

[02:30:01]

ALL THE PROPERTIES THAT TRANSFER OWNERSHIP AND ALL THE EASEMENTS THAT PROVIDE ACCESS TO THOSE PROPERTIES, HAVING TO HAVE A SPECIFIC PERSON THAT THEN WOULD HAVE TO TRANSFER THE NEXT TIME THE PROPERTY SOLD AND THEN, I MEAN, IT WOULD HAVE TO BE SOMETHING WITHIN THE TITLE.

OKAY.

SO WE LOOK AT IT AS ACCESS EASEMENT.

DOES THE PROPERTY HAVE AN ACCESS TO IT WHEN THE SUBDIVISION TAKES PLACE? IN THIS PARTICULAR CASE, THE EASEMENT IS DEFINED AS AN ACCESS EASEMENT NO MORE, NO LESS.

AND SO WHOMEVER OWNS THAT PROPERTY FOR ALL INTENSIVE PURPOSES GIVES THAT PERSON THAT IS USING THAT EASEMENT AUTHORITY TO USE THAT EVEN THOUGH IT GOES OVER SOMEBODY ELSE'S PROPERTY.

THAT EASEMENT WAS DEFINED.

NOW THAT'S ALL I CAN SAY LEGALLY.

I MEAN MAYBE WE NEED A INTERPRETATION FROM OUR, UH, OUR UH RIGHT.

BECAUSE WHAT YOU JUST DESCRIBED WOULD BE THE OWNER OF THE PROPERTY, BUT NOW THIS IS A SHORT TERM RENTAL.

SO THE PEOPLE WHO WILL BE USING THIS PRICE, THIS EASEMENT IS NOT GONNA BE THE PROPERTY OWNER.

THEY'RE GOING TO BE OTHER FOLKS WHO YEAH, BUT BUT THE PERSON I'M SAYING GIVING THEM AUTHORITY AS THE OWNER WHO OWNS THE HOME.

OKAY.

THAT'S THE SHORT TERM PROPERTY CUZ THEY'VE BEEN GRANTED AUTHORITY THROUGH THE TRANSFER OF OWNERS.

OKAY.

SHIP TO THEM.

SO, UH, IN ANY CASE, UH, YEAH, WE, WE GET MORE CALLS ON EASEMENTS.

I THINK THAT ANYTHING ELSE? AND, AND RIGHT AWAY KINDA YEAH.

, SO THEY WANNA ASK ABOUT IT.

RIGHT.

SO, UH, NOW WE NEED CLARIFICATION ON THE, WHETHER, UM, THIS EASEMENT ALLOWS THEM TO ALLOW THEIR RENTERS TO CROSS WITHOUT PERMISSION OF THE PERSON WHO ACTUALLY OWNS THE, THE PROPERTY.

I APOLOGIZE.

IS THE EASEMENT, IS THE EASEMENT, IS THE PAPERWORK IN THE PACKET REGARDING THE EASEMENT? BECAUSE THE ONLY WAY WE WOULD KNOW THAT FOR SURE IS TO ACTUALLY SEE THE LANGUAGE OF, OF THE ACTUAL EASEMENT DEED, WHATEVER IT IS.

UM, DO WE HAVE THAT MATT? UM, I'M NOT SURE IF IT'S, IT'S NOT IN THIS BACK STATED WITH THE, I'M NOT A LAWYER, BUT I, I LIVE ON A PRIVATE ROAD AND MY UNDERSTANDING IS, IS THAT IF YOU GRANT AN EASEMENT, IT'S TO THE PROPERTY OWNER IN THE GUEST.

SO YOU DON'T HAVE TO HAVE PERMISSION OF AN INDIVIDUAL OF, OF THE PERSON WHO GRANTED THE EASEMENT.

SO YOU COULD ACCESS YOUR PROPERTY IN ORDER TO BRING YOUR GUEST OR YOUR RELATIVES IN.

I I WOULD AGREE MOST CASES THAT IF YOU'RE THE, IF YOU HAVE THE EASEMENT, THEN IT'S, IT SHOULDN'T RESTRICT WHO CAN CROSS THE EASEMENT.

BUT WITHOUT SEEING THE ACTUAL PAPERWORK, I CAN'T TELL YOU DEFINITELY THAT THAT IS THE CASE.

BUT JUST FOR MY EXPERIENCE WITH THINGS THAT I'VE BEEN INVOLVED WITH, THERE'S A LOT OF, YOU KNOW, DIFFERENT LANGUAGE THAT YOU WOULD NOT EXPECT TO SEE IN DEEDS AND THINGS LIKE THAT.

SO, UM, I MEAN, I I WOULD SUSPECT THERE NOT BE ANY TYPE OF RESTRICTIONS.

YEAH.

BUT AGAIN, WITHOUT ACTUALLY LOOKING AT IT, I CAN'T TELL YOU FOR SURE.

ABSOLUTELY.

THAT WOULD BE MY, MY THOUGHT AS WELL.

BUT IF IT DOESN'T SAY THAT, THE FIRST THING THAT'S GONNA HAPPEN IS THIS GENTLEMAN IS GONNA TRY TO STOP IT AND WE DON'T WANT THAT.

YOU COULD APPROVE THIS SUBJECT TO CONFIRMATION OF THE EASEMENT.

I WAS GONNA ASK THAT QUESTION.

YES.

OKAY.

I I HAVE A QUESTION BEFORE WE DO, IF I COULD ASK THE HOMEOWNER, ARE YOU, YOU'VE GOT, IT LOOKS LIKE TWO DWELLINGS HERE.

YOU'RE LIVING IN ONE AND YOU'RE GONNA RENT THE ONE OUT NEXT TO YOU.

IS THAT CORRECT? COME ON.

WOULD YOU LIKE ME TO COME OUT PLEASE? YES, PLEASE.

I THINK IT'S CONJOINED IT LOOKS LIKE, RIGHT? YEAH, THERE'S, THERE'S A BIT OF A MATT WILLIAMS, UM, ONE 15 LOANS AND FLATS NICELY.

UM, THERE'S A LITTLE BIT OF I THINK CONFUSION STEM BY THE WAY IT WAS WORDED HERE.

IT IS ONE PROPERTY.

THE ORIGINAL CABIN ACTUALLY DATES BACK TO FRONT ROYALS FOUNDING AND WE CAN TRACE RECORDS ON THE PROPERTY, UM, TO THE LATE 1780S.

IT'S BEEN RESTORED SEVERAL TIMES.

UM, IT IS NOW THE BACK OF THE CABIN IS ACTUALLY OUR GREAT ROOM.

THE EXTERIOR OF THAT IS AN INTERIOR WALL OF THE HOUSE.

AND SO IT'S BEEN INTO, INTEGRATED INTO THE REST OF THE PROPERTY AND THE REST OF THE BEDROOMS AND DESCRIPTION OF THE PROPERTY ARE PRIMARILY ON THE HOUSE THAT WAS BUILT IN 1995

[02:35:01]

ADJOIN INTO IT.

OKAY.

SO THAT'S HOW IT'S SET UP.

WE WOULD NOT INTEND THIS IS ALL ONE PROPERTY, CORRECT? CORRECT.

OKAY, SO YOU'RE NOT JUST RENT THIS PART.

THAT IS CORRECT.

IT WOULD BE THE ENTIRE PROPERTY.

THAT WAS MY OKAY.

THANK YOU FOR THAT CLARIFICATION.

YEAH.

AND APOLOGIES FOR ANY CLARIFI.

UH, THAT'S ALRIGHT.

USED WITH THAT .

HAPPY DO DRESSING YOUR QUESTION.

I KNOW THAT PROPERTY WELL, , IT'S BEAUTIFUL.

BEAUTIFUL.

IT'S BEAUTIFUL.

I WILL SAY IT'S BEAUTIFUL.

OKAY, ANY OTHER QUESTIONS, UH, FROM THE BOARD AT THIS TIME, IF NOT MRS. SHROCK, DID ANYONE SIGN UP FOR THIS ONE? WOULD ANYONE LIKE TO SPEAK ON THIS ONE SECOND CALL? THIRD AND FINAL CALL PUBLIC HEARING IS CLOSED.

IS THERE ANY OTHER DISCUSSION? SO HOW DO WE ADD THE SUBJECT TO THAT WAS MY, WE APPROVE THIS.

HOW WOULD WE WORD THAT MRS. JORDAN CONTINGENT ON THE RIGHT OF WAY? IS IT TO MAKE ANOTHER COMMENTS OR THAT THOSE, UM, IF, IF YOU HAVE SOMETHING THAT YOU THINK WOULD BEAR IN ON OUR HOW WE'RE DOING THIS MOTION.

YES.

OR GO AHEAD, YOU CAN OPEN IT BACK UP.

WHEN WE PURCHASED THE PROPERTY AND WE HAD ALL THE INITIAL DOCUMENTS THAT WERE GIVEN TO US, WE ACTUALLY LATER, AFTER GOING UNDER CONTRACT RECEIVED KIND OF AN ADDENDUM TO IT THAT ESSENTIALLY SAID THAT NO ROAD MAINTENANCE AGREEMENT EXISTED FOR LONE AND FLATS.

IT WAS ACTUALLY OUR IGNORANCE AT THE TIME, NOT KNOWING THAT IT WAS A PRIVATE ROAD OWNED BY ANOTHER INDIVIDUAL.

UM, TO OUR KNOWLEDGE AND RESEARCH, WE CANNOT FIND ANY DOCUMENTATION THAT IS INCLUDED IN ANY OF THE RECORDS OR DEEDS ON LANGUAGE AROUND THE EASEMENT.

UM, SO WE'RE NOT SURE, YOU KNOW, IF THAT EXISTS OR WHERE IT IS.

BUT WE'VE DONE AT LEAST KIND OF LIGHT RESEARCH IN ALL OF THE DOCUMENTS IN THE FORMER OWNER WHO I TEXT WITH, UH, REGULARLY.

UM, I'VE ASKED HIM ABOUT IT AS WELL.

UM, AND HE HAD PURCHASED THE HOUSE IN 2004, I BELIEVE.

UM, HE DIDN'T HAVE ANY KNOWLEDGE OF THAT AS WELL, UM, BUT DID HAVE OTHER EXTENSIVE KNOWLEDGE OF THE PROPERTY.

SO IT'S A LITTLE BIT OF A BLACK BOX FOR US, UM, AS WELL IN TERMS OF THAT.

SO I JUST WANTED TO MAKE THAT NOTE THAT IT WAS, THERE WAS EXPLICITLY NOTHING I READ THROUGH EVERY SINGLE DOCUMENT, UM, YOU KNOW, THAT WE HAD WHEN WE PURCHASED THE PROPERTY.

OKAY, THANK YOU.

YES, SIR.

ONE QUICK QUESTION FOR JUST BEING STRAIGHT UP ON THIS.

DO YOU HAVE A PROBLEM WITH THIS PERSON? WE DON'T, UH, .

IT'S ACTUALLY A LITTLE BIT OF A, A FUNNY STORY.

WE ACTUALLY THOUGHT THAT THE, BEFORE WE READ THE LETTER, WE ACTUALLY THOUGHT IT WAS A DIFFERENT NEIGHBOR THAT HAD SUBMITTED A LETTER, UM, WHEN WE ACTUALLY WENT AND SPOKE TO THAT NEIGHBOR WHO IS DIRECTLY ADJACENT TO US AND, UH, HAD AN ENTIRE CONVERSATION WITH NEITHER OF US KNOWING THAT HE ACTUALLY WASN'T THE ONE WHO WROTE THE LETTER.

AND I DON'T KNOW IF WE EVER EXPLICITLY SAID ANYTHING ABOUT THE LETTER, UM, BUT WE THOUGHT WE HAD, YOU KNOW, ASSUAGED, UM, YOU KNOW, THOSE CONCERNS WITH THE NEIGHBOR WHEN WE SAW THE AGENDA FOR THIS.

UM, WHICH ADMITTEDLY WASN'T UNTIL A FEW DAYS AGO WE REALIZED THAT IT WAS NOT THE SAME PERSON.

UM, AND I WISH WE WOULD'VE DISCOVERED THAT SOONER.

IS THAT ABSOLUTELY WOULD'VE REACHED OUT, PROVIDED ALL OF MY CONTACT INFORMATION AND TO THE BEST OF MY ABILITY, UH, TALKED TO HIM ABOUT HIS CONCERNS AND A NUMBER OF THE OTHER CONCERNS THAT WERE IN THE DOCUMENT.

OBVIOUSLY WE CAN'T, YOU KNOW, NECESSARILY, UH, OBJECT AGAINST THE, HIS CONCERNS ABOUT HOUSING IN THE AREA AND I UNDERSTAND THAT.

BUT, YOU KNOW, OUR RENTERS, IF THERE WERE EVER SHOOTING OR ATVS ON THE PROPERTY AND WE ARE LOCAL, WE WOULD IMMEDIATELY, YOU KNOW, EVICT UM, RENTERS FOR THAT.

UM, WE ALSO HAVE TAKEN OTHER STEPS THAT WE TALKED TO ALL OF THE OTHER NEIGHBORS ABOUT, WE JUST, THIS ONE UNFORTUNATELY KIND OF WASN'T ON OUR RADAR BECAUSE OF OUR KIND OF NOT UNDERSTANDING THAT LONE AND FLATS WAS ACTUALLY PART OF THAT.

WE WERE IGNORANT OF THAT UNTIL A FEW DAYS AGO AS WELL.

BUT WE'VE INSTALLED NOISE MONITORING DEVICES SO IF, YOU KNOW THERE'S NOISE OVER 70 DECIBELS, UM, FOR ANY PERIOD OF TIME WE ARE IMMEDIATELY NOTIFIED AND WILL ACT.

SO WE HAVE SPOKEN TO ALL OF OUR NEIGHBORS AND ABSOLUTELY INTEND AS SOON AS POSSIBLE TO SPEAK WITH HIM.

UM, HOPEFULLY TO COME TO, YOU KNOW, UH, TO DISSUADE, YOU KNOW, HIS CONCERNS.

UM, BUT YOU KNOW, I, THAT'S, THAT'S KIND OF WHAT I UNDERSTAND.

I DON'T KNOW THE LEGAL THINGS AROUND, YOU KNOW, THE I DON'T EITHER.

THAT'S UP TO THEM.

YEAH.

SO, OKAY.

ISN'T IT THE NOISE LIMITATION?

[02:40:01]

I THINK IT'S 60, NOT 70.

SO WHY WOULD YOU HAVE TACK IT ON 70? IT'S, I CAN AMEND THE, SO THAT'S ACTUALLY JUST KIND OF THE STANDARD THING WE USE A IN OUR ORDINANCE IS 60.

YES.

SO WE CAN ADJUST IT TO THAT.

AND SO ESSENTIALLY ANY TIME THE, AND YOU CAN ADJUST IT TO ANY LEVEL, I WILL ACTUALLY GO BELOW BECAUSE I WOULDN'T WANNA WAIT UNTIL, YOU KNOW, THERE'S, AND THAT'S AN INSIDE, UM, NOISE MONITORING.

UM, SO IF IT EVER IS OVER A CERTAIN LEVEL FOR A PERIOD OF TIME, WE WOULD IMMEDIATELY BE NOTIFIED, UH, AND WOULD TAKE ACTION.

MM-HMM.

.

UM, AND THAT WAS ONE OF THE THINGS, YOU KNOW, WE'VE DISCUSSED WITH THE REST OF THE NEIGHBORS, UM, WHO POTENTIALLY HAD A CONCERN.

OKAY.

OKAY.

THANK YOU.

SO MRS. JORDAN, HOW DO WE AMEND THIS MOTION? UM, I AM WORKING ON THAT RIGHT NOW.

IF YOU'LL KNOW FOR JUST ONE SECOND.

CAN I JUST BRING, SO TO NOTE HERE IN HIS DEED, WHICH WE HAVE HERE, UM, IT DOES CITE THE PLAT FOR THE DIVISION OF LAND OF TYSON, A ROAMER IN THE FORK DISTRICT DATED MAY 14TH, 2003, RECORDED AS INSTRUMENT NUMBER OH 3 0 71 67.

UM, WE CAN LOOK THAT UP.

UM, AND IN MOST PLAS, IF IT'S AN APPROVED PLAT BY THE COUNTY, WE'LL WE'LL WANT SEE THAT ACCESS EASEMENT WHEN THAT PLAT, SO THAT WOULD SHOW THAT ACCESS EASEMENT AND MAYBE LANGUAGE, UH, ON THE EASEMENT ITSELF.

BUT AGAIN, IT WOULD BE A LITTLE BIT OF TITLE WORK THAT WOULD NEED TO BE DONE.

SO, UM, IT DOES MENTION IN HERE THE CONVEYANCE IS EXPRESSLY SUBJECT TO THE EASEMENTS CONDITIONS AND RESTRICTIONS AND RESERVATIONS CONTAINED INTO DUALLY RECORDED DEEDS, PLATS AND INSTRUMENTS.

SO, UM, KIND SOME OF THAT STANDARD LANGUAGE THAT YOU GET.

AND THEY MADE A MISTAKE CUZ THEY REFERENCED RAHAN COUNTY .

IT MIGHT NEED TO BE FIXED.

, CAN I SPEAK TO THIS NOISE THING? SO GOOGLE TELLS ME THAT SPEAKING IS BETWEEN 55 AND 65.

UM, I'M GONNA BE HONEST WITH YOU, I HAVE A HEARING ISSUE SO MY TELEVISION'S PROBABLY LOUDER THAN 65 CUZ MY FAMILY'S ALWAYS COMPLAINING ABOUT IT.

BUT ANYWAY, THAT, I JUST WANTED TO CLARIFY.

SO I DON'T KNOW WHY OUR CODE IS 60 YEP.

IF A NORMAL SPEAKING VOICE BETWEEN 55 AND 65.

YEAH, WE'VE WE'VE SEEN THAT SEVERAL, SEVERAL TIMES.

I DON'T KNOW IF YOU REMEMBER THE SHOOTING RANGE.

YEAH, WELL WE DID THAT AT THE SHOOTING RANGE, BUT A NORMAL, LIKE YOU AND I TALKING RIGHT NOW, I MEAN IT'S PROBABLY A MICROPHONE IS LOUDER.

IT IS.

WELL WE'RE WE'RE LOOKING INTO THAT RIGHT NOW.

YEAH.

IT'S CONVERSATIONAL NOISE, WHAT IT'S SUPPOSED TO.

YEAH.

WE'RE LOOKING INTO TRYING TO MAKE SOME TYPE OF REVISION TO THIS, TO THE ORDINANCE, BUT THE WAY, UH, THE WAY THAT THEY'VE MEASURED THE, THE, THE NOISE LEVELS AND DECIBELS, IT'S, IT'S NOT A, DOESN'T GO UP STRAIGHT LINE.

IT'S KINDA LIKE A EXPONENTIAL CURVE.

YEAH, IT'S A CURVE.

YEAH.

WE MEASURE IT AT THE PROPERTY LINE ALSO.

SO IT'S, THE CHALLENGE IS, IS TO HAVE, UH, A I WOULD, I'LL SAY A, A PRIVATE, EXCUSE ME, A UM, DECIMETER, UH, DECAL METER THAT HAS BEEN CALIBRATED CORRECTLY AND MEETS ALL THE REQUIREMENTS BECAUSE IF YOU DO TAKE IN THE COURT, THAT IS SOMETHING THAT WILL COME UPS.

SO, UM, IT'S A LITTLE MORE COMPLICATED THAN THAT.

IT'S A LITTLE MORE COMPLICATED.

WE'VE, WE'VE, WE'VE, WE'VE USED THIS DURING, UH, IN THE PAST WITH ISSUES WITH KENNELS.

I'VE HAD TO GO OUT AND DO THE DECAL METER AND THE FARTHER AWAY THE NOISE, THE, THE, OBVIOUSLY THE, THE LOWER THE READINGS.

SO I MOVE S YEAH.

PEOPLE AND STAFF.

I DON'T KNOW, SOMETIMES I THINK PEOPLE REGULATE STUFF.

, DO YOU WANNA READ THE MOTION? I'LL, OKAY.

YEAH, YOU NEED TO READ WHAT'S ON OUR MOTION SHEET AND THEN OH MY GOODNESS.

ALL RIGHT.

IT'S A BOOK.

IT'S A BOOK.

.

OKAY, NOW EVERYONE'S GONNA LAUGH BECAUSE I HAVE TO GO UP TO THE, TO THE HEADER PAGE.

HERE WE GO.

I KNOW.

CHERYL'S GIGGLING OVER THERE.

NOPE.

DOESN'T EVEN ALL ABOUT TIME, DREW.

ALRIGHTY.

LET'S SEE.

SO WE'RE DOING, UM, CPU

[02:45:01]

OH 7 0 6 OR IS IT OH 7 0 5 0 7 0 6.

IT'S OH 7 0 6.

OKAY.

VERY GOOD.

OH 7 0 6.

ALL RIGHT.

SO I'M GONNA SAY I MOVE THAT THE BOARD OF SUPERVISORS APPROVE THE CONDITIONAL USE PERMIT REQUEST OF MATTHEW WILLIAMS AND JAY GILBERT FOR A SHORT TERM TOURIST REYNOLD WITH THE CONDITIONS THAT RECOMMENDED BY THE PLANNING COMMISSION AND STAFF.

AND SUBJECT TO CONFIRMATION FROM THE COUNTY ATTORNEY'S OFFICE THAT NEITHER AN EASEMENT NOR RIGHT AWAY WOULD PROHIBIT OR PRECLUDE GUESTS FROM USING LONE SIM FLATS.

ROAD START.

CUT.

ROLL CALL MRS. SHIRAI.

MR. MABE.

HI MRS. COOK.

HI MADAM CHAIR.

AYE.

MRS. OATS? AYE.

MR. BUTLER? AYE.

THERE WE GO.

ANY QUESTIONS FROM THE BOARD? I GOTTA ASK? IT SAYS HERE, YOU LIVE IN SPOKANE, WASHINGTON.

I DO LIVE IN SPOKANE, WASHINGTON.

I WAS GONNA CORRECT YOU ON THAT.

OH, IF YOU COULD COME UP.

I'M SORRY.

OKAY.

MRS. ROCKY IS GOING IN AND WINCHESTER, I'M NEXT.

BONETTE, , SORRY, I APOLOGIZE.

NAME'S THOMAS PIGEON.

FIVE 40 LAKESIDE DRIVE.

I DO LIVE IN SPOKANE, WASHINGTON.

NOT WINCHESTER, BUT I JUST HEARD YOU SAY THAT.

I DIDN'T KNOW WHEN THE RIGHT TIME WAS.

I I SHOOT YOU AN EMAIL OR CALL YOU AND LET YOU KNOW THAT'S NOT MY ADDRESS.

FOR SOME REASON WITH THE COUNTY TOO, THEY ACTUALLY PUT MY PARENT ADDRESS IN MINNESOTA FOR THE COUNTY DEED.

AND I HAVE THAT FIXED MY ADDRESS IN SPOKANE.

SO I'M NOT QUITE SURE THE ADDRESS.

WE KNOW WHERE YOU WERE.

YEAH.

OKAY.

SO I'M HERE.

I, I GUESS MY, MY WONDER IS IF YOU'RE IN SPOKANE, WHY DO YOU WANT A HOUSE HERE? THAT SEEMS LIKE AN AWFUL LONG WAY TO SPEND THE WEEKEND.

WHAT I UM, I ACTUALLY CAME OUT HERE FOR LIKE A WORK TRIP NOT TOO LONG AGO IN THE AREA AND TOOK A DRIVE OUT HERE AND ENJOYED THE NATIONAL PARK AND ALL THE SENIORITY OUT HERE AND JUST KIND OF, UH, WANTED

[02:50:01]

TO COME OUT HERE AND ENJOYED THE PLACE.

I GREW UP IN MINNESOTA, YOU KNOW, WITH THE, THE FALL COLORS AND KIND OF MORE THAT, LIKE, THAT BIT OF A BOT VIBE.

AND I JUST KIND OF FOUND THIS PLACE AND WANTED, SPEND MORE TIME ON HERE AND OWN A PROPERTY OUT HERE.

SO THAT'S WHAT MY WIFE AND I DID.

AND THEN WE, UM, HIRED A LOCAL, WE'RE GONNA HIRE A LOCAL PROPERTY MANAGER IF, UM, YOU GUYS PROVE US AND THEY'LL HANDLE ALL THAT.

UM, BOOTS ON THE GROUND, YOU KNOW.

UM, OKAY.

YEAH, THOSE ITEMS. OKAY.

THANK YOU.

MAY I ASK A QUESTION? YES.

DO YOU HAVE A PROPERTY MANAGER LOCAL YET? I DO.

IT'S THE, UH, SHENANDOAH PROPERTY MAINTENANCE.

THEY CALL THEMSELVES LIKE PROPERTY MAINTENANCE, BUT THEY'LL BE HANDLING LIKE, UM, THEY'RE LIKE A 24 7 CALL.

SO THEY HAVE LIKE TWO PHONE NUMBERS, ONE'S DIRECTLY TO THE OWNER OF THE COMPANY.

AND THEN ONCE THEY'RE LIKE 24 7, LIKE EMERGENCY NUMBERS.

SO IF THERE'S LIKE ANY PROBLEMS WITH GAS, LIKE I'M GONNA GIVE IN MY PROPERTY, UM, MAINTENANCE PLAN, I'M GONNA GIVE THAT TO MY NEIGHBORS.

THEY CAN CALL THAT NUMBER AND THEY'LL COME OUT AND DEAL WITH THE PROBLEM IMMEDIATELY.

IF, YOU KNOW THE SHERIFF DEPARTMENT OR SOMEONE DID GET CALLED, THEY'LL BE THE LOCAL POINT OF CONTACT TO DEAL WITH THAT.

SO LIKE, THEY'RE THE PROPERTY MANAGER FOR THE PROPERTY AND I'LL JUST HANDLE LIKE THE AIRBNB, YOU KNOW, COMPUTER CLICKING AND GUEST INTERACTION THROUGH THAT, THAT INTERFACE.

ANY OTHER QUESTIONS? AND THE QUESTION OF THE NIGHT? HAS ANYONE ELSE SIGNED UP FOR THIS? MRS. SHROCK? OKAY.

WOULD ANYONE LIKE TO SPEAK ON THIS AT THIS TIME? SECOND CALL.

THIRD CALL.

PUBLIC HEARING IS CLOSED.

THANK YOU.

IS ANY QUESTIONS DISCUSSION? IF NOT, IS THERE A MOTION? ADAM? CHAIR, I MOVE.

THE BOARD OF SUPERVISORS APPROVED THE CONDITIONAL USE PERMIT, UH, REQUEST OF THOMAS L PIGEON OR A SHORT TERM TOURIST RENTAL WITH THE CONDITIONS AS RECOMMENDED BY THE PLANNING COMMISSION AND STAFF START ROLL CALL MRS. SHIRAKI.

MR. BUTLER? I, MRS. OATS, I MADAM CHAIR THIS ONE.

AND I DON'T LIKE, I DON'T LIKE SAYING NO, BUT I DON'T, I DON'T SEE HOW YOU CAN HAVE A CONNECTION AND IT KIND OF BOTHERS ME THAT WE'RE GETTING PEOPLE, WE, YOU KNOW, WE'VE HEARD TONIGHT PEOPLE THAT DON'T LIKE IT, THAT SOMEONE THAT'S LIVES OUTSIDE THE COUNTY DOING THIS, SOMEONE OUTSIDE THE STATE.

I, I JUST FEEL LIKE THERE NEEDS TO BE A PERSONAL OWNERSHIP AND I DON'T FEEL LIKE HOW YOU CAN DO THAT.

SO I'M A NO SORRY, MRS. COOK, I, MR. MABE, I MOTION PASSES AND THAT'S THE END OF OUR PUBLIC HEARINGS.

IF THERE'S NO FURTHER BUSINESS, IS THERE A MOTION TO ADJOURN? SO MOVE.

MOTION CHAIR.

SECOND.

SECOND.

ALL IS IN FAVOR? AYE.

MEETING ADJOURN.

THANK YOU EVERYONE.
