THANK

[A. Call to Order and Pledge of Allegiance of the United States of America]

YOU.

I'D LIKE TO INVITE EVERYBODY.

I MEAN, WELCOME EVERYBODY.

IT'S BEEN A LONG DAY ALREADY, UM, TO THE APRIL 20TH, 20, 21 MEETING OF THE BOARD OF SUPERVISORS.

AND AT THIS TIME I CALLED THE MEETING TO ORDER AND WE'LL START WITH THE PLEDGE OF ALLEGIANCE, PLEASE, FOR WHICH IT STANDS ONE NATION UNDER GOD, INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL.

OKAY.

THANK YOU VERY MUCH.

[B. Adoption of Agenda – Additions or Deletions]

AT THIS TIME, WE'LL HAVE THE ADOPTION OF THE AGENDA OR THE, ANY, ANY ADDITIONS OR DELETIONS MADAM CHAIR I'D LIKE TO REMOVE ON THE CONSENT AGENDA ITEM, NUMBER ONE, UH, THE ADDITIONAL APPROPRIATION REQUEST, UM, AFTER THE WORK SESSION THAT WE HAD LAST WEEK AND UPON FURTHER INVESTIGATION, THAT AMOUNT HAD ALREADY BEEN APPROPRIATED IN THE SCHOOL'S BUDGET LAST YEAR.

SO IT NO LONGER REQUIRES A FORMAL APPROPRIATION.

IS THAT CORRECT? DR.

DALEY? YES, MA'AM.

THEY HAD REDUCED THAT WAS THE ORIGINAL APPROPRIATION LAST YEAR.

AND WHEN THEY REDUCED THEIR BUDGET BECAUSE OF SOME STATE FUNDING, THEY, WE DID NOT REDUCE THE BUDGET.

SO OUR BUDGET WAS STILL AT THE ORIGINAL AMOUNT.

OKAY.

AND ON ITEM NUMBER TWO, UM, AND YOU HAVE A COPY OF THE REASON REVISED INFORMATION ON THE APPROVAL OF LICENSE AND SERVICE AGREEMENT WITH LAKEFRONT RURAL PROPERTY OWNERS.

THERE'S A FINALIZED AMOUNT THAT HAS BEEN GIVEN TO YOU OF $15,570 THAT WAS MISSING AS WELL AS THE DATE OF PAYMENT, WHICH IS DECEMBER 31ST.

AND THAT'S BEEN ADDED.

SO WITH THAT, DO I HAVE A MOTION TO ACCEPT THE AGENDA AS AMENDED? I'LL MAKE THE MOTION.

IS THERE A SECOND, SECOND ROLL CALL, MRS. SHAHRAKI MR. FOX.

MR. MADE MADAM CHAIR.

I MRS. OATES.

OKAY.

[C. Presentation – Health and Dental Insurance Rates for FY 2020-2021 – Ed White]

PRESENTATION OF HEALTH AND DENTAL INSURANCE RATE FOR THE YEAR 2020.

SHOULD THAT HAVE BEEN 2021? 22? YES.

MADAM CHAIR.

THAT WAS MY FAULT.

OKAY.

UM, I MEANT TO ASK THAT EARLIER.

I'M SORRY.

UM, MR. WHITE, THANK YOU.

MADAM CHAIRMAN AND BOARD MEMBERS.

UM, MY NAME IS ED WHITE.

I'VE IT'S, IT'S ONLY BEEN PROBABLY FOUR MONTHS SINCE I LASTED UP HERE.

UM, WE, I WORK FOR MCGRIFF INSURANCE SERVICES AND WE HELP COUNTIES AND SCHOOL SYSTEMS NAVIGATE THE PROCESS OF LOOKING AT HEALTH INSURANCE OPTIONS.

AND THE REASON I WAS HERE ABOUT FIVE MONTHS AGO WAS WARREN COUNTY SCHOOL BOARD, UM, KIND OF THROUGH THE PROCESS.

AND MANY OF YOU PROBABLY READ IN THE PAPERS BACK IN FOURTH QUARTER OF LAST YEAR, ANTHEM WAS HAVING TROUBLE WITH THEIR HOSPITAL NEGOTIATION AND A LOT OF THE SCHOOL SYSTEMS AND COUNTIES AT THAT POINT, DECIDED WE'VE GOT TO HAVE A BACKUP PLAN, WENT OUT TO BID AND ULTIMATELY THE SCHOOL SYSTEM LEFT BLUE CROSS AS WELL AS MANY OTHER SYSTEMS, SHENDRO COUNTY, SHANNON COUNTY SCHOOLS, CITY WINCHESTER.

UM, BUT IT JUST WAS FORTUITOUS THAT THE COUNTY WARREN COUNTY WAS GOING TO BE DOING AN RFP THIS YEAR.

ANYWAYS, IT WAS EVERY FOUR OR FIVE YEARS THAT YOU ALL DO ONE.

SO THE TIMING WAS RIGHT.

YOU CERTAINLY DIDN'T DIDN'T NEED TO DO ANYTHING BACK IN JANUARY, FEBRUARY.

SO THAT BROUGHT US TO THE, TO WHERE WE ARE TODAY, WHICH WAS WE WITH THE HELP OF DR.

DALEY AND KI AND JODY, WE PULLED TOGETHER AN RFP, PUT IT ON THE STREET FOR, FOR MEDICAL OPTIONS, DENTAL OPTIONS, ENVISION OPTIONS.

AND TO GIVE YOU A LITTLE BIT OF SOME, SOME BACKGROUND ON WHAT THE COUNTY HAS TODAY, YOU'RE COVERED THROUGH, WHAT'S CALLED THE LOCAL CHOICE, WHICH IS A STATE SET UP PROGRAM.

YOU'RE STILL KIND OF, THE RATES ARE BASED ON YOUR OWN EXPERIENCE, BUT IN A LOT OF RESPECTS, IT IS A SET PACKAGE OF PLANS, A FEW TO CHOOSE FROM.

AND YOU, WITHIN THAT PACKAGE, YOU GET MEDICAL, DENTAL AND VISION IT'S PACKAGED.

SO IF YOU TAKE FAMILY MEDICAL, YOU GET FAMILY DENTAL.

IF YOU TAKE SINGLE MEDICAL, YOU GET SINGLE DENTAL IN A SINGLE VISION.

SO THAT'S WHERE YOU'RE SITTING TODAY.

SO IN THIS PROCESS THAT WE DID IN THE RFP PROCESS, WE OBVIOUSLY ASKED FOR AN APPLES TO APPLES COMPARISON WHEN WE WERE LOOKING AT, AT THE DIFFERENT COMPANIES.

AND HOPEFULLY YOU'VE GOT A COPY OF THIS, BUT ON THE, ON THE PRESENT, ON THE, ON THE SLIDE SHOW, SEVERAL COMPANIES QUOTED, UM, THIS YEAR, WHICH IS, WHICH IS EXCITING.

WE DON'T HAVE A TREMENDOUS NUMBER OF HEALTH INSURANCE OPTIONS IN OUR PART OF THE NORTHERN SHENANDOAH VALLEY.

SO IT'S NICE WHEN WE, WHEN WE DO GET SOME COMPETITION.

SO AGAIN, WE HAD THE LOCAL CHOICE RENEWAL IN HAND, WHICH WAS ABOUT A 2% REDUCTION.

WE GOT QUOTES FROM ANTHEM.

AND WHEN YOU SEE WHOLE PACKAGE, IT MEANS THEY QUOTED THE MEDICAL, THE DENTAL AND THE VISION ANTHEM DIRECT, MEANING NOT THROUGH THE LOCAL CHOICE.

AETNA QUOTED THE WHOLE PACKAGE, CIGNA QUOTED THE WHOLE PACKAGE

[00:05:01]

AND UNITED AS WELL.

ALL OF THOSE COMPANIES, WHEN I SAY THE WHOLE PACKAGE BY, BY QUOTING THE DENTAL AND THE VISION, ALONG WITH THE MEDICAL, THEY ALSO GIVE YOU SOME DISCOUNTS BY PACKAGING IT TOGETHER.

SO WE ALSO GOT INDIVIDUAL QUOTES FOR DENTAL AND VISION FROM AMERITAS, GUARDIAN, DELTA, DENTAL, AND THE STANDARD.

THEY DON'T DO MEDICAL.

SO THEY JUST QUOTED WHAT THEY COULD.

AND THEN A COUPLE OF COMPANIES THAT JUST QUOTED VISION ONLY AS AN OPTION.

SO THROUGH THE PROCESS, WE OBVIOUSLY DID A LOT OF SPREADSHEETING AND HAD MULTIPLE COLUMNS OF DIFFERENT COMPANIES.

AND WE KIND OF WEEDED IT DOWN PRETTY QUICKLY, OR WE'LL WHITTLE IT DOWN PRETTY QUICKLY TO UNITED HEALTHCARE, PRIMARILY BECAUSE THEY OFFERED SUCH A DISCOUNT ON THE MEDICAL RATES BY THEMSELVES, AND THEN A SIGNIFICANT ANOTHER, BASICALLY TWO AND A HALF PERCENT DISCOUNT OFF THE MEDICAL.

IF WE LOOKED AT THEIR DENTAL AND VISION, WHICH ALMOST IN MANY, MANY RESPECTS GAVE US DENTAL AND VISION AT A VERY REDUCED RATE.

SO WHAT WE DIDN'T PUT UP HERE TODAY, AND JUST SO WE DIDN'T, I GUESS HAVE TOO, TOO MANY SLIDES TO GO THROUGH WAS THE SIDE-BY-SIDE COMPARISON OF THE BENEFITS.

SO WHAT YOU BE REST ASSURED OF THE TOP HALF OF THIS SPREADSHEET THAT YOU DON'T SEE HERE IS BASICALLY A LINE ITEM COMPARISON OF DOCTOR COPAYS AND DEDUCTIBLES, AND CO-INSURANCE THE 80 TWENTIES AND THE MAXIMUM OUT-OF-POCKETS AND ALL THE PIECES THAT OBVIOUSLY ARE IMPORTANT WHEN YOU'RE COMPARING APPLES TO APPLES.

AND AT THE SIZE THAT WARREN COUNTY IS ALL THE, ALL THE PLANS, THE CARRIERS THAT QUOTED QUOTED PLANS IDENTICAL, OR WITHIN JUST A FRACTION OF BEING EXACTLY LIKE THE PLANS THAT EMPLOYEES HAVE TODAY.

OKAY.

SO WITHOUT GOING THROUGH ALL THAT, WE FIGURED WE'D KIND OF FOCUS MORE ON THE COST PIECE OF IT, BUT HAPPY TO ANSWER QUESTIONS RELATED TO ANY OF THE ASPECTS OF THE BENEFITS THEMSELVES.

SO IF YOU LOOK AT THIS SPREADSHEET ON THE LEFT HAND SIDE, YOU'VE GOT YOUR CURRENT PLAN TODAY WITH THE LOCAL CHOICES HAS ANTHEM BLUE CROSS BLUE SHIELD ENROLLMENT.

WELL, THAT'S NICE FOR ENROLLMENT.

AND IF YOU'VE GOT TWO PLANS TODAY THAT THE EMPLOYEES CAN CHOOSE FROM A $250 DEDUCTIBLE AND A THOUSAND DOLLARS DEDUCTIBLE.

AND OBVIOUSLY YOU'VE GOT, YOU CAN SEE THE BULK OF YOUR EMPLOYEES ARE IN THAT THOUSAND DOLLAR DEDUCTIBLE PLAN BENEATH THAT ARE THE RATES, THE PLANS KEY ADVANTAGE TWO 50 KEY ADVANTAGE 1000.

THAT'S JUST THE NAME THAT THE LOCAL CHOICE GIVES THE PLANS THAT YOUR EMPLOYEES HAVE ACCESS TO.

UM, AND YOU CAN SEE THE MONTHLY TOTAL, THE ANNUAL TOTAL.

AND IF YOU WORK YOUR WAY DOWN TO THE BOTTOM, YOU CAN SEE THE DIFFERENCE.

THE NEW RATES THAT WE'VE GOT THAT GO INTO EFFECT JULY 1ST WITH THE LOCAL CHOICE ARE ABOUT 63, ALMOST $64,000, LESS THAN THE CURRENT RATES.

SO YOU HAD A GOOD YEAR WITH LOCAL CHOICE.

THEY GAVE YOU A GOOD RENEWAL OVERALL.

UM, SO THE RIGHT TWO COLUMNS ARE THE UNITED HEALTHCARE PLANS.

AGAIN, WE FOCUSED ON THEM.

NOBODY ELSE WAS IN THE BALLPARK AS FAR AS COST GOES COMPARED TO THEM.

AND YOU SAW ON THE PREVIOUS SLIDE WHERE RATES WERE HIGHER AND A COUPLE OF CASES, A COUPLE WERE SLIGHTLY LOWER UNITED WAS VERY COMPETITIVE OVERALL.

SO YOU CAN SEE THE RATES THERE AGAIN FOR SINGLE DUAL AND FAMILY.

BUT IF YOU WORK YOUR WAY DOWN TOWARDS THE BOTTOM, YOU'RE GOING TO START TO SEE SOME PRETTY SIZABLE SAVINGS.

BUT FOR STARTERS, UNITED DOESN'T BUNDLE PRODUCTS, THE WAY THE LOCAL CHOICE DOES.

SO, AS I MENTIONED, WHEN I STARTED, IF YOU TAKE SINGLE MEDICAL WITH LOCAL CHOICE, YOU HAVE, YOU ONLY GET SINGLE DENTAL, YOU CAN'T GET ANYTHING BETTER AND YOU GET THAT DENTAL PLAN, WHETHER YOU WANT IT OR NOT UNITED HEALTHCARE DOESN'T CARE, THEY ALLOW FOLKS TO PICK INDIVIDUALLY.

SO IF YOU WANT SINGLE MEDICAL AND FAMILY DENTAL THAT'S OKAY.

SO WHAT WE TRIED TO DO TO MAKE SURE WE WERE COMPARING APPLES TO APPLES, AS WE PULLED IN THE TOTAL DENTAL COST, BASED ON THE ENROLLMENT TODAY THAT WE KNOW FOLKS HAVE.

SO YOU'LL SEE THAT ADDITIONAL COST ADD DENTAL OF 164,000.

SINCE IT'S IN THE RATES FOR THE LOCAL CHOICE, WE WANTED TO BE FAIR WHEN WE PULLED IT INTO THE COST COMPARISON, SAME THING FOR VISION PULLED THAT RATE IN JUST SO WE HAVE SOME COMPARISON THERE, BUT FOLKS CAN CHOOSE WHAT THEY WANT WITH THOSE TWO COVERAGES.

THEY DON'T HAVE TO MATCH THEIR MEDICAL ENROLLMENT.

OKAY.

OOP, CAN YOU GO BACK, SORRY, BENEATH THAT REAL QUICKLY.

UM, SOME OF THE THINGS THAT UNITED OFFERED WAS BASICALLY SOME DISCOUNTS.

FIRST.

THEY KNOW THAT THERE'S COST IN CHANGING AND THERE'S TIME.

CAUSE IT'S, IT'S THERE'S TIME INVOLVED IN CHANGING FOR THE STAFF.

SO THEY'RE GIVING WARREN COUNTY A QUARTER PERCENT, A QUARTER OFF OF THEIR FIRST MONTH PREMIUM, WHICH IS ABOUT 60,000.

THEY'RE ALSO GIVING A $5 PER EMPLOYEE PER MONTH, BILLING CREDIT, WHICH ACCOUNTS TO ABOUT 16 OR 17,000.

SO IF YOU LOOK AT THE VERY BOTTOM, YOU CAN SEE WE'RE TALKING ABOUT FOR JULY 21, JULY, 2021, A TOTAL COST OF AROUND 29, 2.98 MILLION, WHICH IS ABOUT $346,000, LESS THAN THE COST TODAY, OR ABOUT $282,000, LESS THAN THE RENEWAL RATES THAT WE GOT FROM THE LOCAL CHOICE.

SO SIZABLE COST SAVINGS.

UM, WE ALWAYS GET QUESTIONS ABOUT, WELL, WHAT IS, WHO IS UNITED? HOW IS THEIR NETWORK? THEY'VE GOT A STRONG, PROBABLY 98% OVERLAP.

AS FAR AS THE NETWORK GOES WITH ANTHEM BLUE CROSS BLUE SHIELD.

IT'S NATIONWIDE.

IF SOMEBODY WANTS TO GO TO THE MAYO CLINIC OR JOHNS HOPKINS, IT'S NOT AN ISSUE.

UM, SO VERY LARGE, UM, OVERLAPPING NETWORK THAT WORKS VERY WELL.

OKAY.

THANK YOU.

UM, AND THIS

[00:10:01]

KIND OF COVERS IT IN A LOT OF RESPECTS.

THEY'VE QUOTED THEIR PPO PLAN DESIGN JUST MEANS FOLKS CAN GO IN AND OUT OF NETWORK, EVEN THOUGH WE RARELY EVER SEE FOLKS GO OUT OF NETWORK, BECAUSE MOST OF THE DOCTORS PARTICIPATE.

THEY'VE GOT WELLNESS PROGRAM.

THEY'VE GOT A COUPLE OF NICE LITTLE PERKS THAT THEY'VE PUT IN THE PLAN.

ONE OF THEM IS CALLED CARE CASH, WHICH JUST GIVES THE EMPLOYEES FOR EMPLOYEE ONLY $250.

IF THEY GO TO CERTAIN PHYSICIANS THAT THEY CAN USE TOWARDS THEIR CO-PAYS.

SO REALLY IN A LOT OF CASES, THEY WOULDN'T EVEN HAVE COPAYS FOR CERTAIN VISITS FOR $500 FOR FAMILY COVERAGE.

WE TALKED ABOUT THE DENTAL AND THE VISION DISCOUNTS THAT THEY GIVE YOU OFF THE MEDICAL.

SO THAT WAS THE TWO AND A HALF PERCENT THAT CAME INTO THE MEDICAL RATES.

I TALKED ABOUT THE PLANS MATCHING.

THEY ALSO PUT IN, IT'S A PRETTY INNOVATIVE KIND OF PROGRAM CALLED BENEFIT ALLY, WHICH BUNDLES AN ACCIDENT PLAN, A CRITICAL ILLNESS AND A HOSPITAL INDEMNITY PLAN.

AND IF YOU'LL GO TO THE NEXT SLIDE, EMILY, I'LL KIND OF COVER IT QUICKLY.

BUT IN A NUTSHELL, IT, AGAIN, ANYONE THAT TAKES THE MEDICAL PLAN AND THEIR DEPENDENCE THAT THEY PUT ONTO THIS MEDICAL PLAN UNITED AS BUILT IN, AND I'M GOING TO WORK ON THAT ENHANCED PLAN ON THE RIGHT HAND SIDE OF EACH OF THOSE PIECES, UM, AN ACCIDENT PLAN AND HOSPITAL INDEMNITY THE CRITICAL ILLNESS.

SO IN A NUTSHELL, BOY GOES TO THE EMERGENCY ROOM FOR A CUT ON THEIR FINGER.

UM, THAT FALLS UNDER THE ACCIDENT BENEFIT SCHEDULE.

YOU CAN SEE EMERGENCY CARE FOR TREATMENT BENEFIT ON THE ENHANCED PLAN.

IT'S GOING TO PAY THE EMPLOYEE $200.

IT DOESN'T MATTER WHAT THEIR BENEFITS PAY.

THEIR BENEFITS ARE GOING TO BE THERE UNDER THE STRUCTURE THAT WE'VE TALKED ABOUT, THE EMPLOYEE IN THIS CASE WOULD GET A $200 CHECK IN THE MAIL JUST BECAUSE THEY HAD TO GO TO THE EMERGENCY ROOM FOR A FINGER CUT IN THAT, IN THAT SITUATION.

SO IT'S MUCH MORE ROBUST.

THIS IS JUST KIND OF A HIGH-LEVEL VERSION OF IT, BUT IT GIVES THE EMPLOYEES SOME MONIES BACK.

THESE NORMALLY ARE BENEFITS THAT, THAT THE EMPLOYEES WOULD PURCHASE ON A VOLUNTARY BASIS.

AND THEY'RE JUST BUNDLED WITH THE MEDICAL PLAN.

THERE'S NO CLAIMS NECESSARY.

THEY DON'T HAVE TO FILE A SEPARATE CLAIM TO UNITED FOR THAT ACCIDENT CLAIM.

IN THAT EXAMPLE, UM, JUST, JUST A NICE EXTRA PERK THAT'S BUILT INTO THE PLAN THAT WILL GIVE THE EMPLOYEE SOME MONEY BACK TO HELP COVER MAYBE SOME OF THEIR OUT-OF-POCKET EXPENSES.

SO WITH THAT, I'LL TAKE A BREATH AND SEE WHAT KIND OF QUESTION THOSE ARE.

MY THREE, YOU MET YOUR MISSED VAP.

WHAT IS THAT? SORRY, EMPLOYEE ASSISTANCE PROGRAM.

SO TODAY IT'S COVERED OR THERE'S AN EMPLOYEE ASSISTANCE PROGRAM BUILT INTO THE LOCAL CHOICE PLAN EMPLOYEE SYSTEMS PROGRAM.

THINK OF IT AS 24 SEVEN ACCESS TO A NURSE TO TALK ABOUT, OR A PSYCHIATRIST OR COUNSELOR TO TALK ABOUT ANYTHING THAT MIGHT BE TROUBLING YOU, AND IT'S NOT JUST THE EMPLOYEE, BUT IT'S ANYONE THAT LIVES IN THEIR HOUSE.

EVEN THOSE NOT COVERED BY THE HEALTH PLAN.

DR.

DALEY OR KEITH.

ANYTHING ELSE THAT YOU WANT ME TO MAKE SURE WE COVER OR TALK ABOUT? OR IF THE BOARD IS COMFORTABLE, THIS'LL BE ON YOUR AGENDA FOR APPROVAL AT THE NEXT MEETING, YOU SEE ANYTHING IN BETWEEN.

NOW LET US KNOW THAT'S A GOOD PLANTS, GOOD SAVINGS, DONE A GOOD JOB FOR US.

AND, AND I KNOW YOU SAID THAT, UH, THIS IS WILDLY ACCEPTED, BUT WE WE'VE CHECKED.

AND WE KNOW THAT OUR LOCAL PHYSICIANS DO TAKE UNITED UNIT UNITED.

NUMBER ONE IS WELL ACCEPTED UP HERE AND THEY'RE WELL ACCEPTED INTERNATIONALLY.

THERE THEY'RE ON THE SAME LEVEL OF RECOGNITION IN THAT THROUGHOUT THE HEALTH PROFESSION, AS ANTHEM BLUE CROSS, ANY OF THOSE COMPANIES, CIGNA THEY'RE, THEY'RE VERY WELL-KNOWN MA'AM.

AND JUST TO ADD TO THAT, THE CITY OF WINCHESTER, UM, TOOK UNITED HEALTHCARE JANUARY 1ST.

AND THAT PROCESS I MENTIONED EARLIER WITH LOOKING FOR OPTIONS FOR JANUARY ONE, BECAUSE THEY WERE WORRIED ABOUT THE NETWORK GOING AWAY WITH ANTHEM.

SO THEY'RE ONE, THAT'S ABOUT 500 EMPLOYEES THAT TOOK UNITED THERE'S OTHERS, OTHER LARGE GROUPS IN THE AREA, BUT THAT'S ONE OF NOTE THAT JUST WENT REALLY NOT UNITED THIS, THIS YEAR.

OKAY.

ONE OF, ONE OF THEIR BIG PLANS MA'AM IS ARP.

THAT'S UNITED.

ANY OTHER QUESTIONS, MR. LEE? OKAY.

THANK YOU.

THANK YOU FOR YOUR TIME.

OKAY.

AT

[D. Public Comment Period (60 Minute Time Limit)]

THIS TIME, IT'S PUBLIC COMMENT PERIOD, AND THAT'S A 60 MINUTE PERIOD, UM, TO DISCUSS ISSUES OR ITEMS THAT ARE NOT A PART OF A PUBLIC HEARING.

ALL COMMENTS WILL BE DIRECTED TO THE BOARD OF SUPERVISORS AND NOT TO THE AUDIENCE.

BE CONSIDERATE OF YOUR FELLOW SPEAKERS.

THERE SHOULD BE NO APPLAUSE, BOOING OR OTHER AUDIBLE DISRUPTION TO THE PROCEEDINGS THROUGH A SHOW OF HANDS.

THIS DOES INCLUDE INFORMATIONAL MATERIALS USED AS PART OF A FACTUAL PRESENTATION TO THE BOARD AT THIS MEETING.

THE BOARD WILL NOT TOLERATE PERSONAL ATTACKS BY ANYONE ON

[00:15:01]

ANY OR ANY OF THE PARTICIPANTS IN THE PROCEEDINGS.

AND MR. SHRUNK, HAS ANYBODY SIGNED UP? YES.

MADAM CHAIR, TOM .

AND IF YOU WOULDN'T MIND GIVING US YOUR NAME AND ADDRESS PLEASE.

OKAY.

MY NAME IS TOM VOLUNTEERS.

I LIVE IN LINDEN.

I PUT MY DRESS ON THAT NOTE.

UH, I'D LIKE TO, UH, BRING UP THE REGULATIONS THAT WE'RE NOW LIVING UNDER BECAUSE OF THE, UH, SPOTTED.

WHAT DOES IT FLY ABOUT ATLANTA AND FOX SPOTTED LANTERN FLY? UH, I LIKE TO GO A LITTLE BIT IN THE BACKGROUND ABOUT HOW THIS CAME ABOUT, UH, ABOUT A MONTH AGO, UH, ROYAL EXAMINER HAD AN ARTICLE AND IT HAD SOME RATHER, I WOULD SAY DRACONIAN RULES, UH, UH, FOR, FOR BEHAVING ONCE YOU'RE IN THE, IN THE, UH, IN THE AREA.

AND, UH, THERE WAS A NUMBER THAT I COULD CALL.

AND WHEN I TALKED TO THE PEOPLE AT THE VIRGINIA DEPARTMENT OF, UH, I GUESS IT'S NOT SPARRING LANA FLY, BUT THERE THEY WERE THE FOLKS, UH, THEY WERE NOT TOO, UH, HIGHLY EMPHASIZING, UH, THE BAD RULES, UH, BUT, BUT THE GOOD RULES AND I'M NOT AGAINST TRYING TO STOP IT.

UH, BUT THE THING THAT CAUGHT ME WAS THAT WE HAVE A, UH, A SET OF ITEMS THAT THEY HAVE CALLED THEIR, UH, REGULATED ARTICLES.

UH, AND YOU HAVE TO TREAT THESE REGULATED ARTICLES, ESPECIALLY SOME OF THE REGULATOR ARTICLES THEY SAID WERE TRUCKS, VEHICLES, TRAILERS, RVS.

AND THE THING THAT BOTHERS ME IS THAT FOR PERSONAL PEOPLE, IF YOU TAKE ANY OF THESE ITEMS OUT OF THE AREA, YOU HAVE TO INSPECT IT.

YOU HAVE TO MAKE SURE THAT THERE'S NO, UH, NO SPOTTED LANTERN FLIES IN WHATEVER PHASE OF THEIR LIFE STAGE ARE.

AND THE REGULATED ARTICLE IS ACCOMPANIED BY A COMPLETED INSPECTION STATEMENT.

AND THE WAY I READ THAT IS THAT, UH, IF I DRIVE MY TRUCK OUT OF HERE GOING EAST, I NEED ONE OF THESE STATEMENTS THAT REALLY BOTHERS ME AGAIN.

I'M NOT, UH, I'M NOT TRYING TO BE AGAINST KEEPING THE LANTERN FLY DOWN, BUT THIS IS FRANKLY THAT CREEPS ME OUT THAT I HAVE TO HAVE A, AN AUTHORIZATION STATEMENT TO DRIVE OUT OF HERE.

OKAY.

AND I DID READ THE LAWS AND THAT'S THE WAY THE LAWS READ TO ME.

SO, I MEAN, HOW DOES THAT AFFECT ALL THE PEOPLE DRIVING TO THEIR JOBS OUT OF HERE? HOW DOES THAT AFFECT PEOPLE THAT COME HERE WITH AN RV OR WHATEVER, AND THEN FIND OUT THAT THERE'S RULES AND REGULATIONS ON HOW TO GET OUT OF HERE? UH, I, I DON'T HAVE ANY SOLUTIONS.

I'M JUST CONCERNED ABOUT WHAT THE LAWS SAY.

THANK YOU.

OKAY.

THANK YOU.

AND YOU BROUGHT UP SOME VERY VALID THINGS, AND THOSE ARE, UM, QUESTIONS THAT, UM, I'LL TRY TO REMEMBER AND TALK TO OUR COUNTY AGENT, AND MAYBE WE CAN HAVE A WORK SESSION, UH, WHERE HE CAN GIVE US MORE DETAILS ON THAT, BECAUSE I HONESTLY DON'T KNOW WHAT TO TELL YOU ABOUT THAT.

I'VE HEARD THOSE REGULATIONS, BUT I DON'T KNOW IF THEY HAVE INSPECTION SITES THAT THEY'RE GOING TO SET UP TO AID

[00:20:01]

PEOPLE OR WHAT, SO WE'LL, WE'LL TRY TO GET THAT INFORMATION.

AND YOU SAID YOU GAVE MS. SHIRAKI YOUR CONTACT INFORMATION.

OKAY.

THANK YOU.

AND I, I APOLOGIZE.

I FORGOT TO MENTION THIS IS, UH, WE DO HAVE A THREE MINUTE, SO, UM, UM, WE'RE WE, YOU WERE FINE, BUT I DID FORGET TO SAY THAT AT THE BEGINNING OF THE COMMENT PERIOD, ANYONE ELSE SIGNED UP? UH, YES.

MADAM CHAIR.

JAMES PRITCHARD.

YES.

YOU ARE FOR THE CORRECT ONE COME FORWARD.

YEAH.

THIS IS THE ONLY COMMENT PERIOD.

UH, WE HAVE AS FAR AS THINGS THAT ARE NOT A PUBLIC HEARING.

GREAT.

YES.

OKAY.

SO I JUST WANT TO BRING IT TO, UM, BRING IT TO THE ATTENTION OF THE, OF THE BOARD, UH, THAT, UH, THE LAST MEETING, AFTER THE PLANNING MEETING, UH, MOST OF, IF NOT EVERYBODY IN THE STREET VISIT, AND THAT WAS SIMPLY BECAUSE OF, UM, THEY REALLY, WE ALL FELT THAT IT WAS ALL, EVERYTHING WAS GONNA BE APPROVED.

WE REALLY DIDN'T HAVE A SAY, WELL, I FOUND OUT, YOU KNOW, YOU KNOW, CAUSE I LIVE ON THE ROAD THAT DOT DID COME OUT AND PUT OUT SOME SIGNS AND SOME THINGS ABOUT, YOU KNOW, THE TRAFFIC ON, ON LIBERTY HALL ROAD.

BUT YOU KNOW, ALSO FOUND OUT TONIGHT THAT THE SPEED LIMITS 25 TO 35 MILES AN HOUR ON, UM, YOU KNOW, A BLIND HILL.

AND SO MY MAJOR CONCERN IS, IS THE MORE TRAFFIC WE ALLOW ON LIBERTY HALL ROAD FOR TEMPORARY LODGING.

IT PUTS US AT RISK.

I WALKED THE ROAD, FAMILY WALKS ROAD, KIDS WALK THE ROAD, YOU COME ON UP OVER THAT BLIND HILL.

THAT COULD BE AN ACCIDENT AND IT WON'T BE ON ME.

SO I JUST WANTED TO MAKE THAT STATEMENT.

THANK YOU.

ANYONE ELSE, MS. SHIRAKI NOT SIGNED UP MADAM CHAIR, BUT I DO HAVE AN EMAIL FROM A FEW RESIDENTS THAT THEY REQUESTED ME TO READ DURING THE PUBLIC COMMENT PERIOD.

DEAR SUPERVISORS, AS RESIDENTS OF APPLE MOUNTAIN LAKE IN LINDEN, VIRGINIA, WE WOULD LIKE TO EXTEND OUR HEARTFELT GRATITUDE FOR ALL YOU DO TO SERVE YOUR CONSTITUENTS AND ENSURE THAT WARREN COUNTY CONTINUES TO REMAIN A SAFE FAMILY ORIENTED COMMUNITY.

THIS PROPOSED REZONING OF GREEN AGRICULTURAL LAND TO COMMERCIAL WOULD HAVE LED TO A SHEETZ GAS STATION TO BE BUILT LITERALLY IN THE BACKYARD OF SOME OF OUR NEIGHBORS, THE SERENE MOUNTAINOUS LANDSCAPE THAT RESIDENTS AND TOURISTS NOW ENJOY WHEN ENTERING WARREN COUNTY WOULD HAVE BEEN CHANGED FOREVER INTO A HARSH THREE ACRE CITYSCAPE OF CONCRETE AND METAL.

THANK YOU FOR YOUR VOTE.

REALIZING THAT TOURISTS DO NOT WISH TO VISIT WARREN COUNTY TO SHOP AT SHEETZ WHEN THERE ARE TWO OTHER GAS STATIONS, LESS THAN HALF A MILE AWAY.

THANK YOU FOR LISTENING TO THE CONCERNS ABOUT OUR WELL WATER BEING IMPACTED.

THANK YOU FOR LISTENING TO OUR WORRIES ABOUT INCREASED CRIME AND TRAFFIC TO OUR LITTLE COMMUNITY, BY TAKING INTO ACCOUNT THE CONCERNS OF THE COMMUNITY CONSTITUENTS, THIS COMMUNITY CONSTITUENTS, THIS POSSIBLE REZONING WOULD HAVE ACTUALLY IMPACTED YOU ARE TO BE COMMENDED BY PROTECTING OUR RURAL SANCTUARY RATHER THAN THE PROPOSED INCREASE IN REVENUE AND BUS STOP THAT DIETING DANGLED BEFORE THE COUNTY A STATEMENT MADE AT THE MEETING THAT THE PROPOSED REZONING WAS NEITHER A GOOD ZONING PRACTICE NOR AN APPROPRIATE NECESSITY FOR THE PUBLIC DID NOT FALL ON DEAF EARS.

THANK YOU FOR LISTENING AND VOTING TO DENY THIS UNNECESSARY REZONING.

YOU SHOWED CLARITY AND CLEAR DECISION MAKING AND KEEPING THIS PARCEL OF LAND TO REMAIN GREEN, WHERE RESIDENTS AND VISITORS ALIKE CAN APPRECIATE THE MAJESTIC IMPACT THAT MAKES LINDEN SUCH A BEAUTIFUL PLACE TO BE ENJOYED FOR YEARS TO COME.

SINCERELY SARAH SULLIVAN, STEPHANIE MANUEL, DEANNA PIPER, JACKIE MILLER, AND MARGARET MELLBERG.

AND THERE WAS NO ONE ELSE SIGNED UP MADAM CHAIR.

WOULD ANYONE ELSE LIKE TO SPEAK AT THIS TIME SECOND CALL, IF ANYONE HAS ANYTHING THEY WANT TO SPEAK ON.

OKAY.

THIRD AND FINAL CALL.

[E. Reports – Board Members, Interim County Administrator, Interim County Attorney]

AND I THINK WE FORGET HOW COLD IT IS.

AND SO IT WAS VERY EXCITING TO HAVE ALL THESE YOUNG WOMEN, UM, 200 YOUNG WOMEN, THE LARGEST NUMBER EVER IN WARREN COUNTY TO SIGN UP, TO PLAY SOFTBALL.

SO I WAS VERY EXCITED TO BE A PART OF THAT.

AND ON FRIDAY I'M GOING TO, UH, GET THE OPPORTUNITY TO HANG OUT AT BILL'S AUTO CARE CLINIC BECAUSE THEY'RE GOING TO DO A GRAND OPENING OF HIS NEW BUILDING THERE.

SO THAT'S ALL MADAM CHAIR.

THANK YOU.

THANK YOU.

AND I TO CONGRATULATIONS SHOW, UM, I'M VERY PLEASED THAT, UM, YOU GOT THIS AND I THINK YOU'RE GOING TO DO A WONDERFUL JOB.

BE TALKING TO YOU HAVE A LOT OF VISION THAT I APPRECIATE.

UM, AND IF I CORRECT ME, MR. SAIL, UH, OFFICER, EXCUSE ME, IF I'M WRONG WAS LAST WEEK, UH, COMMUNICATIONS OFFICER'S RECOGNITION WEEK.

WELL, I WISH WE HAD THEM HERE.

HE CAME ON THE WRONG WEEK TO RECOGNIZE THEM.

SO I APOLOGIZE TO THAT, BUT I DO WANT TO THANK THEM ALL.

THEY'VE GOT A TREMENDOUS JOB AND THEY DO WELL AT IT, SO WE APPRECIATE THEM.

UM, LET'S SEE, I ATTENDED ON APRIL 14TH, FIRE CHIEF'S MEETING AND OUR FIRE CHIEF IS BACK HERE AND IT WAS A WELL ATTENDED MEETING ALL.

I THINK WE HAD ALL, BUT MAYBE ONE FIRE, CHIEF, AND STILL THAT STATION WAS REPRESENTED BY THE COMPANY PRESIDENT.

AND, UM, IT WAS A VERY GOOD MEETING AND THEY EXPLAINED THEIR NEED AND IT'S ON OUR CONSENT AGENDA FOR THERMAL IMAGING CAMERAS, UM, WHICH THEY USE TO, UM, NOT ONLY CHECK IF I'M WRONG, CORRECT ME, UH, SOURCES OF HEAT, BUT ALSO CAN BE USED, UM, AND ACCENTS AND SO FORTH TO SCAN THE AREA IN CASE SOMEONE IS THROWN FROM A CAR AND NOBODY KNEW THERE WAS ANOTHER OCCUPANT TO THAT CAR.

SO, UM, THEY EXPLAINED THE NEED TO THAT, AND THAT THEY'RE GONNA, IF WE PASS IT TO, THEY WILL GET THEM AT A VERY GOOD BARGAIN.

UM, SATURDAY I ATTENDED EARTH DAY AT SKYLINE.

MR. PETTY WAS THERE, UM, TOOK MY GRANDSONS AND, UM, IT WAS, IT WAS A REALLY GOOD, MY KIDS, MY GRANDKIDS ARE SIX AND EIGHT AND THEY LOVED IT.

MY GRANDSON WENT HOME, READ ME ALL THE PAMPHLETS.

HE GOT, HE WAS SO EXCITED.

THEY GOT TREES, THEY GOT ALL KINDS OF THINGS AND IT WAS REALLY NICE.

AND THEN THAT AFTER LET'S SAY SUNDAY AFTERNOON, T-BALL FOR THE BOYS OPENED UP AND I GOT TO SEE MY SIX YEAR OLD PLAY T-BALL AND THOSE KIDS HAD THAT IS, IT'S SO EXCITING TO WATCH THOSE KIDS.

UM, AND I THINK THAT'S IT FOR ME, DR.

DALEY.

THANK YOU.

MA'AM DO YOU WANT TO ADD ANYTHING? SURE.

YES.

UM, WE ARE PROUD TO ANNOUNCE THAT, UM, OUR OWN JOE PETTY HAS BEEN CHOSEN AND PROMOTED TO THE POSITION OF, UM, PLANNING DIRECTOR.

MR. PETTY BEGAN WITH THE COUNTY IN JANUARY, 2018 AS ZONING OFFICER, AND HE WAS PROMOTED IN, UM, 2000, 19, MID 2019 CHOSE, ONLY ADMINISTRATOR.

AND WE'RE EXCITED.

WE FEEL THAT HIS KNOWLEDGE AND HIS ENTHUSIASM FOR WARREN COUNTY, UM, THAT IT WILL BE A GREAT HE'LL MOVE SEAMLESSLY INTO THAT POSITION.

SO, UM, WE HAVE A GREAT TEAM IN THE PLANNING DEPARTMENT, AND I KNOW I'M ALWAYS PREACHING ABOUT OUR GREAT TEAM WITH MATT AND NATALIE AND EMMA.

AND I THINK JOE, I'M JUST CONFIDENT HE'LL DO A GREAT JOB AS THE DIRECTOR.

SO, SO WE'RE EXCITED ABOUT HIS PROMOTION.

THANK YOU.

YES, SIR.

UH, MUNG OTHER THINGS THIS WEEK, MADAM CHAIR, UH, WE HAD OUR BOND SALE.

REMEMBER THE BOARD AUTHORIZED THE RESALE OF SOME OF OUR BONDS, AND WE HAD ENDED UP SELECTING FOR PARTICULAR YEARS TO REISSUE AND OUR NET PRESENT VALUE SAVINGS WAS 8.3%.

IT'S A TOTAL GROSS OF $931,000.

AND THAT ALL AVERAGE 49,000 A YEAR.

SO WE'RE, WE'RE VERY PLEASED WITH THAT.

WE HAD SET A MINIMUM OF 4% AND, UH, MR. MICK LIBERTY HAD HELPED WITH, UH, NEGOTIATIONS THERE AND WE DIDN'T LIKE IT.

SO WE TOOK A NUMBER OF THE YEARS OUT THAT WE STILL HAVE IN OUR POCKET

[00:30:01]

FOR THE FUTURE SOMETIME, BUT THESE FOUR YEARS DID WERE SELECTED AND THAT WAS SUCCESSFUL.

SO WE'RE VERY PLEASED WITHOUT, UH, WE ARE CONTINUING OUR WORK, UH, WITH IT.

UH, THEY DID SOME OF THE SWITCHOVERS TO THE NEW SYSTEM ON THE ADMINISTRATION BUILDING YESTERDAY EVENING AND WORKING TONIGHT.

AND THEY WILL BE DOING THE PUBLIC SAFETY BUILDING NEXT MONDAY AND TUESDAY.

AND WE'LL KEEP THAT PROD PROD PROCESS PROGRESSING THERE.

AND, UM, YOU KNOW, TOMORROW IS ADMINISTRATIVE PROFESSIONALS DAY AND WE WANT TO THANK MRS AND OUR OTHER ASSISTANTS FOR ALL THE WORK THEY DO HERE TO KEEP US ON A STEADY COURSE.

THANK YOU.

THANK YOU, MR. HAM.

I HAVE NO REPORT.

WELL, I'M GOING TO SET BACK IN BECAUSE I, I WAS JUST THINKING, IT SEEMED ABOUT THIS TIME OF YEAR THAT, UM, IT WAS ADMINISTRATIVE ASSISTANT.

IT'S NOT ON MY CALENDAR.

I'M BUMMED.

I GOTTA GET A NEW CALENDAR FOR NEXT YEAR.

SO THANK YOU, MRS. SHIRAKI YOU DO AN AWESOME JOB AS WELL AS SHELLY AND KAYLA, AND WE APPRECIATE IT VERY MUCH.

ALRIGHT.

UH,

[F. Approval of Accounts]

APPROVAL OF ACCOUNTS.

I HAVE A MOTION TO APPROVE AS PRESENTED MADAM CHAIR.

AYE, MR. MABE, MR. FOX, AND IS NOW SEVEN 30 AND WE HAVE TWO ITEMS UNDER UNFINISHED BUSINESS.

UM, WHAT IS, DO WE WANT TO GO INTO PUBLIC HEARINGS OR DO WE WANT TO TAKE CARE OF THESE TWO AND THEN GO INTO PUBLIC HEARINGS? I THINK WE SHOULD JUST TAKE CARE OF THE UNFINISHED BUSINESS.

WE'VE ALREADY WENT THROUGH IT SEVERAL TIMES A WEEK.

YEP.

OKAY.

[G. Marlow and Silek Investments, LLC for the Amendment of Proffers (R2004-09-01, R2005- 12-01, R2006-05-01, and R2007-05-01) – Taryn Logan]

ITEM G MARLO AND SILENT INVESTMENTS, LLC FOR AMENDMENT OF PROPER'S ARE 2004 DASH OH NINE DASH OH ONE R TWO ZERO ZERO FIVE DASH 12 DASH OH ONE R TWO ZERO ZERO SIX DASH OH FIVE DASH OH ONE AND R TWO ZERO ZERO SEVEN DASH OH FIVE DASH OH ONE, MRS. LOGAN.

THANK YOU.

UM, AS WE PRESENTED, UM, AS I PRESENTED AT THE LAST WORK SESSION, UM, IN YOUR PACKETS, YOU HAVE THE REQUEST FROM MARLIN SILAC INVESTMENTS TO AMEND THEIR PROFFERS.

THEY DO HAVE FOUR SETS OF PROFFERS FOR, UM, FOR THIS DEVELOPMENT BECAUSE THE LAND WAS ACQUIRED AT DIFFERENT TIMES AND SUBSEQUENTLY REZONED AT DIFFERENT TIMES, THE APPLICANT HAD ORIGINALLY PROFFERED TO DEDICATE 60 FEET OF RIGHT AWAY FOR THE, UM, COUNTY'S PROPOSED COLLECTOR ROAD TO THE REAR OF THE PROPERTY.

UM, AND I'VE MET WITH THE APPLICANT AND THE NEW REQUEST IS TO REDUCE THAT PROFFER TO 50 FEET OF RIGHT AWAY, UM, WHICH WILL MATCH WHAT WE HAVE, UM, BEEN WHAT HAS BEEN PROFFERED TO THE COUNTY AT THE REAR OF THE RURAL FARM SITE AS WELL.

AND THEN THEY ARE ALSO REQUESTING TO, UM, ADD THE USE OF ENCLOSED STORAGE AND THE USE OF THE STORAGE OF RECREATIONAL VEHICLES AND CARS, UM, IN BOATS TO THE PROFFER STATEMENT AS WELL.

THE PROFFERS LIMITED, UM, THE USES TO, UM, APPROXIMATELY SIX USES.

AND, UM, THEY DO HAVE, UM, SOMEONE, A BUSINESS THAT WANTS TO BUILD THE ENCLOSED STORAGE WITH THE STORAGE OF RECREATIONAL VEHICLES, UM, IN CARS, ON THE, ON THE SITE TO THE REAR OF THE PROPERTY.

AND, UM, THOSE USES WOULD NEED TO BE ADDED TO THE PROPER STATEMENT FOR THEM TO DO SO.

AND AS I EXPLAINED AT THE WORK SESSION, THIS IS THE FIRST STEP AS A MIM IS, IS AMENDING THESE PROVERS IF THE BOARD SO DESIRES AND THEN THE APPLICANT WOULD NEED TO COME BACK FOR THE CONDITIONAL USE PERMIT FOR THEM USE, THAT WOULD ALSO, THAT WOULD COVER THE, UH, THE HIDING OR THE SCREENING PART.

YES, SIR.

THE, THE, THE RECREATIONAL VEHICLES ON BOATS AND CARS THAT HAS TO BE SCREENED FROM VIEW OF ROUTE THREE 45, 22, BECAUSE THE COUNTY HAS A HIGHWAY, A RELAY DISTRICT THAT SPANS 1000 FEET OF EACH SIDE OF THE ROADWAY THERE.

AND, UM, IN WITH THAT, THE ORDINANCE REQUIRES

[00:35:01]

THOSE TO BE TOTALLY SCREENED FROM VIEW.

I DID SPEAK WITH THE, UM, THE BUSINESS OWNER TODAY AND THEY, UM, TALKED ABOUT DOING THE BUILDING PARALLEL TO, UM, WINCHESTER ROAD AND THEN THE ART, THE STORAGE WOULD BE BEHIND THAT BUILDING.

AND I ENCLOSED A RENDERING OF, OF THAT BUILDING IN YOUR PACKET.

UM, SO WE WOULD WORK WITH THEM THROUGH THE CONDITIONAL USE PERMIT PROCESS TO DETERMINE THE EXACT SCREENING, BECAUSE ALSO THERE WOULD BE, I MEAN, I WOULD ASSUME SOME POSSIBLY A FENCE.

AND THEN, AND THEN THIS IS ALL TO THE REAR THREE ACRES OF THE PROPERTY.

SO EVENTUALLY THE PROPERTY IN THE FRONT WILL BE DEVELOPED AS WELL.

ONE THAT THEY'RE INCLINED TO USE.

I MEAN, THERE'S FOUR PICTURES HERE.

WELL, I THINK IT'S THE DIFFERENT ELEVATIONS OF THE SAME BUILDING.

MY, MY COPY BLURRED OUT, BUT THE ELEVATION A, THE WAY THEY'RE TALKING, I BELIEVE THAT WOULD BE THE FACE TOWARDS, OR ELEVATION B WOULD BE THE PARALLEL TO THE ROAD BECAUSE OF THE LENGTH OF IT.

SURE.

I GUESS.

I MEAN, YOU HAVE TO, YOU HAVE TO COME UP HERE, SO IT GETS RECORDED.

THANK YOU.

SO IS THE APPLICANT WORKING WITH MR. MARLON, MR. SILENT? HI, MY NAME IS KEVIN TOMACO.

I'M LIKE SH LIKE TARYN STATED.

I AM WORKING WITH MR. MARLOWE OR MRS. MR. CY, LIKE ON THE STORAGE USE THERE.

AND I BELIEVE THE RENDERINGS THAT YOU WERE LOOKING AT ARE EXAMPLES FROM THE ARCHITECT THAT WE HAVE CHOSEN.

YES.

THOSE ARE EXAMPLES OF SOME OF THE BUILDINGS THEY HAVE DONE AND WOULD BE BASICALLY INDICATIVE OF THE QUALITY IMMATERIAL CHOICES THAT WE WOULD BE LOOKING AT UTILIZING.

OKAY.

SO THIS IS NOT EXACT, BUT THIS IS CLOSE TO WHAT YOU'RE.

OKAY.

IT'D BE SOMETHING IN THAT YES.

IN THAT LANGUAGE.

AND THEN THIS IS WHAT THE BACK ANOTHER.

YEAH.

OKAY.

SO OUR OVERLAY DISTRICT HAS CERTAIN ARCHITECTURAL REQUIREMENTS, UM, ANY WAY THAT THEY WOULD HAVE TO ADHERE TO.

AND WE COULD ALSO THROUGH THE CONDITIONAL USE PERMIT, PUT ANY ADDITIONAL CONDITIONS THAT THE BOARD FELT NECESSARY.

OKAY.

THANK YOU VERY MUCH.

YES, SIR.

THANK YOU.

ARE THERE ANY OTHER QUESTIONS OR CONCERNS WITH THIS? HOW MANY VEHICLES DO YOU ANTICIPATE WILL BE SUITABLE BEHIND THAT BUILDING THE THREE ACRE SPACE? RIGHT.

SO THE, AND YOU GUYS ARE PLANNING HOW TO HIDE THOSE VIEWS FROM, YEAH, IT WOULD HAVE TO BE, WE WOULD HAVE TO ENSURE THAT ACCORDING TO THE ORDINANCE.

SO IT IS IN THE REAR.

UM, SO THAT'S, THAT'S WHY IT'S POSSIBLY DOABLE.

AND SO THERE WOULD BE A ROAD EXTENDED BEHIND WORLD FARMS TO REACH THAT'S THE PLAN.

UM, THERE'S STILL A PROPERTY IN RURAL FARMS IN THIS PROPERTY, BUT AS PROPERTY COMES TO REZONE OR DEVELOP, UM, THE COUNTY HAS BEEN ACQUIRING RIGHT OF WAY FOR THIS PROPOSED COLLECTOR ROAD, WHICH HAS BEEN IN THE COUNTY'S PLANS.

UM, FOR, FOR MANY PRIOR TO MYSELF COMING HERE, UM, FOR MANY YEARS.

SO YOU CAN SEE THE START OF IT AT THE REAR OF THE WELLS FARGO AND SEVEN 11 IN BETWEEN.

AND THEN THAT ROAD WOULD EXTEND AND THEN IT WOULD COME OUT AT DIAMOND RIDGE IS, IS THE PLAN.

SO IN THE INTERIM, MRS. LOGAN, HOW WOULD THEY ACCESS FROM WINCHESTER ROAD FROM, FROM FIVE 22? I TELL THAT, WELL, AND IT WILL ALWAYS BE ABLE TO BE ACCESSED FROM WINCHESTER ROAD AND THAT'S NOT GOING TO GO AWAY WITH THE COLLECTOR, THE COLLECTOR.

I WOULD JUST BE AN ALTERNATIVE WAY IN OKAY.

BECAUSE THEY DID THE FRONTAGE IMPROVEMENTS ALL ALONG THE FRONT OF THE PROPERTY, UM, WITH V DOT AND, AND THE ADJOINING PROPERTY OWNER.

SO THE FRONTAGE IMPROVEMENTS ARE DONE.

AND THE ENTRANCES IN ONE FIVE ON WINCHESTER ROAD INTO THIS PROPERTY ALREADY? YES.

YES.

I'M TRYING TO REMEMBER.

OKAY.

CLOSE THE DOORS AND WAREHOUSE ON THERE.

[00:40:04]

THANK YOU.

ANY OTHER QUESTIONS? IS THERE EMOTION? MADAM CHAIR? UM, I MOVED TO THE BOARD OF SUPERVISORS APPROVED THE REQUEST TO AMEND THE APPROVED REZONING PROPERS FOR THE APPLICATION.

NUMBERS ARE 2004 DASH ZERO NINE DASH R ONE R 2005 DASH 12.

ARE 2006 DASH FIVE DASH OH ONE ARE 2007 DASH ZERO FIVE DASH ZERO ONE TWO.

ADD ENCLOSED STORAGE WITH THE STORAGE OF RECREATIONAL VEHICLES AND CARS AS A USE PERMIT ON THE PROPERTY AND TO ALLOW A REDUCTION OF THE RIGHT OF WAY WITH ALONG THE REAR PROPERTY LINE TO 50 FEET.

IS THERE A SECOND, SECOND ROLL CALL, MRS. SHIRAKI MR. FOX, MR. MABE, MADAM CHAIR.

THIS IS OATS.

THANK YOU.

ITEM H

[H. Conditional Use Permit 2021-01-01, Justin and Felicia Katzovitz for a Short-Term Tourist Rental – Matt Wendling]

CONDITIONAL USE PERMIT 2021 DASH ONE DASH OH ONE, JUST JUSTIN AND FELICIA.

AND I APOLOGIZE IF I SAY YOUR NAME WRONG FOR SHORT TERM, UM, TOURIST RENTAL, MR. WINDLEY.

UH, YES.

THIS APPLICATION.

YEAH, IT WAS TABLED AT THE MARCH 16TH BOARD OF SUPERVISORS MEETING AFTER THE PUBLIC HEARING.

UM, MRS. COLORS, UH, REQUESTED THAT V THAT COMPLETE A REVIEW FOR THE LAND USE FOR THE IMPACT TO THE STATE ROAD AND, UH, TABLED IT UNTIL THIS MEETING.

UM, I DID CONTACT MR. CARTER AND MR. BOYS FROM V THAT REGARDING, UH, THE CONDITION OF THE ROAD WAS, UH, UH, AN ISSUE PUBLIC HEARING WITH MANY OF THE CITIZENS.

UH, AND IF THERE WERE ANY SAFETY IMPROVEMENTS THAT COULD BE DONE, UM, TO THE ROAD IN MY PHONE CALL WITH MR. CARTER, HE STATED THAT THE STATURE STORY SPEED LIMITS FOR HIGHWAYS AND EVERYTHING IS 55, BUT, UM, THE SPEED LIMIT FOR UNPAVED ROADS, WHICH THIS PORTION THAT MR LIVES ON IS, IS, UM, 25 WITH A 35 PER HOUR, UH, MAXIMUM, UM, THE ROAD DID NOT QUALIFY FOR RURAL RUSTIC IMPROVEMENT PROGRAM, AS IT HAS LESS THAN 50 ANNUAL AVERAGE TRIPS PER DAY.

THEIR DATA SHOWED THAT THEIR ANNUAL AVERAGE TRIP FOR RESIDENTS, ONE OF THE ROAD IS 40 VEHICLES PER DAY, BASED ON THE HOUSING ON THE ROAD.

UH, NUMBER THREE, THE ROAD IS TYPICALLY MAINTAINED TWICE A YEAR THROUGH RESURFACING AND GRADING.

AND THAT LAST YEAR HIS CREWS DID GO OUT A FEW MORE TIMES TO ADDRESS, UH, PAROLE BASED ON SOME COMPLAINTS THAT THEY HAD RECEIVED.

UH, AND THEN, AND NUMBER FIVE V THAT DID PROVIDE SOME ADDITIONAL SIGNAGE RELATING TO CURVES, UH, OR THEY CAN, BUT THEY DON'T PROVIDE ANY TYPES OF WARNING, SLOW DOWN CHILDREN AT PLAY SIGNS.

I THINK THAT'S PRIMARY DUE TO SECURITY ISSUES.

THEY DON'T WANT TO ALERT PEOPLE ABOUT THAT.

UM, BUT, UM, YEAH, THERE'S CAUTION, CURVED SIGNS HAVE BEEN ASSAULTED ALONG THE ROAD SINCE, UH, THE MARCH BOARD MEETING AND THE ROAD DID RECEIVE ITS ANNUAL, UH, GRADING AND, AND MAINTENANCE.

UH, BOY STATED IN HIS EMAIL, WHICH WAS, UH, BASED ON A REQUEST FOR COMMENT SPECIFIC TO THIS USE THAT THEY VE THAT TYPICALLY DOES NOT HAVE OBJECTIONS FOR THE PROPOSED USE, BUT IT APPEARS THAT THE PRIVATE ENTRANCE, UH, THAT WAS ORIGINALLY PERMITTED BY V DOT, UH, TO ACCESS THE DWELLING WAS ABANDONED AND A NEW ENTRANCE WAS INSTALLED, OH, WITHOUT A PERMIT, BASED ON OUR IMAGERY, WHICH I'VE PROVIDED YOU SOME MAPS OF, UH, IT LOOKS LIKE IT WAS DONE AFTER 2018.

OKAY.

UM, SO THE ENTRANCE IS STALLED DOES NOT MEET THE SITE STANDARDS AND THEREFORE THEY WOULD RECOMMEND THAT THE, UH, THE APPROVAL OF COP REQUIRE THAT THE APPLICANT OBTAIN A LAND USE PERMIT TO CLOSE NEW ENTRANCE ESTABLISHED ENTRANCE TO ACCESS THE DWELLING.

UM, YEAH, KEN HAS STATED THAT HE WOULD BE HAPPY TO PUT LANGUAGE IN HIS PROPERTY MANAGEMENT PLAN STATING GUESTS SHOULD TAKE EXTRA CAUTION WHILE USING LIBERTY HALL ROAD AND SHOULD DRIVE NO FASTER THAN 15 MILES PER HOUR.

YOU'RE IN A PLACE THAT YOU'VE NEVER BEEN BEFORE.

IT'S PROBABLY A REALLY GOOD IDEA TO REMIND PEOPLE ABOUT THAT.

UM, AND JUST TAKE EXTRA CAUTION.

AND AS WE'VE HEARD EARLIER, THERE ARE CITIZENS THAT USE THAT ROAD FOR THEIR FAMILY RECREATION.

AND, AND CERTAINLY THAT'S A GREAT IDEA.

UM, HE'D ALSO, HE'S ALSO WILLING TO ADDRESS THE ENTRANCE ISSUE IN ORDER TO MEET

[00:45:01]

REQUESTS FOR, UH, THE ENTRANCE TO BE PROPER TO THE PROPERTY, BE RELOCATED TO HIS PREVIOUS LOCATION.

UM, AND THIS REQUIREMENT WAS ADDED AS A CONDITION AND WILL BE REQUIRED TO BE COMPLETED PRIOR TO BEING ISSUED A CERTIFICATE OF ZONING FOR THIS BUSINESS LICENSE AND PRIOR TO ESTABLISHING AND ADVERTISING THE USE.

SO IF IT IS APPROVED BY YOU, IT DOES MEAN YOU CAN START THAT USE RIGHT AWAY.

HE'S GOING TO HAVE TO GET THAT DONE AND THEN RECEIVE THAT CERTIFICATE OF ZONING FROM US THAT SAYS HE'S MET ALL THE SUPPLEMENTARY REGULATIONS AND THE CONDITIONS ON THE PERMIT BEFORE HE CAN START ADVERTISING OR, OR DOING THE SHORT-TERM TOURIST REALM, UH, PLAINTIFF COMMISSION MOVE THIS FORWARD WITH THE FOLLOWING TWO CONDITIONS.

NUMBER ONE, THE APPLICANT SHALL COMPLY WITH ALL WARREN COUNTY HEALTH DEPARTMENT REQUIREMENTS REGULATIONS, AND THE MAXIMUM NUMBER OF OCCUPANTS SHALL NOT EXCEED SIX AS DETERMINED, ACCORDING TO THE HEALTH DEPARTMENT, OPERATIONAL PERMIT FOR A THREE BEDROOM DWELLING.

AND NUMBER TWO, THE APPLICANT SHALL HAVE THE WELD WATER TESTED ANNUALLY FOR E-COLI AND L CALIFORNIA BACTERIA, AND A COPY OF THE RESULTS SHALL BE SUBMITTED TO PLANNING AND HEALTH DEPARTMENTS.

BY THE END OF THE CALENDAR YEAR, CONDITION THREE WAS ADDED AFTER RECEIVING COMMENTS FROM V DOT AND THAT CONDITION IS THE APPLICANT SHALL BE REQUIRED TO ABANDON THE NEWER EXISTING ENTRANCE TO THE EAST.

I WILL SAY I CURT I CORRECTED THAT MS. COLORS BROUGHT THAT UP WITH ME.

SO THANK YOU, MS. COLLARS, AND RE-ESTABLISH THE ORIGINAL ENTRANCE TO THE WEST IN ORDER TO MEET ME THAT SIGHT DISTANCE STANDARD AND APPLY FOR ANY PERMITS REQUIRED BY V DOT.

UM, PUBLIC HEARING HAS BEEN HELD, AS I MENTIONED AT THE PRIOR BOARD MEETING, I'D BE GLAD TO ANSWER ANY QUESTIONS.

AND MR. KASSOVITZ IS HERE TODAY.

OKAY.

I KNOW MR. FOX ASKED, UM, WHAT THE WIDTH OF THE ROAD IS, AND I KNOW ON THE PAPER, THE ONE FORM YOU GAVE US OR PITCHER THERE'S A 36 FOOT, I THINK IT SAID RIGHT OF WAY, BUT DID WE GET A MEASUREMENT OF WHAT THE ACTUAL WIDTH THAT YOU'RE ABLE TO GO THROUGH THE AREAS? YOU KNOW, THAT'S A TOUGH ONE BECAUSE IT VARIES, UH, THROUGHOUT THE LENGTH OF THAT ROAD.

SO IT, YOU KNOW, KIND OF, DEPENDING UPON WHERE YOU'RE AT ON THAT ROAD, UM, THERE ARE PORTIONS WHEN THAT ROAD, WHERE THERE IS A OLD ANCIENT STONE WALL, AND IT'S PROBABLY IN THE RIGHT OF WAY.

SO THAT'S COMPRESSING A LITTLE BIT, THE ROAD, THE NARROWNESS THERE, THEN IT OPENS UP A LITTLE BIT AFTER THAT.

AND THEN, UM, AS YOU CAN SEE IN, IN SOME OF THE IMAGERY, YOU KNOW, TH THE ACTUAL RIGHT OF WAY, THAT'S PINCHED DOWN A LITTLE BIT, AND THEN IT ENDS UP IN THAT FINAL CUL-DE-SAC THERE AT THE END OF LIBERTY HALL ROAD.

UM, THERE IS, AND WE RECEIVED SOME INFORMATION ON THE PRESCRIPTIVE RIGHT AWAY AT THE END OF LIBERTY HALL, WHICH WAS A 30 FOOT PRESCRIPTIVE RIGHT AWAY THAT BEAT OUT ABANDONED IN 1982, UH, THAT WILL COME UP IN ONE OF OUR FUTURE, UM, CONDITIONAL USE PERMIT APPLICATIONS.

SO, UM, AGAIN, IT WAS, IT WAS KIND OF DIFFICULT TO GET AN ACCURATE MEASUREMENT ON THAT.

UH, BUT, UH, YEAH, I THINK BY ALL MEANS, UH, V DOT AND ANYBODY WHO DRIVES THAT ROAD WOULD AGREE THAT THE SLOWER, THE BETTER AND THE SAFER, SO, YES, SIR.

I WOULD AGREE, UM, ANY QUESTIONS OR CONCERNS FROM MADAM CHAIR? I WOULD JUST HAVE ONE QUESTION, UH, IN THE MOTION.

COULD WE ALSO ADD A NIGHT ONLY TO CONDITIONS AS RECOMMENDED BY THE PLANNING COMMISSION, BUT I ADDED IT RECOMMENDATION TO BEAT OUT ALSO WHEN WHICH, WHICH CONDITION OKAY.

WHAT, WHAT THE PLAN AND WHAT HE WAS TALKING ABOUT, DUDE, WHAT THE DETOX WAS.

YEAH.

I ACTUALLY THINK THERE'S A NEW, OH, THERE IS.

THERE'S AN ARCHIE.

I THINK WE GOT, WE DO HAVE A NEW PAGE.

ANOTHER PAGE ON US.

SORRY ABOUT THAT.

YEAH.

AND I APPRECIATE THE FACT THAT THEY CAN'T, THAT HE CAN'T ACTUALLY MOVE ON UNTIL HE'S DONE THAT.

BUT AT THE SAME TIME, I KIND OF FEEL LIKE I WOULD LIKE TO KNOW BEFORE WE APPROVE THIS, THAT IT IS DONE.

I JUST KIND OF FEEL LIKE, I LIKE TO KNOW I'VE GOT ALL THE T'S CROSSED AND I'S DOTTED AND NOT HAVE TO WORRY THAT NOT SAYING ANYTHING DISPARAGING, BUT THINKING THAT YOU MAY NOT REALIZE, AND IT MAY BE, HE'S ALREADY GOT THIS THING LINED UP AND OH ONE WEEKEND

[00:50:01]

WON'T MATTER.

AND THEN WE HAVE AN ACCIDENT AND THERE'S A LIABILITY THERE BECAUSE EVEN VIDOT SAYS THAT USING THAT INTEREST IS UNSAFE AS WELL AS A LIABILITY.

UM, IF ANY ACCIDENTS OCCUR COURSE, I REALIZE THAT'S ON HIM, BUT I'M TRYING TO PROTECT HIM AS WELL.

SO, UM, AND KNOWING THAT ROAD, AND I DO KNOW THAT ROAD, IT IS A VERY PRECARIOUS ROAD.

SO, UM, THAT'S JUST MY THOUGHTS ON THAT.

SO THE MOTION ITSELF, UM, I D I MEAN, I SUPPOSE YOU COULD PUT AN V DOT ON EITHER.

I MEAN, HOWEVER, YOU, HOWEVER YOU MOTION, UM, YOU KNOW, BASED ON THE COMMENTS FROM A PLANNING COMMISSION STAFF AND V DOT, I DIDN'T THINK TO ADD THAT, BUT, UH, HOWEVER YOU MOTION, WHATEVER, UM, THAT CERTAINLY CAN BE DONE.

UM, NUMBER THREE WAS THE ONE THAT I ADDED.

THAT'S WHY YOU HAVE THAT AT THE OTHER PAGE, UH, CONDITION THREE, IT APPEARS THAT WHAT YOU'VE DONE I BELIEVE IS ADDED THE V.SITE DISTANCE STANDARD TO THE, UM, CONDITIONS FOR THE CONDITIONAL USE PERMIT REQUIREMENT.

ANYWAY.

SO WE WOULDN'T HAVE TO RESTATE IT DOWN HERE BELOW.

I DON'T THINK, I THINK IT'S ALREADY INCLUDED BECAUSE IT'S PART OF THE CONDITIONS AS RECOMMENDED BY THE PLANNING DEPARTMENT.

OKAY.

I DID CONTACT, YOU KNOW, MYSELF AND I DO HAVE TO GO THROUGH THAT LAND USE PERMIT PROCESS WITH THE DOCTOR AND HAVE THEM APPROVE THE PLANS THAT THE CONTRACTOR STARTS WORK AND THEN GET APPROVAL AFTER THE WORK IS DONE.

SO I DO HAVE ACCEPTED THE RESPONSIBILITY OF CHANGING THAT IT, AND WE WOULD NOT.

AND THAT'S WHAT I WAS CONCERNED ABOUT.

YEAH, IT'S BEEN, IT'S BEING ADDRESSED.

YEAH.

UNTIL, UNTIL WE RECEIVED THAT SIGN OFF STAFF STAFF FROM V DOT ON THAT LAND USE PERMIT, WE WOULDN'T ISSUE THE CERTIFICATE OF ZONING.

HE WOULD NOT BE ABLE TO ESTABLISH THE USE.

I MEAN, HE, HE COULDN'T GET HIS BUSINESS LICENSE.

HE COULDN'T GET TRANSIENT LODGING, YOU KNOW, I MEAN, HE CAN, HE CAN DO THE BALANCE OF WHAT'S REQUIRED BY THE SUPPLEMENTAL REGULATIONS, WHICH IS HIS WATER QUALITY TEST, HIS, HIS, UH, SEPTIC INSPECTION, HIS, UH, HIS LAND LINE.

HE CAN DO, UH, THE INSPECTION FOR SMOKE AND FIRE DETECTORS THROUGH THE, UH, BUILDING INSPECTIONS DEPARTMENT.

AND WITH THAT CHANGE OF USE TO THE TRANSIENT LOGIC, BUT HE'S NOT GOING TO BE ABLE TO, UNTIL WE GET THAT BASED ON THIS CONDITION, HE WOULD NOT GET A CERTIFICATE.

IS THERE ANYTHING FROM US IN ORDER TO START THAT BUSINESS? AND THAT'S THAT'S WITH ANY COMMERCIAL BUSINESS THAT WE HAVE COME THROUGH OR ANY, ANY SHORT-TERM TOURIST RENTAL UNTIL THEY RECEIVE THAT CERTIFICATE, AS THEY'RE LEARNING FROM US STATING THAT THEY'VE MET ALL THE REQUIREMENTS, THEY'RE NOT GOING TO BE ABLE TO START THAT BUSINESS WELL, AND I'D LIKE TO ADD THAT CONDITIONAL USE IS UPON CONDITION.

SO YOU'RE ONLY GETTING IT AS LONG AS YOU FOLLOW THE CONDITIONS, SHOULD YOU NOT FOLLOW THOSE CONDITIONS? WE CAN ALWAYS RESEND THAT CONDITIONAL USE.

SO, YEAH.

NOW MY QUESTION WILL BE, DOES VITA GIVE YOU AN, UM, A REPORT THAT THEY'VE INSPECTED THAT CHANGE AND THAT IT MEETS THEIR REQUIREMENTS BEFORE YOU WOULD ISSUE THAT WE CAN CERTAINLY REQUEST THAT I WOULD LIKE TO ENSURE THAT ABSOLUTELY.

OKAY.

IS THERE A MOTION ON THIS? ALL RIGHT.

I MOVE THAT THE BOARD OF SUPERVISORS APPROVED THE CONDITIONAL USE PERMIT REQUEST OF JUSTIN AND FELICIA CATS OF IT'S FOR SHORT TERM TOURIST RENTAL WITH THE CONDITIONS AS RECOMMENDED BY THE PLANNING COMMISSION AND STAFF AND WITH THE V DOT APPROVAL.
